APPLICATION: A request by Edward and Mary Mat.tive for approval of an
Accessory Use Permit to allow constr•u, tion of a 480 square foot storage shed
on property zoned R-4.5 (Residential, 4.5 units/acre) . Location: 12755 SW
Marie Court (WCTM 2S1 4AD, Tax Lot 400) .
D_E_CISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described application subject to certain
conditions . The findings and conclusions on which the Director based his
decision are as noted below.
A. FINDING OF FACT
1 . Background
No previous applications have been reviewed by tK-w Planning Division
regarding this property.
2. Vicinity Information
R-4.5 zoning surrounds the property on all sides . Development in the
area is primarily single family residential but several duplexes arty
located immediately north of the subject property. The rear lot line
of the parcel abuts a pedestrian and bicycle access to Jack Park. The
park is located east of the subject parcel.
7 . Site Information and Proposal Description
There is currently a single family residence located on the front
por•tijn of this lot. The applicants are proposing to build a
480 square foot: storage shed in the northeast rear corner, of the lot.
The roar yard is fenced. The accessory structure will be set away
from the rear property line by six feet and the side pwoperty line by
eight feet. The pitched roof will be twelve feet high at the peak.
The shed will not contain any el-.ctrical or plumbing hookups .
4. Agency and NPO Comments
The Building Division commented that a building permit is required
prior to construction of the shed.
No other comments were received.

B. ANALYSIS AND CONCLUSION
The proposed accessory structure meets the provisions set forth in
Chapter 18. 144 of the Community Development Code (CDC) . In residentially

zoned districts and on a lot less than 2.5 acres, accessory structures up
to 500 square feet are permitted with the Planning Director's approval.
Such structures must be loc--Ated at least five feet from the rear and side
property lines.
As liscussed in the proposal description, the proposed storage shed will
meet both size limitations and setback requirements. A building permit
will be required from the Building Division prior to construction.
C. DECISION
The Planning Director approves M 88-04 subject to the following conditions:
1 . A building permit shall be obtained prior to construction of the tool
shed.
2. The building shall have a minimum setback of five feet from all
property lines.
3. This approval is valid if exercised within one year of the final
decision date noted below.
D. PROCEDURE
