The Commission based its decision upon the facts, findings, and conclusions noted below: A. FACTS 1 . General Information CASE: Sign Code Exception SCE 89--01 i REQUEST: To retain an existing 2.1 .65 (21 '7") foot tall nonconforming freestanding sign where the Cude allows a maximum sign height of 20 feet. COMPREHENSIVE: PLAN DESIGNATION: Commercial General ZONING DESIGNATION: C--G (Commercial General) APPLICANT: Blare Signs of America OWNER: Texland Properties P.O. Box 25357 2828 North Haskell Portland, OR 97225 Dallas, Texas 75204 LOCATION: 10650 SW McDonald Street (WCTM 2S1 10AA lot 600) 2. Background Information The subject property was annexed to the City of Tigard in 1Q65, No record of a building permit-, building plans or any kind of development review application could be found by staff. Staff therefore assumes that the site was developed while it was in Washington County. No sign permits for either the subject freestanding sign or a wall sign could be found. 3. Vicinity Information Properties to the north and west are also zoned C—G. Properties to the east and south are zoned and developed R-12 (Multi—family Residential, 12 units per acre maximum density) . 4. Site Information and Pro osal Description 'The site is currently occupied by a. 2160 square. foot commercial food and beverage retail sales business. FINAL ORDER NO. 89-02 PC — TEXLAND PROP. Atop the sign is a vary large parking lot light. The sign sits at the eastern end of the S.W. McDonald Street; entrance and is oriented towards east and westbound traffic on S.W. McDonald. The sign height has been measured to be 21 .65 feet high with an area of approximately 39 square feet. The subject sign has been considered nonconforming as a March 20, 1988, and the property owner was notified of this in February, 1988. A voluntary compliance agreement was signed indicating the willingness on the part of the owner to take some action to rectify the nonconforming sign once the City notified him of the adoption of new sign code regulations . The property and business owners were cited for the following nonconfor•mit:ios: 1 , -Coo high fr-eestandirig sign, a violation of .vection 18. 114. 130(c)(1)(D) . Ordinance 88--20 incorporated numerous new regulations into the sign code. Since September of last year business and property owners havo consulted with staff as to how their individual signs might be brought into compliance. During one such discussion, staff was challenged as to the actual height of the subject: sign, The 21.65 foot height was verified in the field. Unfori.unately, the additional inches in excess ; of what is allowed could not qualify for an Administrative Exception and so this application was generated. "i 5. Electric have all reviewed the proposal and have no objections to it. �4 No other comments were received. 4 B. FINDINGS AND CONCLUSIONS vl\ Section 18. 1.14. 145 of 'Tigard's Community Development Code contains the H, criteria whereby the Planning Commission can approve, i approve with modifications or deny an application for a sign code exception. The are: + (1) The proposed exception to the height limits in the Sign Code is necessary to make the sign visible from the street because of the topography of the site; (2) A second freestanding sign is necessary to adequately identify 'l a business or premises that is oriented towards a primary street but whose main access is from a secondary street; r FINAL ORDER NO. 89-02 PC - TEXLAND PROP. (Blaze Signs) SCE 89-01 - PAGE 2 I,ti ;1 (3) Up to an additional 25 percent of sign area or height- may be permitted when it is determined that tho increase will not deter from the purpose of this Chapter. This increase should be judged according to specific needs and circumstances which necessitate additional area to make the sign sufficiently legible. The increase(s) shall not: conflict with any other nondimensional standards or restrictions of the Chapter; (4) The proposed sign is consistent with the criteria set forth in Subsection 19. 114. 130(g) of this Chapter; (a) The proposed exception for a second freestanding sign an an interior lot is necessary because all of the following apply: (A) The combined height of both signs shall. not exceed 130 percent: of the sign height normally allowed for one freestanding sign in the same zoning district; however, neither sign shall exceed the height normally allowed in the same zoning district:; (B) Neither sign will pose a vision clearance problem or will project into the public right--of--way; (C) Total combined sign area for both signs shall riot exceed 150 percent of what is normally allowed for one freestanding sign in the same zoning district; however, neither shall exceed the height normally allowed in the same zoning district. In addition to the criteria in subsection (a) of this section, the Commission, or in the case of an Administrative Exception, the Director, shall review all of the existing or proposed signage for the development and its relationship to the intent- and purpose of this Chapter. As a condition of approval , the Commission or Director may require: (1) Removal or alteration of nonconforming signs to achieve compliance with the standarr's contained in this Chapter; (2) Removal or alteraticn of conforming signs in order to establish a consistent sign design throughout the development; and (3) Application for sign permits for signs erected without permits or removal of such illegal signs. T'he subject sign exceed the 20 `oot maximum allowable height by 19 inches (21 feet 7 inches or 21 ,65 feet) . This amount exceeds the five percent which staff could grant administratively as provided in Section 19. 114, 149. However, it is lar less than what staff could grant administratively had the applicant- for the original site development review requested a 25 percent increase in sign height as provided in Section 19. 114, 130(g) or what the Planning Commission could grant under Sign Code Exception criteria (a)(3) : 25 percent for a maximum height of 25 feet.
