This permit was issued under the 1990 Editions of the One and Two Family Dwelling Code. The following are the code requirements for placing sewer pipe (1990 edition of the One and Two Family Dwelling Code with updates): i a) Section P-2204, Trenching and Backfi',lin • P-2204.1 requires that the "...piping shall be installed in trenches so that it rests on solid and continuous bearing . • P-2204.3 requires the trench to be properly backfilled and describes the minimum requirements for placing the backfill. b) Section P-2502, Building Sem,er Site • P-2502.2, installation, requires that building sewers "...shall be laid on a firm bed of approved materials...". As you can see, the code in effect at the time permit #SWR92-0245 was issued requires that the sewer pipe be placed on firm soil and that the trench be backfilled to certain minimum requirements. The code is silent on paving requirements, and in fact, the code exempts paving from permit requirements. An inspection was performed on 8/3i32, which resulted in an approval of the sewer pipe installation. Practice hi the Cite of Tigard is to inspect the nipe in the open trenen to verify slope, pipe material, connections and tLe proper firm bedding;. The approval on 8/3/92 indicates that these items were in conformance with the minimum code requirements. Sturgis who otn.a property in the City of Tigard, a, requesting the Board to grant a connection fee to Mr. Sturgis under the so called "grandfather clause" that would allow him to acquire that permit for $300. rather than the $2,100. that is charged for new connActions. The rouse that Mr . Sturgis proposes to connect to the sewer was constructed prior to 1970, therefore, qualifies for the "grandfather" fee. The "grandfather" fee also stipulates that connections shall be made within three years of availability of sewer service and the Sturgis property was not permitted for connection within { that three year period. Mr. Sturqis claims that we was not informed of that requirement and, . therefore, makeu this request. Your Board asked for a recommendation from the City of Tigard and a copy of their August 3, 1992 Memorandum is attached. Subsequent to re^eipt of the Memorandum, I spoke with Mr. Randy Woolly who is with the City of Tigard, and it was his recommendation that your Board approve Mr. Sturgis' request and that you grant him a 90-day period in which to obtain that permit. Unfortunately that amount (which is a "Grandfather Clause" for homes; constructed prior to July 1, 1970, which connect to the sewer within three years of the date the sewer becomes available to the property) was incorrect because the sewer has been available to the for more than three years. I It is the position of the city that the connection fee should be the current connection rate of $2135.00 per building. In our telephone conversation of July 29, 1992, you indicated you had never been notified of the time limitation, and you should be allowed to connect to the lower rate. I then directed you to contact the Unified Sewerage Agency for a ruling (which I understand you are in the process of doing) . I understand that you have a contractor_ available on this date to install the sewer lines to the homes, and if theme is a delay in construction during the appeal, the contractor: may not be available o for quite some time. During our discussion today, you indicated j that you only wish to be allowed to install the sewer service lines ! to within five feet cif the homes, but not connect them to the sewer until the situation of the permit ieea is resolved.
