Staff Recommendation:
The City Staff recommends denial of this application until such
time as a plan for this area has been completed. At this time the Staff
feels that, without a plan, invading this area with any change in existing
density or traffic would be undesirable both for the neighborhood and the
City.
At present the surrounding neighborhood is composed of single family
residential units, Phil Lewis Elementary School, and undeveloped R-7 land.
An off ramp from the new 217 Highway joins 72nd Avenue approximately 100'
below Hampton Street, and the applicant feels this is reason enough to
rezone this property. Allowing C-3 would be opening the area up to an
unlimited commercial development which cannot be considered compatible in
this residential neighborhood.
Public Bearing:
Approximately fifteen people from the neighborhood were present
in opposition to the zone change. Three of these spoke in agreement with
the staff recommendation ani, in addition, explain ecd the inappropriateness
of commercial development across from the school, the inadequacy of 72nd
to handle present heavy traffic, and the need for a plan for the area
because they all recognize its changing character.
The applicant was not present, although notice was mailed to him.
Commission Action:
The Commission voted unanimously to deny this request.

Property Involved: 10010 SNI Garrett Street (Map N2S1 2CB, Tax Lot 3600)

Staff Recommendation:
The staff recommends approval of this application to build a
planned residential development of sixteen new units on this property
with the following conditions:
I
1. That all utilities be underground.
2. That a five foot strip of land be dedicated to the City
for future improvement of Garrett Street.
3. That decorative lighting be installed along the driveway
and in the parking areas ---- plans to be approved by the
City Staff.
4. That landscaping plans be submitted for staff approval.
5. That the property be fenced on the sides and the rear
providing privacy to the property.
Public (Tearing:
This application was on the agenda of three Commission meetings
(September, October and November) . At each meeting three neighbors
expressed great opposition to the increased density in the area because
of the low density character of the neighborhood, the inadequacy of the
road and the water service. The applicant was assured by the water
district that a new line down Garrett Street will be included in their
next budget.
Commission Action:
The Commission approved the request by a 4 to 3 vote; the majority
feeling that this property was not suitable for a good subdivision of
single family homes because of its narrowness, and that the PR approach
could be of higher quality and could be better controlled by the City.
