Nicoli moved and Goldbach seconded that the proposal be
tabled until the November 16th meeting to allow the
applicant to negotiate the location of the sign with
staff. In the meantime one sign on Hall Blvd. and one
on Pacific Highway off the sidewalk would be permitted.
The motion was approved by unanimous voice vote.
7. J SIGN CODE REVISIONS SCR 5-76
Amend the City Sign Code Sectiol 16 .36.040 (3-9) . Free-
standing signs.
A. Staff Report : Read by Daniels.
Staff informed the Commission that notice had been
published twice in the Tigard Times, that notice of
the study session was published and agendas were sent
a week in advance to 99 sign companies.
B. Public Testimony:
Staff presented written testimony from Mr. Jerry Scott
of Sign Craft . Testimony consisted of a letter and a
booklet with pictures.
Testimony in favor:
o Dick Kluempke a. representative of Neighborhood Planning
Organization (NPO) III asked that the goals of the
Neighborhood Plan be incorporated into the new sign
code to provide high quality design standards for
signs. In Mr. Kluempkes opinion the adoption of the
new sign code would be a step forward to improving
Pacific Highway .
o Florence Heim, NPO IV, seconded Kluempke' s recommenda-
tion and further stated the need for a complete reform
of signs .
o Jan Choruby expressed concern about the sign problem
on Pacific Highway and suggested that some type of
design control would be appropriate.
Opposition :
o Larry Azeltine, representing Oregon Electric Sign
Association, stated that a sign should be strictly
between the sign company and the business. He asked
that Design Review Board not be allowed to review
signs since the Board does not always understand the
economics of business.

o Azeltine also informed the Commission that Oregon
Electric Sign Assoc ation is currently suing the
City of Gresham for allowing their Design Review
Board to review signs.
o Phillips objected to the threat of lawsuit if the
Commission acts affirmatively .
o Leonard Reinecke, representing Ramsay Sign Company
and Oregon Electric Sign Association stated it; would
not be a workable solution for Design Review Board
to govern signs since aesthetics could not be
legislated.
o Bob Pershing, Oregon Sign Company , seconded Mr.
Reinecke 's statement and informed the Commission that
the sign industry could be trusted to do the best
job possible .
o Staff read Jerry Scott ' s written submission , the main
point presented in the letter was a request that the
sign code should include stricter aesthetic control .
C. Staff Recommendations:
Staff recommends that Section 16 . 36 .040 ( 3-7) be
deleted and that the following language be inserted in
its place :
"( 3) One multi-faced free-standing sign identifying the
principal goods, products, facilities or services avail-
able on the premises shall be permitted on a 'premises ' .
(4 ) Free standing signs shall not exceed the sizes set
forth in the following chart :

(5) Every free standing sign shall include the street
address of the property if the address is not readily
visible from the street.
(6) In the case of a 'shopping center' or other pre-
mises with more than one tenant, a, single format shall
be established and the sign shall include: the name cf
the shopping cepter or czirplLx, if it has a name, and
the naine of ..he shopping center or complex sball appear
in print which is larger than th-• :game of any tenant.
(7) No free standing sign permitted pursuant to this
section except theatre marquees shall include a sign
of the type known as a "reader board". For the pur-
poses of this section a "reader board" is defined as
a sign designed so as to permit the changing of the
message of the sign regularly or frequently, as, for
example, a sign made up of a blackboard, changeable
paper faces or a .rack designed to hold movable letters.
(8) Permits for the construction or placing of free
standing signs pursuant to this section shall be issued
only after the: following conditions have been met :
a. The applicant shall submit both a plot plat
and a scale drawing of the sign. The plot plat shall
be made to scale and it shall indicate the location of
all buildings, property lines, existing signs, streets ,
driveways and overhead power lines on the premises. In
addition , the plot plans shall show the approximate
location of neighboriiig signs and buildings within .100
feet on either side of the subject premises. The scale
drawing of the sign shall show the sign dimensions, the
colors, materials, construction , height above ground, and
source and intensity of illumination.
b. The application , including the information re-
quired by paragraph a above, shall be submitted to the
Design Review Board, which shall review the proposal .
The Design Review Board shall determine whether the
sign as proposed is acceptable given its impact on 1 .
public safety, 2 , the architectural compatibility of
the elements of the sign one with another, 3. the
compatibility of the sign to its surroundings, 4 . its
aesthetic qualities, 5. its consistency with the needs
of the business (:jr businesses to which it relates.
(9) The position of the sign will be governed by the
need to protect the visibility of adjacent signs within
100' on either side of the premise.
( 10) Each free standing sign shall be surrounded by an
area set aside to protect the sign from vehicles negotiat-
ing in 'the parking area of the business to whish the sign

relates, and the area so set aside shall be landscaped.
The size and shape of the area set aside and the land-
scaping shall be represented in the plot plan required
by this section , and shall be subject to the review
and control of the Design Review Board. "
Daniels informed the Commission that it has been the
City ' s policy to resolve the problems associated with
Pacific Highway . Of the four affectors that set the
tone for what occurs on the highway - speed , access
points , land uses and signing - the City has control
over two of them. In 1975 the City revised the C-3
zoning to more effectively control the land uses and
now in 1976 the oversized and distracting signing
should be corrected. i
Joe Bailey , City Attorney , asked that Planning Comniission
set a time limit on which non-conforming signs would have
to come into conformance.

