SITE PLAN/DESIGN REVIEW COMMENTS:
A zone change from C-3 to A-12 was approved by City Council on December 17, 1979.
A minor land partition to create lot 3301 was final on September 29, 1980.
The bond has not been posted for public improvements as conditioned in the
minor land partition and the minor land partition has been filed. A zoning
violation exists.
STAFF RECOMMENDATIONS:
Staff recommends approval subject to the following conditionE:
1. All conditions of MLP 11-80 must be met before Building Permits can
be issued (see attached) .
2. Public water service and sanitary service shall be .. ;r_a1-led
site prior to the issuance of a Building Permit.
3. No Occupancy Permits shall be issued until all conditions placed upon
this development by the City of Tigard have been satisfied and inspections
verifying this have been carried out by the appropriate department.
4. No changes will be made to approved plans or specifications unless
formal application is made to the appropriate City department, and
changes are approved by that department. Application for changes
will be made in writing and shall include applicable drawings.
5. Grading plans and construction plans for all work in public rights-
of-way and all other public improvements shall be prepared by a registered
professional engineer in accordance with City standards, and shall
be submitted to the ublic Works Director for review.

All public improvements will require a Compliance Agreement and must
be (design) approved by the Public Works Director, and must be either
fully and satisfactorily constructed prior to the recording of any
minor land partition, public dedication, final plat or issuance of
Building Permits; or bonded to the City for 100% of the estimated cost

Dear Ms. Girod:
Enclosed is a copy of Ordinance No. 79-115 which was approved by the Tigard City
Council at their regular meeting of December 17, 1979. Your request was approved
with the following conditions as set forth in the enclosed ordinance.
1. That the applicant dedicate five feet of right-of-way with half--
street improvements along S.W. Frewing to local street standards
prior to ibsuance of a Building Permit.
2. No Occupancy Permits shall be issued until all conditions placed upon
this development by the City of Tigard have been satisfied and inspec-
tions verifying this have been carried out by the appropriate depart-
ment.
3. No changes will be made to approved plans of specifications unless
formal application is made to the appropriate City department and
changes are approved by that department. Application for changes
will be made in writing and shall include applicable drawings.
4. Construction plans on all public right-of-ways shall be submitted
and approved by the Public Works Di.rec:tor prior to commencement
of work.
5. Public water service and sanitary service shall be installed to this
site prior to the issuance of a Building Permit.
6. All existing or proposed utilities shall be placed underground.
Street lighting installations shall be approved by the Public
Works Director.
7. That the owner receive site design approval prior to issuance of a
building permit.

clean out all dead or dying vegetation and perform wharever improve-
ments are requested by the Public Works Director to insure proper
working order of the drainage area prior to issuance of Building
Permits.
9. No Minor Land Partitions shall be made in reference to this project
unless formal application is made to the City of Tigard Planning
Department and the Minor Land Partition is approved and recorded.
