CASE: HOP 3-84 Carlson
After the decision was issued on the above ,pplication, during
the appeal process, Building Inspector Brad Roast raised a concern about
housing handicapped individuals in the residence without providing adequate
fire, life, safety protection for those individuals.
On May 4 , 1984, at approximately 1 :00 A.M. I contacted Mrs. Carlson
regarding handicapped residents in her home. She informed me that no
handicapped individuals lived in the home and that tier home was not set
up to accomodate handicapped individuals. I informed her that if handicapped
individuals did move in her home, there were Uniform Building Code requirements
for the protection of those individuals which would have to be met.

APPLICATION: A request. by Harold Carlson and Jolene Carlsol for a Home
Occupation Permit to operate a Residential Hume for the
Handicapped on property zoned R-1 located at 14615 SW Hazeltree
(Wash. Co. Tax Map 251 10 BC Lot 600).
DECISION: Notice is hereby given that the planning Director for the City
of Tigard has APPROVED the above application subject to certain
conditions. The findings and tionclusions on which the Director
based his decision are as noted below.
A. FINDING OF FACT
1. Background
No previous applications have been reviewed by the Planning
Department on this property.
2. VICINITY INFORMATION
The subject property is surrounded by parcels that are all zoned
R-1 (Residential) .
3. SITE INFORMATION AND PROPOSED DESCRIPTION
There is a 6, 100 square foot home on the property. The
applicant is pro. -,ing to use approximately 655 square feet for
Handicapped Residents. The applicants will occupy the remainder
of the home.
4. AGENCY AND NPO COMMENTS
None
B. ANALYSIS AND CONCLUSION
The proposal appears to be in conformance with the provisions set
forth in Chapter 18. 142 of the Tigard Municipal Code.
C. DECISION
Home Occupation Permit HOP 3-84 is approved subject to the following;
conditions :
1. The square footage of the home used for occupancy by hand icappf,d
residents shall not be expanded.
2. There shall be no people employed at the home who are n(,t
residents of the home.
3. There shall be no signs or advertising visible from the exterior
of the premises.
4. There shall be no more than five residents of the facility
receiving care.
5. The Home Occupancy Permit shall be renewed annually.
6. A Business Tax shall be obtained for the premises.
D. PROCEDURE
1. Notice: Notice was published in the newspaper, posted at City
Hall and mailed to:

The Planning Director has approved a Home Occupation Permit to operate a
Residential Home for the handicapped on property zoned R-1 located at 1461.5 SW
Hazeltree (Wash. Co. Tax Map 2S1 IOBC lot 600).
The adopted finding of facts, c+ecision and statement of conditions can be
obtained from the Planning Department, Tigard City Hall, 12755 SW Ash, P.O.
Box 23397, Tigard, Oregon 97223. The decision shall be final on May 11,
1984. Any party to the decision may appeal this decision in accordance wits
section 18.32.290(A) and section 18.32.370 of the Community Development code,
which provides that a written appeal may be filed within 10 days after notice
is given and sent. The deadline for filing of an appeal is May 11, 1984. The
hearing on an appeal will be De Novo.
