Mitchell, deputy regional director of urban renewal, HHFA, San Francisco. In addition, there will be other sessions of interest to planning officials. For example, during the park and recreation session the matter of city beautification will be discussed including street trees and signs. As I unders'.:and it, the problem arises primarily by reason of the explanation of Mr. Randall that he constructed the buildings now present on his property on Burnham Street originally with the intention of utilizing same for multiple dwelling purposes, but due to various factors, he has in fact for many years utilized these improvements for chicken houses, and this was the use being made of same at the time the area was zoned M-3. The problem presented to me was whether his intention to use the improvements for A-2 purposes would be sufficient to authorize the granting to him of permits for remodeling these chicken houses for multiple dwelling use under the rule that a non-conforming use may be con- tinued. I find that the law seems to be settled that mere intentions do not establish a non-conforming use., and it is not enough that the plans for the proposed use have been put on paper. . A use which was merely contemplated or intended, but not realized at the effective date of the zoning regulation prohibiting such use , is not protected as a non-conforming use. Thus it would appear that on this point the buildings in question were not being used for. A-2 within the meaning of the law at the time the land was classified for M-3 purposes, and the proposed use thereof for A-2 purposes now would require a zone change . eery truly yours , ed. A. Burnham is appreciated, i s I had intended to appear but am not able to do so and would appreciate your reading my letter at this hearing to put my views on file and record. While I am in sympathy with the above Tax Lot owner's desire to make a better use of his lot than residential, I do not feel that multiple dwellings will be in keeping with the logical de- velopment of property between Burnham and the railroad tracks. Inasmuch as proximity of the property to the railroad with good street access, salver and other utilities would in my mind dic- tate some eventual commercial use, I would think that any zoning toward multiple housing in this particular area would be a mis- take for the community and very likely a poor profit possibility for the property owner. Kindly give my regrets to those involved at my absence but I shall certainly be happy to meet again at a later date if there is any unresolved conflict.
