In response to your letter of November 26, 1979, and with reference to item
kl of Plans Examination Report No. 1284, it seems to us that Mr. Johnson and
the State of Oregon's attitude, policy or whatever with respect to waiving the
fire protection requirements in the case of property line exposures prescribed
under Section 504 of the State Building Code is rather, ill advised. From our
experience, limited as it may be, we have found that planning rules, tools,
regulations and so on remain, more car less, in a state of flux and what may be
true today with respect to covenants and restrictions does not necessarily
apply tomorrow. For this reason, and in the interest of the safety, health
and welfare of the public, we feel obliged to not follow the State's lead
with respect to this issue.
On the other hand, in the case under, discussion, it becomes somewhat irrele-
vant since the west wall , which is located 8' or 9' from the west property
line, is of masonry construction and does comply with the code. Also, the
south wall which is located roughly 25' from the south property line, when
constructed in accordance with the revised plan which accompanied your letter,,
will be in substantial comp, tance with code requirements. The north and east .
walls are acceptable as shown on the drawings. Therefore, and since we re-
ceived the foregoing information regarding the property line from the Tigard
Building Department, it will not be necessary to file an additional plot plan
as requested in requirement ul of glans Examination Report No. 1284.

Regarding the issues addressed in hent #2 of the referred to plans examination,
report, as indicated in the foregoing, with respect to the south exterior wall ,
the stipulations contained in your 'letter concerning both the construction of
the south wall and the wall along grid line H is acceptable and hereby approved. `
As indicated in our previous telephone conversation regarding exterior wall
openings referred to in item #2 of the report, the allusion concerned night
depository, not the entrance door which is at a 900 angle from the property line.
The detailed drawings of the construction of the night deposit facility whici►
accompanied your letter satisfies that issue.

Since you have stipulated that you will comply with the remainder of the regiire-
ments listed in the report, and since requirements N.1 and #2 are satisfied a,
indicated in the foregoing discussion, we have no further objection to the issuance
of a building permit or commencement cf construction. We trust this letter will
assist in clearing the way for the further development of the project. Please
let us know if we can be of service in any other way.

This letter is in response to your plans examination report
No. 1284, for the U.S. Bank at the Greenway Town Center,
dated 11/19/79. I wa.11 respond to the items you listed

Item No. 1
As you are aware, the P.U.D. planning tool establishes
specific relationships and plan configuration of buildings
within a set boundary. Parking and access drives are
likewise defined and controlled. The separate owners of
the indivilual tax lots have given up their normal property
rights to relocate buildings within their tax lot. Mr.
Ray Johnson of the State of Oregon Commerce Department 1
indicated that due to the above reasons, the State of
Oregon waives the protection requirements set forth in
section 504 (A) and (B) . The Clackamas Town Center Project
has recently received this exception granted upon receipt
of a letter of request. I here by wish to request this
same exception based on the above reason- for the United f
States Bank Project.
Item No. 2
We a-e aware that the 1979 S.B.C. will omit this requirement,
but since we are still working under the 1976 S.B.C. we will li
comply to aviod delay. Please see the revised partial section
4/A3, which defines an equivalent 1 hour assembly for the south
wall of the building.
We will revise the wall assembly on grid line H, above the lower
roof as follows : omit 1/2" plywood sheathing as shown. Replace
with 1/2" gypsum sheathing :,pard in 4'x8' sheet size only per

You refer in your last paragraph in item no. 2 to section
504 S.B.C. concerning protect )n of walls and openings.
Again, since we are using the State Building Code, I
consulted Mr. Ray Johnson concerning section 504(b). He
stated that this parapraph grants an exception from the •
protection requirements in that the wall and opening in
question are ninety degrees to the tax lot line. Plus,
in this particular -ase we have an eight inch block wing .
wall extending out four feet from this wall for additional
protection,

1 . The plans submitted to and examined in this office did not contain an accurate
plot plan showing the relationship of the exterior walls of the building to the
lines of adjoining property. That is, the Greenway Towncenter is situated on
separa+,e parcels of land rather than being located on one cax lot. Accordingly,
real property lines exist which have a significant bearing upon building con-
struction. An accurate to scale plot plan must be submitted.

In addition, and with reference to item #1 , if our memory serves us correctly
there is a property line running north and south on the west exposure of this
building. No openings are permitted within 5 ft. of a property line, and
openings located between 5 ft. and 10 ft. from a property line must be served
by fire rated door or window assemblies.

3. The plans submitted to and examined in this office contained no electrical
or heating, ventilation or air conditioninq plan. Prior to the installation
of any HVAC equipment and its attendant duct work, complete mechanical system
plans must: be submitted to and approved by this office.

4. Part one of Section 08700 of the specifications prescribed that finish hardware
shall be in compliance with applicable building and fire codes. However, accord-
ing to our interpretation of the contract documents, exit doors #1 and #2 will
be fitted with deadlocks.
Exit doors are required to be openable from the inside at all times without the
use of a key, special knowledge or effort. However, keyed deadlocks may be em-
ployed if they are of the "indicating type" and there is posted on or adjacent
to the door a sign reading "This Door To Remain Unlocked During Business Hours"
in letters not ess than one inch in height on a contrasting background.

5. Referring to Sec`ion ("i-100 of the specifications and particularly part 3 thereof
relating to fire S'lOpping, fire stopping consisting of 2" (nominal ) lumber,
gypsum plasterboard or equivalent material is required:
a) At all floor and ceiling lines in wood framed walls and partitions.
b) At maximum vertical and horizontal intervals of 10 feet in all wood framed
walls and partitions. �
c) In furred walls at the ceiling lines and at maximum 10 ft. horizontal inter-
vals.
Penetrations made in this prescribed fire stopping to accommodate wiring, plumbing,
duct work and similar utility runs must be packed following the installation of b
said utility runs, in a manner which will effectively maintain the integrity of Lt
the fire stopping and cut of all concealed draft openings which could afford a
passage for flame.

6. Regarding part 2 of Section 07200 of the specifications, insulation must not be t;
placed within 3" of the sides or 24" of the top of recessed light fixture enclosures
or similar heat generating devices.
