DOCKET: Review of a proposed free-standing sign .
LOCATION: 13970 S.W. Pacific Highway (corner of McDonald and
S .W. Pacific)
APPLICANT: Mr. James Page
BASIC FACTS:
1 . The site is zoned C•-3 (General Commercial) .
2. The Tigard Community Plan state that the policy along
Pacific Highway should be to "establish high design
standards for signing and appearance. "
3. 1.6. 36.040-8 "No free standing sign or any portion of any
free-standing; sign shall be located on or be projected
over any portion of a street , sidewalk , or other public
right-of-way .
4 . 16 . 36.040-3B "The minimum clearance below the lowest
portion of a free standing sign and the ground below shall
be fourteen feet in any driveway or parking area. "
5. On August 17, 1976, the 'Tigard Planning Commission granted
Tigard Muffler a variance of.' Title 16, Sign Regulation .
This variance would permit one free-standing sign on S.W.
Pacific Highway advertiving "Tigard Muffler" . This
approval was subject to the following conditions :
1 . Design Review establishes a ,maller sign sire
( a 4 ' x 8' sign was present (,d) .
2 . Supvrflu.,us signs be t0i(,n down at the Staff ' s
discrel ion .
FINDINGS :
1 . Staff has visited the site and specified the signs that
should be removed. The applicant will remove the exist-
ing ills-gal signs.
RECOMME'NDA'TIONS:
1 . That the maximum size of the sign io be attached to the
light pole be 3 ' x 4 ' and hang on building side of the
pole.

Staff recommends denial based on the intent of the
Tigard Community Plan to improve the visual environ-
ment of Pacific Highway.
E. Rebuttal :
o Williansen stated that he did not agree with the
staff finding on the economic hardship.
o Krause asked whether the previous sign was
identifying or advertising the business.
o Rasmussen stated it was identifying the station .
o Nic.oli stated that the site conditions warranted
another sign .
Sakata moved and Tepedino seconded to deny the motion
since the proposed sign was intended to advertize
products and prices rather than identify the business.
A roll call vote ascertained 3 in favor - 1 dis-
senting Nicoli and 1 abstention - Phillips.

A. Staff Report : Read by Daniels.
B. Applicant Presentation :
o James Page, applicant , corrected the staff' report to
read 1 wall sign 3J ' x 8 ' rather than 2 wall signs
4 ' x 8 ' , described his request and his tenant relation-
ship with Exxon .
C. Public Testimony - None .
D. Staff Recommendations :
The staff recommends denial for the following reasons :
1 . One free-standing sign already exists on the site
and is of greater size than allowed by the code.

2. The site is oversigned and contains several
illegal signs.
3. The intent of the Tigard Community Plan would not
be served if another sign is allowed.
E. Rebuttal :
o Nicoli indicated the need for a Muffler Shop, that
the city should not have given the applicant a
business license ;,f he- could not advertize.
o Krause requested that the area be policed for
superfluous signs and that the proposed sign be
smaller.
o Phillips suggested that a long vertical sign be
erected under the existing Exxon sign .
o Popp stated that a vertical sign could not be easily
read by hi-speed traffic.
F. Commission Discussion :
o Sakata moved and Krause seconded that the proposal
be approved with the following conditions :
1 . Design Review establish a smaller sign size.
2. Superfluous signs be taken down at the Staff ' s
discretion .
The motion was approved by unanimous volee vote .
7. OTHER BUSINESS
o Staff informed the Commission of the upcoming workshop on
August 31st and presented a workshop agenda.
o Popp asked that staff acquire a larger accomodations for the
group.
o Popp directed the Commissions attention to a memo from Bruce
Clark, City Administrator, rega.i•ding the Highway 217 and 72nd
intersection .

standing sign shall be computed on 1 ' sq. -eet of area
per lineal foot of street or highway frontage, plus 1
sq. foot of area for each foot of frontage over one
hundred feet . . . "
FINDINGS :
1 . The applicant , Tigard Muffler, is proposing to erect one
free standing sign 4 ' x 81 . Tigard Muffler is sharing
building; space with an Exxon gas station. Exxon has
used all the alloted sign space for S.W. Pacific .
2 . The intent of the Tigard Community Plan to improve the
visual environment along S.W. Pacific Highway would not
be cumplied with by relaxing the sign code.
