Tigard, and whereas said application was approved by the City Engineer
of said City and a permit issued, subject to and upon certain conditions,
directions, stipulations, terms, provisions and requirements provided for
in said permit , a copy of which permit is attached hereto and hereby made
a part of this bond to the same extent and effect as if written herein
and specific reference now made to all the terms, provisions,
specifications and requirements set out, declared dnd provided for in
said permit;
NOW THEREFORE, IF THE Principal herein shall faithfully and truly
observe the terms, provisions, conditions, stipulations, directions and
requirements of said permit and shall in al.l. respects, whether the same
be enumerated herein or not, faithfully comply with the same and shall

14 � 1��o DECISION: Notice is hereby given that the Planning Director's
designee for the City of Tigard has APPROVED the above request
subject to certain conditions . The findings and conclusions on
which the decision Is based are noted below:
A. FINDINGS OF FACT
1. Background
The Planning Department approved Minor Land Partition
MLP 90-0012/Lot Line Adjustment MIS 90-0009 on June 29,

A subject parcel and an adjacent 0. 36 acre parcel to the

No other ]and use or development applications for this
parcel have been reviewed by the City of Tigard.
2 . Vicinity Information
The subject parcel is surrounded by other properties
that are zoned for light industrial use ( I-L and I-P) .
Snyder Roofing, an architect's office, and a 21,000
square foot warehouse, which is currently under
construction, are located to the west of the subject
site. An office building is located to the north
across SW Hunzi.ker Read. To the east of the site is
Western Foundry. The property to the south remains
vacant.
3. Site Information and Proposal Description
The property is presently undeveloped. This site
slopes gently away from FIunziker Road. A ten foot wide
storm drainage easement is recorded along 216 feet of

the western property line. A 30 foot wide
access/utility easement exists along the eastern
property line. There is also a 30 foot wide
access/utility easement located at the southern end of
the proposed construction office/warehouse facility
which shall provide legal access to the landlocked
parcel located directly to the west.
The applicant proposes to construct a 5,940 square foot
auto .repair building and a 6,987 square foot
construction office/warehouse facility on the 1. 36 acre
site. The construction office/warehouse would front on
SW hunziker koad; the auto repair facility would be
setback approximately 250 feet from the road. One
driveway entrance is proposed at the eastern end of the
property's Hunziker Road frontage.
The auto repair facility would be provided with 44
parking spaces, including 40 spaces surrounded by a
six-foot tall chain link fence. The construction
office/warehouse facility would be provided with 13
parking spaces . Bicycle racks and designated
handicapped parking spaces will be provided near each
of the proposed structures ' main entrances .
The plan provides for 15 .4 percent of the total site to
be iandscaped. The parking area will be separated from
the street frontage by a 35 foot landscaped area which
will inclule three Glory Red Maples with diameters of
two inches or more. Landscaping will be provided both
around the perimeter of the parking area at the
southwest end of the construc ion office/warehouse and
along the entire length of the north side of the
structure.
The auto repair facility proposes that one tree by
placed within each of the two landscaped areas which
are located on either side of the facility's main
entrance. Landscaping is proposed along the entire
north side of the structure. The applicant also
proposes to landscape two approximately 400 square foot
planter areas which are located at the northwest and
southwest corners of the parking area. No landscaping
is proposed along the site's southern boundary due to
the steep slope and abutting paved accessway.
4 . Agency and NPO Comments
The Engineering Division has reviewed the request and
provides the following comments:

a. The site accesses to S.W. Hunziker Road, a major
collector street . The existing right of way of I
60 feet is the required width for a major
collector. Along the frontage of the site,
existing street improvements include a 36 foot
wide pavement with a. curb; a sidewalk and street
lights have not been previously installed and
will therefore be required.
b. Sanitary sewer is available in S. W. Hunziker
Road.
C . The Unified Sewerage District has established,
and the City has agreed to enforce, (Resolution
No. 90-43) surface water management regulations
requiring the construction of on-site water
quality facilities or fees in lieu of thein
construction. Reqniring surface water qualit,,
facilities on small sites would result in
numerous facilit,_es that could become a
maintenance burden to the City. Furthermore, t?-e
applicant has not proposed any such facilities
and there are no natural depressions or otaer
areas of this site that particularly !suitable .for
water quality facilities. Regional facili'„ies,
funded by fees in lieu of construction of these
facilities would provide the requ,..red trr;atment I
with improved reliability and .less ma;nt.enance.
Consequently a fee in .lieu of the constrr.ction of
on--site water quality facili_,:ies s;iould be
assessed .
d. Storm drainage is provided by connecting to an
existing public storm sewer located in SW
Hunziker Road.
e. Washington County has establiahe,.1, and the City
has agreed to enforce (Leslilution No. 90-65) ,

undersized. The applicant shall coordinate with the
Engineering Division to determine whether on-site
retention of storm drainage is necessary in order to
avoid exceeding the capacity of the public storm sewer.
The Tualatin Valley Fire and Rescue District has
reviewed the proposal and has the following comments:
a. The required fire flow for both of the proposed
structures is over 3,000 GPM. The maximum
allowed by current Fire Code and District
Ordinances is 3,000 GPM. Therefore, measures
need to be taken to comply.
b. All roads which allow for parking shall
accommodate an unobstructed paved surface of at
least 20 feet in width. If the roadway cannot
provide this then No Parking signs shall be
installed on one or both sides of the roadway.
C . Roadways over 150 feet in length which terminate
in dead-ends shall provide adequate turnarounds .
Turning radius shall not be less than 45 feet
outsi_ee aiA 25 feet inside. In this case, the
roadway which is provided around the southern end
of the construction office/warehouse will suffice
for the turr,around, however the turning radius is
inadequate.
d. Fire hydrants are required within 250 feet of all
portions of the outside walls of the buildings .
If the building provides an internal sprinkling
system, the availability of fire hydrants may be
extended to 500 feet.
NPO #5 has reviewed this proposal and has the following
comments:
We are concerned that all regulations of the Code
are adheared to by the proposed end users
particularly with regard to noise abatement,
hazardous waste, supplies and vehicle storage.
The Tigard Water District, General Telephone, Northwest.
Natural Gas, and Portland General Electric have
reviewed the proposal and have issued no comments or
objections .
No other comments have been .received.

