This letter is In response to your questions regarding the finish grading by
the "Kindercare" project to th�-, north of your property.
I have reviewed the project with the City Building Official (Brad Roast) , who
gave the following reasons for approving the project:
o The original topography of the "Kindercare" property sloped downward in
a south to southwest direction towards your property. A majority of
the "Kindercare" property is now collecting storm water by means of
roof drains, parking lot catch basins and yard drains, which are
discharged to the storm sewer system.
o The toe (bottom) of the slope created by Kindercare was permitted to
begin at or about the property line because of a setback of the slope
(which is required only for maintenance of the slope) served no
purpose. There is provision for the Building Official to approve
alternate setbacks.
I hope this answers your questions as to the City's position in this muter.

Following our discussions I toured the Hall Blvd. Professional
Village site with Mr. Walden, Building Official. I have reviewed
the entire file and. have the following comments to make.
Your building is not ready for occupancy. The tenriants you have
allowed to occupy a space in this structure are doing so illegally.
We will not issue a partial-occupancy permit to you and you bear
sole responsibility for ycur tennants. We will not allow furf.her
occupancy and should this occur prior to final inspection we will
issue a stop work order on the building project. All conditions
palced upon you by the Planning Commission, Site Dasi-gn Review
Planner and Building O£fical will be satisfied prior to a final
inspection and issuance of an occupancy permit.
You have placed the cart before the horse in this instance and
this City will not sanction violations of specific ordinances
and regulations .
