Gentlemen:
It has come to my attention that we are again
faced with a zone change on Walnut Avenue near Watkins
Street.
This zone change was refused by the planning com-
mission recently after a thorough .review by that board
who were, at the time, faced with remonstration from
the majority of the property owners.
It is my opinion, as well as many other property
owners in Tigard that our zoning ordinances protect
us against spot zoning and this is definitely spot
zoning.
A duplex zone change was refused recently on Watkins
and Walnut. How then, could ,you ,justify a large apart-
ment complex to be approved?
We property owners would like to be sure that
our homes are protected by our zoning ordinances tnd
the good judgment of our elected officials.
I, like many other residents of the area are op-
posed to this lone change and request that ,you re-affirm
the decision of the planning commission.

Mr. Yercfy, who wished to purchase this property, intends to
build a plant for building and rebuilding machinery tools.
Mr. Ray Shaw, Mrs. Fly, Mr. George Lowery and Floyd Gaeger
objected to this zone change. They feel that this change would
decrease the value of their property, and they do not wish to
have any type of manufacturing in that area.
Mr. Gordon, who is the realtor, stated that he had contacted
the people who live between the creek and the vie ,•t and they
are in favor of this change.
Larry Sinnott asked if Mr. Yancey would consider an M-4 sone
change on thin l-roperty. The Planning and Zoning members and
Mr. Yancey discussed this change at length.
Mr. Vicolit 1 move that *o recommend to city council a zone

Motion seconded by For. Severson. Upon call for vote the motion
was unanimously defeated, majority members being present.

Gentlemen:
The City of Tigard Planninq and Zoning Commission at their
meeting December 10, 1964, recommends the following changes
in the Plannir -, and Zoning Ordinance 63-6 for consideration
and approval by the City Council .
1 . Variances - The addition of Section 2300; Authorization
to Grant or Deny Variances and Section 2301; Conditions
for Granting a Variance and Section 2302', Variance
Procedure
2. The addition to the Zoning Code of Residential District
R-7 and R-10 as described on the attached proposal of
changes further include and add to these residential
districts the same conditional use as outlined in Resi-
dential District R-5
3. Except in Residential District R-5 in the case of
Section 704-3 rear yard, the minimum depth shall be
changed to 20 feet instead of 25 feet. Further the
Planning Commission proposes the addition of the follow-
ing paragraph under conditional uses Section 1903-38
reading as fmilows : Contractors Equipment Storage and
Office Zone3 Allowed; a. C-2, M-3 and C-3 Lot Size;
a , Same as primary zone, Lot Coverage; a. Same as

Variances
Section 2300 . Authorization to Grant or Deny
Variances,
The city council may authorize variances from the require-
ments of this ordinance following recommendation of the
planning commission where it can be shown that, owing to
special and unusual circumstances related to a specific
piece of property, the literal interpretation of this
ordinance would cause an undue or unnecessary
allow shhip,
except that no variance shall be granted
use
of property for purposes not authorized within the onea
in which the proposed use would be located. In granting
variance the city may attach conditions which it finds
necessary to protect the best interests of the surround-
ing property or neighborhood and to otherwise achieve the
purposes of this ordinance.

The Purpose of this district is to ,provide for and protect resident-
ial land Properly located for families who desire to live in a
single family dwelling environment; who do not want nor .have a need
for larger lots hereinafter provided. This district is designed
to be used in areas providing full urban services including puL)l.ic
water .and public sewer.

701 Purpose
The )urpose of this dintrict is to provide for a buffer zone in and
protect surrounding residential land properly located for families who
desire to live in a single family dwelling environment; who r?u not
want nor have a need for larger :cots .hereinafter provided. This
district is designed to be used in areas providing full urban services
including public water and public sewer and its application to be at the
discretion of the Planning and Zoning Commission

703 Lot Size
703-1 The minimum lot area shall be Ten thousand (10,000) square
feet per dwelling unit where City sewer connection available.
703-1.1 Where City newer connection is not available and a septic
tank and drain field is to be used, the minimum lot area shall
be fifteen thousror_d (15,000) square feet.
703-2 The minimum aver-age lot width Shall be Seventy (70) feet.
703-3 The minimum lot width at the building line shall be Seventy (70) fe'
703-4 The minimum average lot depth shall be one hundred (100) feet.
703-5 The minimum lot widish at the street shall be sixty (60) feet.
703-6 The minimum lot width at the street on an approved cul-de-sac
shall be forty (40) feet.