B. ANALYSIS AND CONCLUSION
The proposed devel.oprent conforms with Community Development
Code requirements for type of use, building setbacks,
building height, maximum site coverage, visual clearance at
driveway/road intersections, parking and bicycle rack
requirements, and vehicular access . However, the following
aspects of this proposal warrant further discussion:
1 . Community Development Code Section 18. 108 . 050 requires
that a pedestrian walkway be provided which extends
from the ground floor entrance to the street which
provides the required access and egress . The site plan
provides an on-site pedestrian walkway between the two
proposed structures . However, there is no walkway
extending from the ground floor entrance of the
construction office/warehouse to SW Hunzike r Street.
Therefore, the site plan will need to be revised to
provide such a walkway.
2 . Code Section 18. 100. 110 (Screening: Special Provisions)
states that trees shall be planted in landscaped
islands in all parking areas, and shall be equally
distributed and on the basis on one tree for each seven
parking spaces in order to provide a caiopy effect.
While this is not feasible due to the traffic
circulation pattern on this site, the applicant will
need to provide three additional trees to be placed in
the area of the parking lot for the auto repair
facility in order to provide for better screening of
the lot.
In addition, details shall be provided for landscaped
areas presently designated "planting" which surround
the auto repair facility parking lot. Staff recommends
that a combination of evergreen hedges and slats on the
chain link fence be used to screen the parking area
from views from surrounding properties..
3. Code Section 1.8. 106 .020 (P) ( 1) (Bicycle Parking) states
that at least ore bicycle rack space shall be provided
for each 15 parking spaces In any development. The
aFplication meets the code requirement by providing one
bicycle parking rack for the 13 pax-king spaces provided
for the construction office/warehouse and three bicycle
I� parking racks for the 44 parking spaces provided for
the auto repair facility. However, the type of .rack
and number of spaces provided in each rack has not been
specified in the application materiel . This
information should be included on the revised site plan
noted in the conditions below.

C . DECISION
Based upon the above findings and conclusions, the Planning
Diruci.or's designee APPROVES Site Development Review SDR 90-
0024 subject to Lhe foli.owirg conditions :

LISTED BELOW ARE SATISFIED OR AN ACCEPTABLE PERFORMANCE
ASSURANCE IS POSTED. UNLESS OTHERWISE NOTED, PLEASE CONTACT
CHRIS DAVIES IN THE ENGINEERING DEPARTMENT AT 639-4171.
1 . A revised site plan shell be submitted to the Planning
Division for approval which provides a pedestrian
walkway from the eni-.rance of the construction
office/warehouse to SW Hunziker Street along with the
design and number of spaces provided for each bicycle

2 . A revised landscaping plan shall be submitted to the
Planning Division for approval which addresses the
placement of three additional trees to be placed around
the perimeter of the auto repair facility. This plan
shall also detail the type and placement of other
landscaping materials to be installed on the site.

3 . The applicant shall install streetlights and a 5 foot
wide city approved sidewalk along the site's frontage
road, S.W. Hunzikez Street.
4 . Sanitary sewer and storm drainage details ynd
calculations shall be provided as part of the site
improvement plans. Calculations shall be based on full
development of the serviceable area. The location and
capacity of existing, proposed, and future lines shall
be addresc:ad. Designs and calculations submitted shall
be star;pc�l by a Registered Professional Engineer
licensed to pri,ctire in the State of Oregon. The
applicant shall •3rovide the Engineering Department "As-
Built" mylars of the sanitary and storm sewer systems .
5. Two (2) sets of detailed improvement plans and profile
construction drawings shall be submitted for
preliminary review to the Engineering Department.
Seven ( 7 ) sets of approved drawings and one ( 1)
itemized construction cost estimate, all prepared by a
Professional Engineer licensed to practice in the State
of Oregon, shall be submitted for final review and
approval . (NOTE: these plans are in addition to any
drawings required by the Building Division and should

only include sheets relevant to public improvements . )
6 . Bui-ding permits will. not be issued and construction of
proposed improvements shall not ccmmence until after
the Engineering Department has reviewed and approved
the improvement plans and a street opening permit or
has been executed. The payment of the following fees
are required: Street opening permit, streetlight,
sign, Traffic Impact Fee, and fee-in-lieu for water
quality.
7 . An erosion control plan shall be provided as part of
the improvement drawings . The plan shall conform to
"Erosion Control Plans - Technical Guidance Handbook,
November 1989 . "
THE FOLLOWING C014DITIONS SHALL BE SATISFIED PRIOR TO THE
ISSUANCE OF AN OCCUPANCY PERMIT:
8 . All landscape materials, site improvements and required
public improvements shall be installed as per the
approved site plan or a performance assurance shall be
posted guaranteeing installation within a short time
