Louvered Windows
Sec. 5405. Regular plate, sheet or parterncd glass in jalousics and louvered
windows shall be no thinner than nominal 7/12 inch and no longer than 4H inches.
When other glass types are used,design shall be submitted to the building official
for approval.Exposed glass edges shall be smooth.
Wired-glass with wire exposed on longitudinal edges shall not be used in
jalousics or louvered windows.

the 1985 editions of the Fire arid Life Safety Code (ULC ) ,
Mechanical Fire and Life Safety Code (UMC ) , Uniform Fire

DECISION: Notice is hereby given that the Planning Director for the City or
Tigard has APPROVED the above application subject to certain conditions . The
findings and conclusions on which the Director based his decision arp as noted
below.
A. FINDING OF' FACT
1. Background
The building presently occupying this property was built in the early
part of this century. Prior to its present commercial use the Tigard
Library was located in the building from 1967 to 1986. No previous land
use applications have been reviewed by the Planning Division regarding
this property.
2. Vicinity Information
ThA subject property is surrounded on all sides by CBD zoning with a PD
(Planned Development) overlay existing on property to the southwest.
Development in the vicinity is confined to retail/commercial
establishments along Main Street and Pacific Highway. Vehicle storage
areas are also located in the vicinity.
The Fanno Creek floodplain is situated nearby with the rear portion of
this property in close proximity to the main creek channel. . The
existence of the said floodplain has restricted development on land
behind this parcel so that: it remains vacant,
3 . Site .Information and Proposal Description
The proporty presently is used as a store for retail sales of paint and
painting equipment and as a studio for a Karate school. Renovation is
pro-Lently occurring in the main part of the building which serves as the
paint store. The applicant was made aware of the need to get City
approval for Site Development Review only after work had commenced in the
building.
4 . Agency and NPO Comments
The Engineering Division has reviewed th- proposal and makes the
following comments:
1 . All public improvements now exist at this site, Applicant' s plan
does not provide sufficient information to evaluate access--egress
nor parking situation. We need property lines and dimensions
thereon, also need to know where the building is situated in
relation to tract boundaries .
2 . Parking, as illustrated on site plan, does not lin on applicant' s
tract.

3. Maneuvering area for vehicles utilizing parking spaces fronting the
building is on the public sidewalk.
4. Elimination of the driveway, now bisected by applicant's easterly
property line, would be desirable due to the acute angle of approach
that existing vehicles must assume when leaving the site. At the
very least, a joint use agreement should exist there with Valley
Auto Parts.
The Tualatin Rural Fire Prevention District has reviewed the proposal and
makes the following comments:
Building exiting system shall be made to comply with UBC existing
requirements.
The Building Division, General Telephone and PGE have reviewed the proposal
and have no objections to it.
NPO N1 has reviewed the proposal and
B. ANALYSIS AND CONCLUSION
There are two main concerns with this proposal, one being the parking
situation and the other having to do with the correct property boundaries of
the parcel . The Community Development Code (CDC) requires 1 parking space for
each 400 square feet of gross floor area with no fewer than 4 spaces
provided. Since the building has 5900 square feet of gross floor area, a
minimum of 15 spaces are required. As indicated on applicant's site plan, 16
parking spaces are contemplated. It should be noted that the previous use, a
library, also had a parking requirement of one space for every 400 square feet
of gr•035 floor area.
A problem does exist with the arrangement the applicant has proposed for
parking. The six spaces in front of the building are a potential public
hazard because they require parked cars to back out onto the sidewalk when
preparing to leave the site. Such a situation is unacceptable to the City and
an alternative parking configuration for the front of the building must be
submitted for inspection. When the Library was located at this site, parallel
parking was situated in front of the building. However, when the parking area
was re--striped, the original parking formit was changed.
The second concern, the boundary lines of the property, is confusing and needs
clarification. The tax map containing this property shows a front property
line of 55.4 feet, However, the site plan portrays a building 65 feet wide
with a 20 foot wide driveway on the western side which adds up to OF) feet in
width. Since a property line apparently bisects the building at some point,
it may not conform with Uniform Building Code and Fire Code.
Because of the age of the building and the absence of any requirements at the
time of construction, the building is regarded as a legal nen-conforminq
structure that would have to be brought int- conformce only if significant
remodeling or reconstruction occurs.
C. DFC]SION
The Planning Director APPROVES SCR 87-07 subject to the following coslditions :

1 . A modified parking plan shall be submitted to the City's Engineering
Division which shows a parallel parking arrangement for the front of the
building.
