For your convenience, we are initiating a calendar year expiration date for all
Home Occupation Permits so they will correspond with the Business Tax
expiration date. This means ,you will be billed only once a year and both the
Home Occupation Permit and Busineas Tax will expire annually on December 31st.
To make this transition to the calendar year expiration date, we have adjusted
the expiration date of your Home Occupation Permit. You will not be billed
again until December 31, 1990 for the home Occupatic.n Permit renewal. You
will, however, be billed for the Business Tax at the end of this year, December
31, 1989. Thereafter, the annual Home Occupation Permit and Business Tax fees
will be due in full on January 1st of each year.

We are requesting a review of our problem of operating four heavy duty trucks which
were parked on our property when not on duty. We would like to explain that the
trucks are leased to Line Haul Trucking in Portland and operate in Oregon and
Washington. I drive one truck and the remaining three are run by certified drivers.
Without one exception all drivers we have, and have had, have all been unemployed.
We recently received a letter from the office of Motor Carrier Safety asking how
many miles our trucks have run in the past twelve months. That total is 218365
miles. Using those miles also details the following: 1- Saying all those miles were
in Oregon would mean Oregon PUC would get $20526.31 (for roads). #2-Based on an
average of 5 mpg would be 43673 gallons of fuel of which 15C is paid for fuel tax of
$6550.95 (for roads). 03-In addition each truck pays Hiway User Tax to I .R.S. Last
year for each truck was $210. and this year it has increased wll over 100% to the
total of $550. per truck.
For any clarification, it is our intention to do only light maintenance at home;
such as washing, greasing, change of oil when needed. All major work is done by
Truck Repair Shops such as Wallace Repair Shop in Tualatin. As a perfect example
my truck needed another motor and the work was done At Wallace Truck Repair at a
total expense of $1418. 15. Another truck will soon be going there also. Labor alone
is $38.00 and sometimes more. While two of our drivers are mechanics, we are hoping
you will understand our definite need for light maintenance.
W7 can confirm that for the f. rst six months that our gross income is $89,298.75.
However our total expenses is $89,691 .78 and the final result is $.93.04 in the red.
We purchased our home from Mr. & Mrs Gaittens in 1973. They had operated a plumbing
busines off the property for years. They had an office in the basement, backhoes in
the yard, pipes all around and whatever was required. They built; the home twenty
years ago. We recentlyi learned that both Mr. & Mrs Gaittens are deceased.
Again we ask for an- consideration you may give. Our drivers are takigg their trucks
home and it will be a rarity that the other trucks will be on our property.

Dear Mr. b Mrs. Clarke
It has recently been brought to my attention that you maybe running
a business out of your home. According to City of Tigard's
Community Development Code, Section 18.142, you are in violation of
conducting a business without a home occupation permit. This permit
oust be applied for through the Planning Department. If approved,
it would allow you to continue your business in your home. You are
also required by Ordinance to pay an annual business tax, which can
be applied for through our Finance Department.
At this point, without the permits, you are in violation. Until
your permit Is approved, you may not conduct a business from your
residence. Failure to comply with the above requirements could
result in civil court proceedings.
I will expect that within three days of receiving this letter, you
will have begun the permit process. If you have any questions,
contact Lis Newton, Associate Planner at 639-4171.
