Anton Schulz and Martha Schulz in Sec. 2, T2S, RIW, W.M.

WHEREAS, the hereinafter described lands, by action of the t
City Council of the City of Tigard, Oregon, pursuant to the Zoning
Code of said City, have heretofore peen limited in the use to those uses
permitted by said Code, under, and have been classified and zoned
for, R-7 (Residential) and
WHEREAS, pursuant to prescribed procedures, the owners of
said lands have applied to the City of Tigard for reclassification of
said property and change of zone thereof to permit the use thereof
for (A-2) (Multiple Dwelling) purposes, and said applicatifm has
been duly publicized and public hearing held by the City Planning
Commission on Janu4iX-21 L1969_after due and legal notice; and
WHEREAS, the Planning Commission has recommended disapproval
of said zone change to the City Council, and due and legs notice of
City Council hearing having been given by publication in the Tigard
Times, and the City Council having heard same at its regular meeting
of February l0, 1969 , and the Counei.l finding that no public
detriment w lLresu t rom granting of Said petition, and that it is ,
in the public interest that said zone change be approved, and the ]ands
re-zoned from r.-7 (Residential) to A-2 ('Multiple rvellinq)
NOW, THEREFORE,
THE CITY OF' fIGARD ORDAINS AS FOLLOWS:

A-2 (Multiple Dwelling) classif;.cation of the Zoning Code of
the City of Tigard, which Zoning Code with respect to the _A-2

PROPERTY INVOLVED: NW corner Hillview and the platted location of
104th Avenue (Map #2S1 2CC Tax Lot 1300)
SIZE OF PROPERTY: 0.78 acre
STAFF RECOMMENDATION:
The City Staff recommends denial of this application. The
property is not sufficiently served by streets for apartment use.
Southwest 104th Avenue is, a platted, but not at all improved
street. The only access to this property now is indirect and on
residential streets which were planned for single family de'velop-
ment and are not sufficient for added density. Perhaps when SNI 104th
Avenue is improved to City standards the zone change should be re-
considered. Allowing a zone change at this time without improvement
of the street would only burden the existing neighborhood.
A-2 zoning would allow for 14 apartment units
PUBLIC HEARING:
No one was present in the audience when this hearing was,
opened. The applicant was not present either .
COMMISSION DISCUS3IOiJ AND ACTION:
The Commission felt that the aurround!ng single family
neighborhood should not have to bear the burden of the traffic
from an A-2 develfJj:ment, and, until such time as 104th Avenue is
an improved City street, that the zoi••ie change should be denied.
The Commission voted unanimously to deny tate zone change.

It is agreed that the undersigned, being the owner of
certain lands abutting 104th S.W. between S.W. McDonald
Street and S.W. Hillview Street, shall post a bond in an
amount estimated to be the cost of construction of 104th
S.W. from S.W. McDonald to S.W. Hillview Street, as
determined by the City Engineer, before the issuance of a
building permit for any structure to be located on said
lands.
It is further agreed that construction of the above portion
of 104th S.W. shall be completed within one year from the
date of issuance of any building permits for structures on
said lands.
It is also agreed that th.,se requirements shall be stated
as deee. restrictions in the event title to said lands,
presently oimed by the undersigned are transferred to
anothe^ party or parties.
