Said premises is hereafter referred to as Pax Lot 2400, Washington Countv Assessor's Map 2S1 12C; :.rid WHEREAS, the parties desire to memorialize their agreement as to an easement granted by King to Hunziker Family and Hauser for storm sewar purposes. NOW, THEREFORE, in consideration of each party': grants and agreements hereinaftez described, and other valuable consideration, each to the other in hand paid, the receipt of which is hereby acknowledges: FIRST: Kina hereby grants and conveys to Hunziker Fami!;• and to Hauser a non- exclusive easement for construction and maintenance of a storm sewer o,: , over, across, under and through that portion of Tax Lot 2400, as described on i:.'iibit D attached hereto and incorporated herein. Said easement is hereafter referred to as the King Easement. SECOND: Said construction and maintenance shall be by and at the expense of the Hunziker Family and Hauser. The improvements so constructed and maintained through that portion of Tax Lot 2400 shall become the property of King and any successors in interest to Tax Lot 2400. said easement shall be to use and maintain in common with King, said storm sewer improvements, and shall benefit, in addition to King's property, Tax Lot 2200 owned by Hunziker Family, and Tax Lot 2201, owned by Hauser. The existing catch basin and storm drain may, pursuant to this easement, be accessed and used, accessed and modified in Page 1 - kGREE.MENT FOR EASEMENT accordance with Exhibit E so as to effectively serve Tax Lots 2200 and 2201, in addition to properties presently served by said existing facilities located in said easement area. The Hunziker Family and Hauser warrant the storm sewer to be constructed on Tax Lot 2400 to be of ecaal or better material and capacity than the now existing catch basin and storm drain. The Hunziker Family and Hauser shall indemnify and hold King harmless from any liablity arising out of the construction of said storm sewer, including but not limited to the payment of any materialmen 's liens. The Hunziker Family and Hauser and respec-ive successors in interest shall henceforth maintain at their expense . .omprth-nsive general liability insurance in the amount of FI7E HMIDRED THOGSANr DCLLaRS ($500,000.00) , covering said easement, naming Kina or his successors as additional insureds and provide Fina or his successors evidence of the same. The Hunziker Family and Hauser shall provide King or his successors evidence of workmen's compensation insurance for any workman providing maintenance or ccnstrcction on said sewer line before such :pork is performed. THIRD: :causer grants and ccnvevs to Htnziker Family a perpetue.�, non-exclusive Aasement to construct and maintain a storm sewer pipeline along, over, under, through anc.' across, a strip 10 feet_ in width adacent to the southwest property line of Tax Lot 2201 extending 275.05 feet, more or less, from Hauser's east property line to Hauser's west propert? line. Said easement is more particularly described on Exhibit F hereto attached and by this reference incorporated hereii.. Hauser agrees that the fulfillment deed for Hauser's j contract of purchase from Hunziker Familv shall reserve said easement for the benefit of all of Tax Lot 2200, j FOURTH: Hunziker Familv agrees to pay all costs and expenses of initial const--cticn and/or modification of storm drain system to be installed along the southwester•, line of Tax Lots 2200 and 2201 to a manhole in the easement granted by King to access the storm sewer in that easement extending to Hunziker Rcad. FITTH: I_` King, within five -.'ears of the effective date of this agreement, desires to move the location of the existing storm sewer line, King will grant such easement modifications as may be neces.sar_, to provide continued storm sewer drainage from the Hunziker Familv'procerty and the Hauser property to Hunziker Road. The Hunziker Familv agrees that it will. pay 50% of the reasonable constrilctien cost of relocating said storm drainage across King's prop rty to Hunziker Rcad, if moved within said five-gear period. ^his obligation shall be Personal to the Hunziker Familv. SIXTH: This agreement shall bind and inure to the benefit of, as the circumstances may require, not only the immediate parties hereto, but also their respective heirs, executors, administrators and successors in interest as well. The obligations and benefits hereto shall run with the land described. SEVENTY: -he maintenance of the storm sewer to be constructed across tax lot 2400 as described above, shall be a shared res"nsibility of the owners of tai; lot '200 and 2201 described herein. The