Dear Mr. Echauri,
I kava become aware of an issue regarding the recent minor land partition
on your property (MLP 88-20).
A requirement of the partition was to provide access for the existing res-
idence to the sanitary sewer system, which was done by providinc•, an ease-
ment along the west property line. However, the attached sanitary sewer plan
shows there are two service laterals provided to the property, of which the
easterly most line would appear to provide better access for the existing
residence.
The point I am trying to make, is, you may want to consider providing an
easement along the east property line for access to the sanitary newer of
the existing residence. The service lateral near the center of the property
would easily accommodate any new structure that may be constructed on the
vacant parcel..
I do want to make it clear that it is not required of you to change the
location of the easement Frovided, however, it may be difficult for the
existing residence to ac-':! .4s the service line near the center of the lot,
considering the easement loes not run along SW Rlrose ST. Should a new
building be constructed - ► the second parcel prior to connecting the
existing residence, it ►i„p be very costly to replace sidewalks and driveways
that may have to be removed for excavation.

NOTICE OF DECISION
VARIANCE V 12-85
APPLICATION: Request by Edward and Kay Echauri for a Variance to allow the
ccnstruction of an 864 square foot building with a maximum height of 13 feet
where a 500 square foot and 12 foot height are permitted on properly zoned
R- 4.15 (Residential, 4.5 units/acre) and located at 9760 S.W. McDonald St.
(Wash. Co. Tax Map 2S1 11BA, Tax Lot 500).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described application subject to certain
conditions. The findings and conclusions on which the Director based his
decision are as noted below
A. FINDING OF FACT
1 . Background
No previous land use applications relating to this property have.
been reviewed by the City .
2. Vicinity Information
All of the surrounding properties are zoned R-4.5 (Residential,
4.5 units/acre) . McDonald Acres subdivision lies to the west and
larger parcels are to the east. McDonald Street and Elrose Street
border the property on the north and youth.
3. Site Information and Proposal Descripticn
A residence is situated in the northern section of the property
with access to McDonald Street. There are two accessory buildings
in poor repair in the central portion of the lot.
The applicant proposes to construct a 36 by 24 foot building
totaling 864 square feet. The height of the building at the roof
peak will be 13 feet. The building will have an 8, 30, and 52
foot setback from the east, south, and west property lines
respectively . An access drive is proposed to Elrose Street All
other accessory buildings on the parcel will be removed, "
4. Agency and NPO Comments
The Engineering Division notes that a street opening permit will
be required to obtain access to Elrose Street.
The Building Inspection Division has no objection.

8. ANALYSIS AND CONCLUSION
Section 18. 134.050 of the Code requires that the following approval
criteria for variance proposals be met:
1. The proposed variance will not be %aterially detrimental to the
purposes of this Cade, be in conflict with the policies of the
Comprehensive Plan, to any other applicable policies and
standards; arh; ;,- other properties in the same zoning district or
vicinity;
2. There Are special circumstances that exist which are peculiar to
the lot size or shape, topography or ether circumstances over
which the applicant has no control, and which are rw t applicable
to other properties in the same zoning district;
3 "The use proposed will be the same as permitted under this Code and
City standards will be maintained to the greatest extent that is
reasonably possible, while permitting some economic use of the
land;
4. Existing physical and natural systems, such as, but not; limited to
traffic, drainage, dramatic lard forms or parks will not be
adversely affected any more - than would occur if the development
were located as specified in the Code; and
5. The hardship is not self-imposed and the variance requested is the
minimum variance which would alleviate the hardship.
The primary purpose of the size (500 square feat) and height (12 feet)
limitations for detached accessory structures is to maintain the
residential character, of neighborhoods by not all.-wwing buildings of a
size that are commercial or industrial in appearance. The size and
height limits only apply to detached accessory buildings . Attached
garages are subject only to the height and setback requirements for a
residence. Also, the Code has no limit on the number of accessory
buildirqs and the applicant could have two 500 square foot buildings and
meet the applicable requirements. The residence is situated in such a
manner that only a d&tached accessory building is pos.ible .
The applicant presently does not have a garage and the proposed building
will serve as a garage and small shop building. No commercial activity
is proposed nor would one be permitted.
The building will exceed the maximum height allowance of 12 feet.
However, thR applicant will provide considerably more than the required
building setback of 5 feet. Tris added setback will compensate the 13
foot height by not locating an oversized building in a way than: would
adversely affect an adjoining propert.y .
Except for the height and size variance, the proposed structure is
consistent with a - `her aspects of the City Code

C. DECISION
The Plannipg Director approves V 12.-85 subject to the following
conditions
1. ilding permits shall he obtained prior to construction
2. A street opening permit shall be obtained from the Enginaering
Division (contact Jonn Hagman or Randy Clarno) for access to
Elrose Street.
3. The building shall not exceed 13 feet in height or 864 square feet
in floor area. The building shall be lucated as shown on the plan
submitted with a minimum setback of 8 feet to the east and west
and 20 feet to the south.
4. No commercial/industrial activity Shall be permitted,
5. Thi-.% approval is valid if exercised within one year of the final
decinior, date noted below.
D. PROCEDURE
1. Notice: Notice was published in the newspaper, posted at City
