Dear Mr. Kolve;
I am writing in reference to your inquiry concerning a face change
for the freestanding sign located at the Canterbury Square shopping
center (WCTM 2S1 10AB, tax lot 290) .
Upon investigation it was determined that the freestanding sign in
question is not in compliance with the City of Tigard Sign Code.
In F(ibruary, 1.989 you signed a voluntary compliance agreement
staL.Lng that you would bring the existing nonconforming
freestanding sign into compliance upon completion of the
reconstruction of SW Pacific Highway of the State of Oregon
Department of Transportation. This highway reconstruction is now
complete. Therefore, the nonconforming status of this freestanding
sign shall now addressed.
The current allowable sign area is 70 square feet ger sign face
( 140 square feet for all sign faces combined) . This area may be
increased up to 90 square feet per sign face ( 180 st,uaare feet for
all sign faces combined) as allowed through Secti.cm 18.114.130
(C; (I) (a) (iii) (1) (Area Increase) of the Coaanunity Development
(:}ode. The allowable sign height- is a maximum of 20 feet in the
General Coimnercial zone. The malcimunt nign height may be increased

sign(s) :located at Cantabury Square. The staff appreciates your response to
this letter so that we could discuss tYe nonconforming signs on your property
and the options available to resolve the problem. The following nonconforming
sign violations an your property were noted:
1. Too high freestanding sign, a violation of section 18.114.130(c)(1)(D).
The City expects to adopt changes to the City Sign Code on March 28, 1988 or
shortly thereafter. As a result, we intend to postpone sign civil infractions
enforcement procedures until after the revisions are adopted. Because the
revisions may affect your mign(s), the City is now offering an extension of
time via a voluntary compliance agreement (see attached).
Although the City is willing to grant an extension, this agreement must be
signed by either the business owner, the property owner, or an authorized
representative and returned to the Planning Division at 13125 SW Hall Blvd.,
PO Box 23397, Tigard, OR 9723 within 10 days of receipt of this letter.
Failure to return the signed voluntary compliance agreement to the City within
10 days or to proceed with any of the alteratives mentioned in the previous
letter will result in no extension of time and the City will proceed with
civil infraction enforcement procedures. A uniform infraction summons and
complaint will be issued and a maximum civil infraction penalty of up to
*250.00 per day per violation may be imposed.

adopted Ordinance 88-20, which amends several portions of Chapter 18.114 of the
City Sign Code. This ordinance became effective on August 26, 1988.
These new provisions may affect the status of your nonconforming sign. As a
result, it is imperative for you to contact the City Planning Division within
31 days of receipt of this letter to discuss the options available to yogi to
correct your sign problem. The options are:
1. Filing an application for a City-approved sign permit;
2. Filing an application for an Administrative Exception; or
3. Filing an application for a Sign Code Exception; or
4. Filing an application for a Variance; or
5. Modification; or
6. Relocation; or
7. Removal of your nonconforming sign(s).

Dear Mr. Hodges:
I an writing to inform you that the flush pitched "roof" sign on your
storefront has ween removed from the City's sign amortization enforcement
list. In accordance with Section 18.114.110(a) , this enforcement program
targets signs erected prior to 1978. Our records indicate that your sign was
Issued a permit in March 1986. The proposed revisione to the sign code may in
fact make this sign truly legal as a flush pitched "roof" sign.
Please accept my sincere apologies for any inconvenience this error might have
caused you.