ebligat'_on tj share maintenance costs shall begin when storm sewer access and modifications have been ccmpLeted. Hcwevf�r, in the event the required maintenance is the result of excessive or, improper use by tax lots 2200 and 2201 or future portions thereof, or damage caused by the owners or occupants of tax lots 2200 and 2201 or future portions thereof, those maintenance and repair costs shall be borne exclusively by the owner of the property from which the damage resulted. The Hunziker. Family and Hauser and successors in interest of Tax Lots 2200 and 2201 shall indemnify and hold King harmless from any and all maintenance required, or anv liability arising out of maintenance performed or resulting from nonperformance of maintenance on the storm drain system to be contructed on Tax Lot 2400. Thisprovision shall not be construed to exculpate King from liability to repair damage caused by King or his successor, except for wear from crdinari use of said fac'.lities. EIGHTH: T,ie easement gr<;nted above by King shall crntinue in perpetuity, subiect to revocation under the following conditio:is: (1) Non-r_omoletion of storm-sewer constrc,ction within six months of the date of this agreement; (2) Any breach of the above obligations by the Hun^iker Family, Hauser, or the successors in interest of Tax Lets 2200 and 2201. The Hunziker Family, Hauser, or their successors, shall be entitled to written notice of any act constituting a breach and not less than 50 days within which to cu):e said breach, before said breach may be affective to cause revocation of the easement. NINTH: In any suit arising: out of this agreement or ea:aement given, the prevailing party may recover its further costs and attorneys' fees incurred in such suit, and on appeal. TENTH: in construing the foregoing agreement, the plural shall mean and include the singular whenever the context so requires. Said easement is hereafter referred to as the King Easement. SECOND. Said construction and maintenance shall be by and at the expense of the Hunziker Family and Hauser. Hauser agrees that the f+ilfillment deed for Hauser's cc11trdct of purchase from Hunziker Family shall reserve said easement for the benefit of all of Tax Lot 2200. FOURTH: Hunziker Family agrees to pay all costs and expenses of initial constr_ction and/or modification of storm drain system to be installed along the southwester_y line of Tax Lots 2200 and 2201 to a manhole in the easement uranted bv_ King to access the storm sewer in that easement extending to Hunziker Road. FIFTH: IF Kinc, within five .ears of the effective data of this agreement, desires to move the location of the existing storm sewer line, King will grant ^lith easement modifications as may be necessary to provide continued storm sewer 1rsinage from the Hunziker Family property and the Hauser property to Hunziker Road. The Hunziker Family agrees that it will pay 50% of the reasonable construction cost of relocating said storm drainage across King's property to Hunziker Road, if moved within said five- rear period. This obligation shall be versonal to the Hunziker Family. SIXTH: This agreement shall bind and inure to the benefit of, as the circumstances may require, not only the immediate parties hereto, but also their respective heirs, executors, administrators and successors in interest as well. The chlications and benefits hereto sl:-ill run with the land described. SEIENTv: -he maintenance of the storm sewer to be constructed across tax Lot 2400 as described =:,ove, shall be a shared rescensibility of the owners of tax lot 2200 and 2201 described 'rerein. The obligation to share maintenance costs shall bec_in when storm sewer access and moe ifications have been completed. Said Page 2 - AGREEMENT FOR EASEMENT maintenance expenses shall be shared 1/3 by Hruser, and 2/3 by Hunziker Family, though each shall be jointly and severally liaLle to King for 100• of said erper.ses. Subsequent owners of portions of tax lots 2200 and 2201 shall share expenses in proportion to the area acquired of the same and be jointly and severally liable to King for 1C0% of said expenses. However, in the event the required maintenance is the result of excessive or improper use by tax lots 2200 and 2201 or future portions thereof, or damage caused by the owners or occvp-anr_s of tax lots 3200 and 2201 or Future portions thereof, those maintenance and repair costs shall be borne exclusively by the owner of the property from which the damage resulted. The Hunziker Family and Hauser and successors in intirest of Tax Lots 2200 and 2201 shall indemnify and hold King harmless from any and all