Dear Mr. Cunningham:
This is a Fire and Life Safety Plan Review and is based
on the 1991 editions of the Uniform Fire Code (UFC) and
those sections of the Uniform Building Code (UBC) and
Uniform Mechanical Code (UMC) specifically referencing
the fire department, and other ."ocal ordinances and
regulations.
This review covers the tenant modif.ir-ation to the above
noted occupancy. The plans as submitted are not approved ,
at this time, subject to Tigard Building Department v
requirements and the following:
After talking to Fire Investigator Martin Scott, I
believe this building was involved in a fire on March 30,
1993 . This building may house four residences upstairs
and businesses that include welding or other potentially
hazardous operations downstairs. If so, specific p
occupancy separations, egress and secondary egress, 5/8
inch sheet rock versus Firtex, smoke detection or
automatic fire protection considerations and other
.standards should be reviewed before proceeding. Plans
would need to be submitted to Tigard Building Department
for approval prior to new construction.
A fire extinguisher_ having a minimum rating of 2A10B:C
must be placed in an accessible location within plain
view. UFC Sec. 10.30? (a)

SUBJECT: Meeting with Lee Cunningham
The following are a list cf requirements stated during the meeting with Lee
Cunningham, that need to be addressed dependent upon his intent for the use of
the property/buildings.
If the upstairs is used as living quarters:
A one-hour occupancy separation is needed and all the requirements
that go along with this code.
If the sculpture shop is usFd, it e..1so requires a one-hour occupancy
separation.
r, Dependent upon who does the work, the contractor can submit the
assembly, George will go over the options of assembly with
Cunningham.
The upstairs also requires that the exiting be fixed and brought up
to code.
The downstairs does not require an occupancy separation if it is
being used as "sole use. "
To use the building now, for his own office:
A "No dwelling/sleeping units" aign will be posted.
Power will be turned hack on.
15 day correction notice will ue issued. Contractor will contact Bob
Nolan, and dependent upon the work he does, the building will be
brought to electrical code accordingly.
The stairway h s to be upgraded to code if they are to be used at
all.
Cunningham's intent at this point, so t) it he can use the building,
is "no dwelling" -- he is also engaging an Electrician.
All incorrect wiring is to be remc,.ed -- i.e. -- extensions cords
wiring from the building to shed, etc.
Needs to give intent on the "shed" the painter used, and if it is
still to be used as such, needs to be brought up to code.
Either all electrical codes will be mat, or outlets, etc. will be
deactivated.

Two of the trailers are no longer being lived in
--- one of them is being used as storage
--- the other trailer, Lhe owner is in jail
The third trailer apparently still has two gentlemen living in
it, and they had requested to Mr. Cunningham to rent for
another month or so. They w�]' be leaving for Alaska. Mr.
Cunningham, said he would tell them they cin not reside there
any longer.
The camper that has been there "comes and goes", but at this
time there is not anyone living ;.n it.
Ken requested that there be some kind of time frame on classifying the prop arty
so that "things" are not left in limbo.

the above address, in a building owned by you.

Subsequently, the Washington County Electrical Department has
ordered the electrical service discontinued. Other viol.aticns
include, but are not limited to, mixed occupancy without proper
fire separation, remodel and alteration without proper permits,
i possible illegal woodstove and inadequate and unsafe exiting.

Dear Mr. Cunningham,
In a letter dated October 14, 1992, you were informed that a
building constre.icted on the above referenced property was in
violation of the Tigard Municipal Code. You were also informed that
it would be necessary to correct this violation within five days.
As of this date, the building remains in violation.
The letter notified you to obtain the appropriate permits, or
remove the building. In a subsequent meotinq you had with a City
Planner, you were informed that the land use regulations would not
allow for construction of this building, therefore it wi.11 not ba
possible to obtain tt.e required permits.
1 You arc- hereby notified to completely remove thA structure from the
site within five days of receipt of this letter. . Failure to comply
will result in the issuance of a civil infractions summons and
complaint.

not been dropped" regarding the city's concerns.
Perhaps you remember me, I became active as a volunteer recruit--.d ty Aill
Monahan , and have been on some committee or seminar ever since. At one time
I ran against Val Johnson Councilwoman, so you no doubt have seen me around
there.
It eeems I have rein afoul of nuildinq codes and as there are many mitigating
circumstances regardinq a very small. temporary structure T've constructed.
T have requested a meeting with you specifically , either in, or perferable out
of the office.

It has come ' a the attention of this department, that a building
has recently been constructed on the above referenced property.
There it; no record of issuance of permits, or approval of
inspections for this structure. This is a violation of the Tigard
Municipal Code Title 14. On October 13, '.992, a "Stop Work Order"
was posted on the structure, requiring appropriate permits and .
inspections be obtained, or the structure to be removed. The notice
also requires that no occupancy of the building is allowed, until 1
such time the building is brought into conformity with the
'� applicable regulations.
You are hereby notified to correct the abova violation within five
days of OctobeL• 13, 1992. Your cooperation in this matter will, be
appreciated.
