Dear Mr. Dorsey,
Thank you for your response to my letter concerning your Tigard facility.
I have discussed this matter at length with Ti.gard's Public Works Director.
We feel at this point that the principal concerns which must be addressed at
,your• property are:
I. The width of Hall Bled. is inadequate For your use. The public works
department estimates that Hall should be widened by six feet.
2. Parking is inadequate for the site. Some parking now is taking place
in the public r%-ht-of-way.
3. Access .and egress at the site is a Frobl.em. Limited access points
must. be established.
4. The left turn opportunities to the site are inadequate. The C'. ty
would like to work with you, your property owner, and other property
owners in the area to upgrade the traffic pattern and turning lanes.
A design must be prepared and detera-ination made of the segmentation
of the cost.
The City hopes to put together a traffic plan for the area. We woulu like
to discuss the 1•ossibility of you or your property owner participating in the
cost of as improvement as well as the Tigard Water. District, Tigard Electric,
Richard Sturgis, and the City of Tigard. Each of these property owners will
contrihutf� tc. the impact on the Hall and Burnham intersection.
At this --ime, we are not as concerned about the paving of your property as
we are concerned about the traffic impact of your us.? and the need for
Improvements. As a mejur contributor to the traffic impact during the morning
hours, your rarticipation in the solution is essential.
I will notify you of further developments. We hope to set up a meeting to
iiscuss this situation in the coming months.

Dear Mr. Manahan:
Your letters of August 30 , 1984, and September 13 , 1984 , reached
my office today. I thought I had given you one of my cards when
I was in your office on May 24 , 1984, as I attached your card to
my notes of that meeting.
Whenever we obtain a new contract from a school district, we
make a practice of stopping by the local city offices to intro--
duce ourselves, explain the type of operation in which we will
he engaging, and request assistance in finding a location. In-
asmuch as zoning and building requirements seem to vary from
city to city, we want to gather information as to the specific
requirements of that city for our particular type of use, and to
see if there are any sites that could be recommended.
Since Keith Liden was on vacation at the time, you called Liz
Newton into your office to help answer my questions. We all
looked at the Comprehensive Plan and the zoning ordinances, and
it was determined that our type of use would require a light
industrial zone. You and Liz pointed out the areas in the City
that were this zone, and generally discussed the areas in which
we might begin to look.
1 advised that we would like to find an existing garage or ware-
house building with ars acre or more of land on which we could
park the buses. In case we could not find an existinq site that
met our needs, we would then probably have to secure some bare
land with the proper zoning and construct a new facility. You
advised that if we had to construct a facility, there would be
several requirements that would have to be met such as site
planning, landscaping and the requirement to provide a paved
parking lot for the buses. I advised that this was different
from other cities, and that we did not have a paved parking lot
for the buses at any of the other 39 school districts we serve.
This expensive requirement would make it almost imperative that
we find something already existing. Based on this intor.mation,
we began our search.

During the next few weeks, we located a number of possible
sites, each requiring quite a bit of modification to meet our
needs. At that time, we called Keith Liden to find out what the
City would require i..n this instance. He advi:,ed that a "Site
Review Plan" would be required when any remodeling would affect
over 50% of the propa rty, or if there was an actual change of
use in the property.
Shori:ly thereafter, we found the McBreen Truck Lines site on
Hall Boulevard, which was an existing freight truck terminal
building with a three-bay garage and adjoining small office.
Most important, the large truck parking lot was more than ade-
quate to park our buses. Che site even included two large
underground fuel tanks and a fuel dispensing island. It was
alp:,,)st too good to be true--it met our needs precisely!
Since it. would not now be necessary to make any changes in the
f-icility , I saw no reason to advise you at the time that we had
found a .;ite. I did not believe that it was necessary to obtain
any garmits or variance�i to rent an existing facility in the
City of Tigard, especially since we were just continuing the
same use.
Actually, "inding a site such as this , located almost exactly in
the center Df the area within which the school buses would be
operating, will be a great asset to the patrons of the school
district, most of whom are taxpayers in the City. This central
location will allow us to provide much better service to the
children, and at a lower cost than if we had to be located
farther away, or even outside the school district.
The nearly two-acre site has more than adequate space to park
all of the buses plus the private automobiles owned by employ-
ees, entirely on the premises.
In regard to the Busir►ess Tax Certificate, you will find we
filed the "Business Tax Information Sheet" with the City office,
on September 7 , 1984.
Let me assure you that we are prcbably more concerned than you
are regarding the safe operation of the buses than transport
Tigard school children. Unfortunately, the school buses do have
to operate on City streets, and do by their very nature create
traffic congestion in many locations during the hours they are
on the road. A good example of this is the current congestion
on SW Durham Road at Tigard High School at dismissal time in the
afternoon.

We try to minimize the school buses impact on the community as
much as possiblp by routing the buses as efficiently as we can
and by training our drivers. We wculO welcome the opportunity
to work with city tra-'fic officials and to look at other ways in
which we might be able to reduce the disruption of traffic at
our location on Hall Boulevard, as well as other key locations
throughout the City.

On August 30, 1984, the aCtached letter was dent to your new address at 1.3000
SW Rall Blvd., however, it was returned to my attention by the Past Office. I
would appreciate your prompt consideration of the issues raised in the letter
and a written response no later than Tuesday, September .25, 1984.
Since writing the original letter, I have received complaints concerning:
1. The parking problem at the site and;
2. _dffic problems caused as •he buses leave the site in the
morning.
The parking issue was raised in my original letter, however, the disruption of
traffic at the site is a new issue. It will be necessary for your company to
address the impact of the morning Coruption to determine, along with our
Public Works Department, if any public improvements can be made such es the
addition of another travel lane.

RE: Possible Zoning Violation
Dear sirs:
The new location of the Dorsey Bus Company at 13000 Hall Blvd. is of concern
t� my office since there la ar, apparent violation of. the Tigard Community
Development Code. I would appreciate your prompt investigation cf this
violation and a letter from you concerning this matter.
Your present use of the site in question appeays to be an allowable use. The
lard is zoned light industrial which, among ocher uses, allows fleet storage.
Fleet storage is defined as ". . ..storage of vehicles used regularly in busineus
operation and not avaliahle for sale or long term storage of operating
vehicles." Your use of the property to store school buses seems to fall into
this category. The problem arises, however, with the physicn.l condition of
the area on which the buses and employee vehicles are stored. Section
18.106.050 (I) of the community Development Code specifies that ". ..all areas
used for the parking, or storage or maneuvering of any vehicle, boat or
trailer shall be improved with asphalt or concrete surfaces according to the
same standards required for the construction and acceptance of city streets."
In essence, this provision requires that any area used for the storage of
buses and employee automobiles, in this case, be pave6. The property on which
you are located is not paved.
In addition, Section 18.106.030(C)(7)(b) requires that one parking s,.ace be
provided for each employee on the largest shift. Given the appearance of the
site this morning, this condition also may not be met.
I would appreciate a written response from you within the next five days. I
am quite concerned with this matter. since I met with Mr. Dorsey on May 24,
19F4 and outlined the conditions which would apply to any location which the
company might. prefer. No approval was given by my office for this site or any
other site nor was a variance from the standar.dp requested. In addition, it
appears that �hc company also failed to app. f for a business tax as requtrcd
by the Tigard Municipal Code.