maintenance required, or anv liability arising out of maintenance performed or resulting from nonperformance of maintenance on the jtorm drain system to be contructed on Tax Lot 2400. This provision shall not be ccnstrued to exculpate King from liability to repair damage caused by King or his successor, except for wear from cr�inar;• Ilse of said facilities. EIGHTH: The easement granted above by Kine shall continue in perpetuity, subject to revocation under the follow.na conditions: (1) Non-ccmpletinn of storm-sever construction within six months of the date of tLis agreement,- (2) greement;(2) Anv breach of the above obligations by the Hunziker Family, Hauser, or the successors in interest of Tax Lots 2200 and 2201. The Hunziker Family, Hauser, or their successors, shall be entitled to written notice of any act constituting a breach and not less than 60 days within which to cure said breach, before said breach may be effective to cause revocation of the easement. NINTH: In any suit arising out of this agreement or easement given, the prevailira party may recover its further costs and attorneys' fees incurred in such suit, and on appeal. TENTH: In construing the foregoing agreement, the plural shr,ll mean and include the singular whenever the context so requires. ELEVENTH: In additional consideration of this agreement, the Hunziker Family is paying, concurrently with the execution of the agreement, King's attorney fees incurred in connection herewith in the sum oZ $ �6 g,� receipt of which King hereby acknowledges. The findings and conclusions on which the decision is based are noted below: A. FINDINGS OF FACT 1. Background The subject property was created as the result of partition (Fila No. a minor land MLP 9-86), which approved division of the original parcel of 140,000 square feet into three parcels. This property represents the eastern parcel created by this partition. The Planning Division previously reviewed an application for construction of a 16,000 square foot industrial building on this site (SDR 88-29) . No action on construction of that occurred. No proposed building other land use or development applications regarding this parcel have been reviewed by the City of Tigard. 2. Vicinity Information Properties to the northwest across Hunziker Street are zoned R-4.5 (Residential, 4.5 units/acre), and are developed primarily with single family residences. Properties to the north, east, south and west are zoned I-P (Industrial Park) and are developed with a mixture of Office and light industrial uses. 3. Site Information and Proposal Description The property is presently undevelc,•- -,, away from Hunziker Street. The applicant h p oposest to lconstruet la 20,470 square foot warehouse and office building adjacent to tt,e western property line. An access drive and parking spaces are to be provided in the eastern and southeastern portions of the property. One driveway entrance is proposed at the eastern end of the Hunziker Street frontage. Twenty parking spaces are to b , provided, loading spaceE. In addition, one at-grade loading door will to prov4.ded adjacent to the parking area. Four loading parking spaces will bu provided. The pl in provides for 20.2 percent of the site to be landscaped. In order -o take advantage of the I-P zone's allowance for 20 percent of landscaped area rather than the standard 25 percent, the landscaping plan provides for five sunset maple street trees with diameters of 3 inches •.�r neater to be planted along the Hunziker Street frontage. In addit�.on, a ten-foot wide landscaped area separates the parking area .From the street frontage. Finally, a number of trees and shrubs are located throughout the site including a combination of shrubs and trees along the aitd's eastern and western aides are intended to serve as a landscape buffer between the site and adjacent properties. 4. Agency and NPO Comments The Engineering Division has reviewed the request and provides the following comments: a. The site accesses to S.W. Hunziker :'treet, a major collector street. The existing right of way of 60 feet is the required width for a major collector. Along the frontage of the site, existing street improvemonts include a 36 foot wide pavement with a curbs a sidewalk and street lights have not been previously installed and will therefore be required. h. A sanitary sewer is available in S. W. Hunziker Street about 90 feet west of the site. A pump station with a force main is proposed. The route of the force main is not shown but appears to require an easement from the adjacent pvrcel. C. The Unified Sewerage District has established, and the City