Renaissance Developmgnt
APPLICATION: A request by Renaissance Development Company for an Administrative Variance
to the minimum side yard setback of five feet to allow a setback of four feet along the
east: side of a newly constructed home. -rho property is coned R- 4.5 (Residential, 4.5
units/acre) . Location: 12372. SW Millvieu Court: (WCTM 1S1 34CL, Tax Lot 13300) .
DECISION: Notice is hereby given that the designee of the Planning Director for the
City of Tigard has APPROVED the abova application subject to certain condit+.ons. The
finding•i and conclusions on which the decisi,an is based are as noted below.
A. I.-INDING OF FACT
1 . Background
No previous applications have been reviewed by the Planning Division with
respect to the subject pruperty.
2. Vicinity Information
Surrounding properties in all directions are also toned R-4.5 and are developed
with single family residences. All immediately adjacent ►.uLs are already
developed.
3. Site Information and Proposal Description
A single family residence has recently boon constructed on the lot. A mistake
was made during construction resulting in the house being constructed four feet
from the eastern side property line rather than the required five foot setback.
A variance to the setback requirement has therefore been r -aquest:ed in order to
legalize the building's location with respect to City requirements . A lot line
adjustment between the suhjet parcel and the parcel to the east is not
practical because the house on the adjacent parcel is set back the minimum five
feat from the property line.
4. Agency and NPO CommenLs
The City Building and Engineering Divisions as well as the Washington County
Fire District have reviewed the proposal and have no objections to it. PGE and
the Tigard Water District also offered no comment on the proposal .
No other comments were received.
P. ANALYSIS AND CONCLUSION
Section 18.134.050 cantons criteria whereby the Director may ipprove, approve wit +
conditions, or deny an application for an Administrative Variance, They are:
1 . The proposed variance will not be materiall!, detrimental to the purpo.ies of this
Code, be in conflict with the policies of t:he Comprehent ive Plan, `.n ;Any other-
applicable
therapplicable policies and standards; and to other properties in the smme zoning
4istrict or vicinity.
2. . There are special circumstance :atexist which are peculiar to the lot size or
shape, topography, or other c .icumstances over- which the 4oplicent has no
control, and which are not applicable to other propertien in the same zoning
district;

3 The use proposed will be the same as permitted under this Cody and City
standards will be maintained to the greatest extent that is reasonably passible,
while permitting some economic use of the land;
4. Existing physical and natural systems, such as but riot limited to traffic,
drainage, dramatic land forms or parks will not be adversely affected an more
than would occur if the development was located as specific in the Code; and
'). The hardship is riot self-•impu4od and the variance requezted is the minimum
variance ;•hich would alleviate the hardship.
The requesteu variance to the five foot side yard setback requirement- satisfies
these criteria. The primary purpose of the setback requirement is to allow for
adequate light, stir arid privacy for residential structures. B-acause the garages
for both homes wou next to the affected side yard, these purposes would riot be
adversely impacted granting the variance. The need for the variance arises from
a mistake in construction and thus nri precedent is set for allowing similar
variances for other proper-ties without a similar peculiar situation existing. The
uses allowed on the parcel would not be affected by granting the variance. All
other Code standards and Plan policies are satisfied with regard to this property
and would not he :effected by the requested vari:.nce. No impacts upon other
properties or iApon physical or natural systems are foreseen by allowing the
requested variance. Although Lho meed for the variance is self--imposed, the need
arises fr•rnn a mistake rather than an intent to circumvent the requirement.
C. DECISION
the Planning Director for the City of Tigard hereby approves Variance V 88--.28
requested by Renaissance Development,
