Dear Mr . Kravas :
Please be advised that the Tigard Planning Commission at their
regular meeting of October 5, 1976, approved your request for
a variance to Section 16 .40.040 (F) of the Tigard Municipal
Code prohibiting an off-premise sign at S .W. Wall and S .W.
Hunziker Street . This approval is subject to satisfying the
following conditions :
1 . The existing sign be rem(7ed identifying the Wall Street
Industrial Park.
2. Location, composition, and size of sign to be approved
by Design Review Board.
3. The area surrounding the sign be landscaped.

Expiration when unexercised f)
When the Planning Commission (or, in the case of an appeal
the City Council) approves a variance the rights thereby
given to the applicant shall continue to exist and to be-
long to the applicant or any other owner of the land for
a period of one year from the date of final approval .
If at the expiration of one year from the date of approval
construction of the structure giving rise to the need for
the variance has not begun, the rights given by the
variance approval shall terminate without .further action
by the City, the Planning Commission, or the City Council .
Such rights shall also terminate at or after the expira-
tion of one year from approval if , though commenced with-
in one year, construction ceases and is not resumed with-
in 60 days.

o Phillips questioned the use of the word "structure" .
o Tepedino suggested that the wording be "construction
of structure or intention of the use" .
Tepedino moved and Moore seconded that the City Attorney 's
recommendation be accepted with the addition of the words
"or initiation of the use" after the words "construction
of structure" .
The motion was approved by unanimous voice vote.

I . BASIC FACTS
1 . The site is designated "General Industrial" on the Tigard
Community Plan and zoned "M-3, Light Industrial" .
2. Section 16.40.040 (E) of the Tigard Municipal Code states
"No off-premisesign shall be permitted in any commercial
or industrial zone, except outdoor advertising signs, as
regulated in Section 1.6.40.090" .
II . FINDINGS
1 . The applicant is requesting to replace the Wall Street
industrial park sign with a wooden off-premise sign
identifying Georgia Pacific .
2 . The existing sign identifying the industrial park is per-
mitted by Section 16 . 36 .050 ( 2) which allows one free-
standing industrial park sign with spaces for each tenant
to be identified.
3. The proposed location does not violate setback or vision
clearance requirements of the Tigard Municipal Code.
