AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT To THE LANDS OF
ROBERT C. MOORS et al in Section 2, T2S, nlW, W.I.
_ ___-_--TIGARD, WASHINGTON COUNTY, OREGON
WHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the 'Zoning
Code of said City, have heretofore been limited in the use to those uses
permitted by said Code, under, and have been classified and zoner'
for, R-7(Residential) and
WHEREAS, pursuant to prescribed procedures, the owners of
said lands have applied to the City of Tigard for reclassification of
said property and change of zone thereof to permit the use thereof
for A-2 (;lulti-Family kesidentiu 4)u:uoses, and said application has
been duly publicized and public hearing held by tt:e City Planning
Commission on August 20, 1968__after due and legal notice; and
WHEREAS, the Planning Commission has recommended disapproval
of said zone change to the City Council, and due and legal notice of
City Council hearing leaving been given by publication in the Tigard
Times, and the City Council having heard same at its regular meeting
of September 9' 1968 and the Council finding that no public
detr mens w resut iom granting of said petition, and that it is
in the public interest that said zone change be approved, and the lands
re-zoned from k-7 (Residential) to A-2 Clultiple-Family Residential)
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the followinq described lands be, and the same are
hereby, zoned as A-2 for use in accordance with the
A-2 (Multiple--Family RenidentiaI)D a sification of the Zoning Code of
the City of Tiqard, which Zoning Code with respect to the A-2
classification is by reference herein made a part hereof:
Commencing at the Northeast corner of Lot 17 of North 'riyardville
Addition Amended, a plat of record in Washington County, Oregon, thence
;Io.rthwesterly along a line which iFi the boundnry between Lot 17 and Lot 18
to a point at which a continuation of said line intersects the Northwest
Boundary of Lot 16, thence Southwesterly along the Northwest boundary of
Lot 16 to the Southwest corner of Lot 16, thence Southeasterly along the
Southeast boundary of Lot 16 and continuing along the Southeast boundary
of Lot 17 to the Southeast corner cf Lot 17, thence t4nrthwesterly along
the Northeast huunddry of Lot 17 to the Point of beginning.
Section 2s This oruinance shall be effective on the 31st day after
its enactment by the City Council of Tigard, Oregon.

at 12575 S.W. Grant.
1. Staff recommendation for denial
2. Public Bearing
a. Mr. Dick Linkhart, 12490 S.W. Brookside Avenue,
presented a petition in opposition to the application
signed by 60 residents, mainly in the Brookside area.
b. Mr. Moore, applicant, presented a land use map of the
area, and spoke saying that the "highest and best" use
of the land was multi-family developmen, and that single
family development would be economically unfeasible.
c. Neighbors, Dorsey Olds and Mrs. Fisher inquired as tc
Mr. Moore's plans. Chairman Paterson said there were
none before the Commission which could only lead to
■uppositions at this time. Mr. Moore said he had as
yet, had none drawn up; that he felt the zone change was
the first step he should take. Brookside neighbor, Mr.
Rau inquired as to how close apartments could be built
to single family residences. Mr. Thompson explained the
setback and screening requirements for the A-2 zone:, Mr,
Rau then explained the Brookside scab-division height
restriction of one story plus daylight basement construc-
tion. Grant Street neighbor, ChTichton Christensen
spoke saying he had no objection to zone change, that
he was paying taxes on land he also couldn't use.
Br:ckside neighbor Carl Miller explained the strictly
single family character of the neighborhood behind the
Moore property. Johnson Street neighbor, Joe Stocks.,,
inquired ,iow long the City intended to keep this side of
Grant Street in single family residential, Chairman
Paterson explained that Planning and Zoning is a changing
thing and that perhaps in the future this area would be
ready for apartments. Brookside neighbor, Mrs. Fisher,
asked if stipulations as to kind of development and height
of buildingm could be put into the zone change„ Chairman.
Paterson explained that the Commission could not tell a
man what to do with his property, and that it must be
guided by the zoning ordinance . Mr. Moore explained that
there i■ increasing pressure for commercial in the area
of which he disapproves but feel@ a happy medium would
be for apartments now. Brookside neighbors, Mr. Linkhart
Carl Miller, Mrs. Fisher 6 Mrs. Linkhart further spoke
regarding the very single family character of the area,

3. commission discussion and action.
a. Mr. Woodard said he felt the change would be an error un-
less plane were presented showing better access, and de-
velopment plans- He further indicated that the neighbors
had not satisfactorily gotten together on a proposed road
connection with McKenzie Street which he felt would benefit
all of the neighbors, Mr. Aitken suggested that Mr., Moore
talk to the neighbors and consider building a single stor;
low density development which might be more acceptable to
them. Mr. Perry asked if Planned Residential could be
considered on a smaller area such as this. Mr. Paterson
explained that although this might be a good idea, it would
require amending the Zoning ordinance, Mr. Nicoli suggested
a buffer development with garden apartments on the front of
the lot facing Grant Street.

S.E. corner of Bonita and Hoffarber Roads (14600 S.W. Hoffarber)

2. Public Hearing
a. The City Planner presented a petition in opposition to the
zone change signed by 36 residents mainly of the Pinebrook
area.
b. Mr. Fimmel, applicant, explained his proposal
C. Pinebrook neighbors, Robert Burrow and Mrs. Boggs, spoke
saying they each felt that downtown Tigard had plenty of
shopping facilities and they were concerned that approving
this zone change would set a precedent and lead to strir
commercial along Hoffarber,
d. Hoffarber neighbor, Mr. Pitiler, said he felt Tigard should
be progressive. He felt this development would look better
than the existing conditions and that it was a strategic
location for small shopping complex. Mr. Stan Adkins,
property owner in the area, spoke in favor saying he would
like to do some convenience shopping there. Mr. George
Penrose of S.W. Mountainview Lane also spoke in favor
saying he felt the area needed this service, Mr. Mayes, a
Pinebrook resident,, spoke in opposition saying he was afraid
of strip commercial, which he said he thought was against
good toning policy. Chairman Paterson explained that the

The City Staff recommends denial of this application. City
policy has been to use Grant Street as a boundary between the
high density and the single family developments . This has
given the area in which this property lies a low density
character which would be disturbed by multi-family development.
The present circ:alation cannot adequately handle A-2 develop-
ment on both sides of Grant Street. The long depth of the
property (445') might result in a long cul-de-sac being
constructed which would be unsafe, based on fire protection
standards, and which will not align properly with McKenzie
Street, causing a hazardous jog for movement into and out of
the property.
