REQUEST: For a minor land partition taking off approxi-
mately 10 , 110 square feet for one lot: and
7, 720 square feet for another. The existing
house will be on a 7 , 800 square foot lot.
SITE DESIGNATION: R-7 single family residential zone
PREVIOUS ACTION: None
I . F`NDINGS OF FACT:
1 . Section 17 .07 .005 through 17 .07 .040 of. the Code have been
adhered to as appropriate in this case .
2 Public services are available to these lots.
3 . SW McDonald and SW 104th Avenue are substandard and shall be
improved - SW 104th as a condition of MLP Bonded, and
SW McDonald through Nonremonstrance agreement .
II . CONCLUSIONARY FINDINGS :
1 . Minor land partitioning has been applied for under the Code.
III . STA_rF ACTION: This mirror land partitiutl is approved subject
to the following conditions :
1 . Half-street improvements to local street standards shall be
made to 104th Avenue . Sidewalks shall be installed against
the curbs and connected North to join existing sidewalk .
Improvements to SW McDonald shall be made to Collector Street
standards . 5 feet of additional R.O.W. along SW McDonald
shall be dedicated to the City prior to the issuance of
Building permits .
2 . A site drainage plan which specifically addresses the existing
drainage problem shall be submitted for review by the Staff
prior to any work being done on site .

3 . Applicant shall apply for a Conditional Use to the Planning
Commission prior to any permits being issued for site work .
One of the conditions of approval of a Conditional Use for
a duplex on the 10 , 110 square foot lot shall be that this
project shall be subject to Site Design Review.
4 . Access to SW McDonald shall be allowed for the two single
family lots . The duplex shall access to SW 104th Avenue .
5 . No Occupancy Permits shall. be issued until all conditions
placed upon this development by the City of Tigard have been
satisfied and inspections verifying this have been carried
out by the appropriate department.
6 . No changes will be made to approved plans or specifications
unless formal application is made to the appropriate City
department and changes are approved by that department.
Application for changes will be made in writing and shall
include applicable drawings .
7 . Grading and construction plans for all work in public rights-
of-way and all other public improvements shall be prepared
by a registered professional engineer_ in accordance with City
standards, and shall be submitted to the Public Works Department
for review.
All public improvements will require a Compliance Agreement
and must be (design) approved. by the Public Works Department,
and must be either (1) fully and satisfactorily constructed
prior to the recording of any mi-or land partition, public
dedication, final. plant, or issuance of Building Permits; or
(2) bonded to the City for 100% of the estimated cost thereof
prior to the recording of any minor land partition, public
dedication, final plat, or issuance of Building Permits.
8 . All proposed utilities shall be placed underground . Street
lighting installations shall. be approved by the Public Works
Department.
9 . A metes and bounds legal description and map shall accompany
a dedication of public rights-of-way, parks , open space or
floodplain areas and shall be prepared by a registered engineer
or land surveyor.
10. Half-street improvements shall be constructed to the approval
of the Public Works Dedart.ment prior to the issuance of a
Building P=.!rmit . A bond shall be posted by the property owner
with the City of Tigard for. 1508 of the cost of the half-street
improvement prior to recording the land partition witty

this Staff Report to the County to facilitate recording . YOUR
MINOR LAND PARTITION IS NOT OFFICIAL UNTIL IT IS RECORDED BY
WASHINGTON COUNTY DEPARTMENT OF ASSESSMENT AND TAXATION.