has agreed to enforce, (Resolution No. 90-43) surface water management regulations requiring the construction of on-bite water quality facilities or fees in lieu of their construction. Requiring surface water quality facilities on small vitas would result in numerous facilities that could become a maintenance burden to the City. Furthermore, the applicant has not proposed any such facilities and there are no natural depressi.ona or other areas of this site that particularly suitable for water quality facilities. Regional facilities, funded by fees in lieu of construction of these facilities would provide the required treatment with improved reliability and less maintenance. Consequently a fee in lieu of the corigtruction of on-site water quality facilities should ba assecsaed. d. Storm drainage is provided by connecting to an existing private storm drain that is connected to a public storm sewer. The puhlt%� storm sewer has inadequate capacity. NOTTCE OF DECISION - SDR 90-0020 - ROACH PAGE 2 Therefore deL'ation of storm drainage is required. Also, a juint use/maintenance agreement between the owners of tho site and owners of the private storm sewer ehn!! Id b executed. The Building Division has noted that the storm drain line along the rear property line is a private storm line. The applicant will need to show proof of right to access this storm drainage line or else will need to arrange: for other means of storm drainage. The private storm drainage line connects to a public storm sewer that may be +indersized. The applicant shall coordinate with the Engineering Division to determine whether on-site retention of storm drainage is necessary in order to avoid exceeding the capacity of the public storm sewer. The Tualatin alley Fire and Rescue District has reviewed the proposal and has commented that the required fire flow for this structure is 3348 GPM; therefore, automatic sprinkler protection will be required. In addition, hydrants must be located within 500 feet of all portions of the outside wall of the building, to be measured arot+nd the outside. Also one hydrant will be required within 70 feet of the fire department connection on the sprinkler system. NPO #5, the Tigard Water District, General Telephone, and Portland General Electric have reviewed the proposal and have issued no comments - objections No other comments have been received. B. ANALYSIS AND CONCLUSION The proposed development conforms with Community Development Code requirements for type of use, building setbacks, building height, maximum site coverage, visual clearance at drive/road intersections, sign location, off-street loading area, and vehicular end pedestrian access. However, the following aspects of this proposal warrant further discussion: 1. Parking. Community Development Code Section 18.106.0.10.D.2 requires parking to be provided at a ratio of one par'Ung spL,.ce per 1,000 square feet of building area for an industrial warehouse. Therefore, this development requires 21 parking spaces for the 20,470 square foot building. The site plan states that 24 parking spaceF, including 15 standard spaces, 4 compact spaces, one designated handicapped space, and 4 loading spaces will be provided. However, the Code's parking requirement Is not intended to include loading spaces as part of thf? required parking spaces. Code Section 18.106.080.A requires that a'-- least '_least two off-street loading spaces be pr.,.)vided for. a commercial or industrial building between 10,001 and 30,000 square feet in size exclusive of the minimum off-street parking space requirement:. Therefore, the site plan will need to be revised to provide for it least one additional off-street marking space. i NOTICE OF DECISION - SDR 90-0020 - ROACH PAGF 3 E 2. Landscaping. The Cootmunity Development Code requires that 25 percent of a developa,d parcel in the I-P zone be landscaped. If additional landscaping amenities are provided, including 3-inch caliper street trees and a minimuwn 10-foot landscaped buffer between the front lot line and the parking area, the total landscaped area of the development can be reduced to 20 percent. The site plan provides for five red sunset maple trees to be provided along the site's Hunriker Street frontage. The landscaping plan notes that all are to have a minimum caliper of 3-inches at planting. In addition, the Bite plan provides for a 10-foot wide landscaped area to separate the proposed new sidewalk along the street from the parking area. The lands^aping plan therefore satisfies the requirements for a reduction in the total landscaped area to 20 percent of the completed development. C.
