contract until City receives confirmation from School

11. S.W. PINE STREET
(a) Attorney Anderson reported it will be necessary to
rededicate and realign S.W. Pine Street. New deed
has been received from Dougherty and Attorney will
give further .information at next meeting.
12. RESOLUTION No. 71-39 RESOLUTION OF CITY COUNCIL CONSENTING
TO THE ANNEXATION BY THE TIGARD WATER DISTRICT
OF CERTAIN LANDS LOCATED WITHIN THE CITY

lei. TRAFFIC SIGNAL - S.W. MAIN, JOHNSON 6 HIGHWAY 99W
(a) City Administrator stated he had received preliminary
plans from the State of Oregon for the traffic signal.
The State will call for bids January 16th and work to
be complete in 120-240 days. Administrator requested
Council to consider the possibility of prohibiting left
hand turns on Highway 99W. If left hand turns were
allowed it .may destroy effect of pretiming system being
installed. Ciuncil to study the matter further.
OTHER BUSINESS
A. CANTERBURY SQUARE SEVER EASEMENT
(1) Director of Public Works advised council the Day Care
Center was built over part of the sewer easement and
Praggastis-Alexander were requesting the easement be
modified '.o take care of the encroachment..
City Attorney stated City had bought easement from
private owner. Alexander-Praggastis et al are the new
owners and cannot correct the matter by giving the City
a new deed.
Council instructed City Adm:^istrator and Attorney to
draw up a permit to alicw A exander and Praggastis to
encumber. the City sewer easemert.

(a) Setting of Public Hearing 8:00 P.M, December 27, 1971.
(b) Director of Public Works stated when Canterbury Lane
Improvement District was formed, property owners were
told City would realign S.,W. Canterbury Lane. Director
of Public Works recommended Council initiate street
vacation and set public hearing for December 27, 1971,
6:00 P�M.
(c) Motion to adopt: Councilman Moore, seconded by Councilman
Norton.
Approved by unanimous vote of Council.
9. APPROVE AGREEMENT - S.W, SANDBURG STREET
(a) Director of Public Works stated developers would comply
with conditions set forth in the agreement and recommended
City Recorder & Mayor be authorized to execute, with the
effective date to be upon acceptance by the City Council.
(b) Motion to authorize Mayor and City Recorder to execute
agreement: Ciuncilman Norton, seconded by Councilman
Bergmann.

10. APPROVE SPxCIFICATIONS FOR INCINERATOR BUILDING
(a) Director of Public Works stated City had agreed with
School District to cover the incinerator with steel
building, approximate cost $3,000. Director of Public
Works recommended bids be received at 2100 P.M, December
13, 1971.
(b) Motion to approve specifications: Councilwoman Paisley,
seconded by Councilman Norton.
Approved by unanimous vote of Council.
11. AWARD BID COMPREHENSIVE LIABILITY POLICY Marsh & McLennan
(a) City Administrator and City Attorney recommended awarding
bid to Marsh & McLennan for $500,000 single limit coverage
for one year, Coverage is the same presently carried.
Premium for one year will be $4671.
(b) Motion to approve awarding bid to Marsh & McLennan:
Councilman Norton, seconded by Councilman Bergmann.

I)irector of Public Works outlined methods of assessment
and recommended adoption of method 3 which would give credit
for $250.00 base charge on O.E.A. line.
Mr. Stewart testified against method -#hree and requested
tax lot 2600 be exempt from assessmet*.
Attcrney Anderson commented on general and special benefits
of installation of sewer and stated the question for Council
to decide what would bea does the new line confer new
benefit to Mr. Stewart's property? If so it could be
recognized as another assessment..
Mr. Cecil Posey, representing O.E.A. , who own tax lots
1301 and 1400 testified against excessive costs.

(b) Motion by Councilman Norton to deny ordinance 71-38.
Motion died for lack of second
(c) Motion by Councilman Bergmann the ordinance be tabled
