The 1963 convention of the League of Oregon Cities will be held at the
Multnomah Hotel in Portland, October 20-22. We are scheduling the
planning section meeting this year on the rAorning of October 21. Among
planning session speakers will be Richar?L G. Mitchell, deputy regional
director of urban renewal, HHFA, San Francisco. In addition, there
will be other sessions of interest to planning officials. For example,
during the park and recreation session the matter of city beautification
will be discussed including street trees and signs. Please call this
conference to the attention of your planning commission members.
Enclosed is a program suggestion sheet an which we would appreciate
having you indicate your suggestions for topics and speakers for the
section meeting, and also for other convention sessions. Please complete
and. return the form to the League office as soon as possible.
We will also appreciate having you report on the suggestion sheet any new
ideas put into effect in your city which would, be of interest to other
planning officials. Much of the value of the League convention comes
from discussion of ideas, experiences and first-hand reports on how
Oregon cities are undertaking new programs, improving services and
developing new techniques.
We will be asking the city manager or city recorder to handle the hotel
anti motel reservations for all of the delegates from each city, and we
%ill be sending additional information on reservations in the near
future.

Dear Sir:
I have been requested to examine the law concerning the
matters hereinafter described with respect to the above-referenced
application for a change of zone from M-3 to A-2.
As I unders'.:and it, the problem arises primarily by reason
of the explanation of Mr. Randall that he constructed the buildings
now present on his property on Burnham Street originally with the
intention of utilizing same for multiple dwelling purposes, but
due to various factors, he has in fact for many years utilized
these improvements for chicken houses, and this was the use being
made of same at the time the area was zoned M-3. The problem
presented to me was whether his intention to use the improvements
for A-2 purposes would be sufficient to authorize the granting
to him of permits for remodeling these chicken houses for multiple
dwelling use under the rule that a non-conforming use may be con-
tinued.
I find that the law seems to be settled that mere intentions
do not establish a non-conforming use., and it is not enough that
the plans for the proposed use have been put on paper. . A use
which was merely contemplated or intended, but not realized at the
effective date of the zoning regulation prohibiting such use , is
not protected as a non-conforming use.
Thus it would appear that on this point the buildings in
question were not being used for. A-2 within the meaning of the
law at the time the land was classified for M-3 purposes, and the
proposed use thereof for A-2 purposes now would require a zone
change .

Your letter of Sept. 6th notifying us of hearing on Zone Change
from M-3 to A-2 for Tax Lot 2000, address: 8975 S. W.
Burnham is appreciated, i

I had intended to appear but am not able to do so and would
appreciate your reading my letter at this hearing to put my
views on file and record.
While I am in sympathy with the above Tax Lot owner's desire
to make a better use of his lot than residential, I do not feel
that multiple dwellings will be in keeping with the logical de-
velopment of property between Burnham and the railroad tracks.
Inasmuch as proximity of the property to the railroad with good
street access, salver and other utilities would in my mind dic-
tate some eventual commercial use, I would think that any zoning
toward multiple housing in this particular area would be a mis-
take for the community and very likely a poor profit possibility
for the property owner.
Kindly give my regrets to those involved at my absence but I
shall certainly be happy to meet again at a later date if there
is any unresolved conflict.

area then it should stick with the present classification F
Of M-2 on S.W. Burnham Road. At the present time , with
Air Kin- on one side of the road and with prospective
manufacturers planning to build on the other side of the
road it does not seem lo:Tical that S.W. Burnham should
suddenly become A-2 classification.

detract from the value of prover ty in this area.

On August 8, 1963 Albertson's Incorporated filed an application for zone
change on certain property situated on the Northeast corner of State
Highway No. 217 and Pacific Highway West.
The proposed land use is for an Albertson's Food Center of the same type
and construction as our other food centers in the Metropolitan area.
We understand that the next regular meeting of the Tigard Planning
Commission is on September 19, 1963. Since we have the subject property
under options that, will expire and require extensions prior to that datep
and since good construction weather is rapidly disappearing, we respect-
fully request that, a special meeting of the Planning Commission be called
to consider our application during the week of August 19 - 23 or next
we.,gk if convenience will permit.