D. Commission Discussion :
o Tepedino stated that the Commission should take a
stand based on the evidence presented at the meeting.
o Moore asked that matter be tabled until Mr, Jerry
Scott could appear in person with his recommendation .
o Wood informed the Board that if a vote was taken
tonight he would have to abstain since he was new
to the Commission .
o Sakata stated that more specific standards would
hamper originality .
o Tepedino stated that continued delay would prejudice
the rights of concerned citizens and that adopting
the new sign code would be an affirmative act in
establishing better design Standards.
Goldbach moved and Sakata seconded to amend the sign
code with the warding as submitted in the staff
recommendations .
The motion was approved with Phillips and Wood abstaining.

BASIC FACTS :
1 . Tigard Community Plan, Neighborhood Plan I , Neighborhood
Plan II , and Neighborhood Plan III state as a policy item
that the City should "establish high design standards for
signing and appearance. " It further states that policies
should be reflected in the Tigard Municipal Code.
2. 18.58.020. 3 Purpose of Design Review states as an objective
to "Conserve the City 's natural beauty and visual character
and charm by insuring that structures, signs , and other
improvements are properly related to their sites and to
surrounding sites and structures" ;
3. The sign code 16 . 36. 040 presbntly states "maximum height
of any portion of a sign or sign structure shall be forty-
five feet from ground level . " Sign area shall not exceed
"seven hundred fifty square feet of sign area per sign face ,
or a total of one-thousand five-hundred square feet for all
sign faces . "
FINDINGS :
1 . The present sign code does not conform to the Tigard
Community Plan, Neighborhood Plan I , Neighborhood Plan II ,
or Neighborhood Plan III nor Tigard Municipal Code Chapters
18. 58 and 18. 59 (site development plan and architectural
Design Review Board) ,
2 . In order to comply with the Tigard Community Plan and
Neighborhood Plans the City Sign Code should be amended
to reflect the need of establishing; high design standards
icer signing and appearance in order to protect the visual
quality of the city .
3. The need of a business to identify their location should
conform to the goals and objectives of the community.
4 . The purpose of Design Review states that signs should be
propertly related to their sites and surroundings . The
sign code should be amended to reflect this purpose .

5 . The pub.'ic safety is greatly diminished by oversized and
improper signs which compete for the drivers attention .
Since over 36,000 vehicles per day use S .W. Pacific Highway
it is important that signs be readable without being
obtrusive .
6. The appearance of a street is greatly affected by the
quality of the signing. As Pacific Highway continues to
develop the clutter and confusion will increase. Since
the value of property is affected by its surroundings,
poor signing will tend to downgrade the City and depreciate
land values .
7. The present code determines the area of the sign by the
amount of frontage the business has. For instance, a
premise which has 300 ' of frontage would be allowed a
350 square foot sign . The present code also allows
frontages to be combined when calculating sign area. For
example, the family drive-in has 120' of frontage on SW
Pacific and 750 ' on 72nd Avenue . This allows a total sign
area of 920 square feet.
8. The present code determines sign height by the distance
from the center line of the road to the sign . Depending
on how the owner positions his sign , a sign up to 45 ' is
allowable.
9. By allowing signs up to 45 ' high and 1 ,500 square feet ,
there i.s no way to ensure that signs will be compatible
with their site or surroundings, that adjacent businesses
will not be blocked from view, or that the community will
be enhanced by their presence.

Staff and Commissioners ;
First of all , I must apologize for my absence at the forthcoming
Nov. 2 , 1976 Tigard Planning Commission meeting. I had every in-
tention of attending, but found I had a previous commitment . .
As per planning staff request , I have reviewed the proposed re-
visions ; SCR5-76 , of the Tigard Sign Code , and would like to comment
on a few of the changes .
Under the heading of basic facts , you define the purpose of the
N. P.O. Groups I , II , III , and the Design Review Board . In both cases
the reasons stated are assurance of high design standards , natural
beauty, visual character, and charm, all words which could be used
synomously with one word: AESTHETICS. In pursuit of that goal , you
have proposed several recomendations , most of which are additional
size and height restrictions . This is the usual approach to correct-
ing some of the problems incurred in the past , and from the stand-
point of todays standards , have created the present sign jungle we
are currently blessed with, I .E. Pacific Highway.
In an effort to correct this , sign code restrictions , after sign
code restrictions have been legislated, to little or no avail . With
that in mind, I would like to propose a different approach that I
feel has considerable merit . Instead of putting so much emphasis
dimention restrictions , concentrate more on the one thing that will
solve a large share of the problems of sign blight. In Tigard , or
any other community for that matter. Nothing new, but a judgement
standard used to evaluate all future expansion and construction in
our city. The magic word? you used it in stating the purpose of
N. P.O. Groups and *-' - Design Review Board, and even the Planning
Commission. itself: AESTHETICS .
I will be the first to agree that there has to be restrictions gov-
erning quanity, size and construction standards , but what ever
happened to AESTHETICS??? .
In essence , what I am trying to say is this ; set standards that will
insure more design and aesthetic merit . The first reaction to this
kind of proposal , is for someone to jump up and repeat the banal old
statement ; 'you can' t legislate aesthetics ' . Well I say you can.
Apparently the staff feels so too , as on nage two of the second sec-
tion of the November 2 , 76 Planning Commission agenda, three of the
five guidlines set forth do make an attempt to legislate aestheti.cs ,
items 2 , 3 , and 4.
Thew three items could be expanded to encompass use of color and
materials . Example,- Restrict the use of flourescent day-glo colors ,
the.v are not only cheap and garish looking, but have short term dura-
hil.. y. Material usage , restrict use of foam plastic in any form of
exterior signs , for the same reasons as with day-glo paints , cheap
looking, and of limited durability. These are only a few suggestions
the balance of which could be discussed at a later date.
The "fly it-, the ointment" , if of course is the overload of the Design
Review Board. Aesthetic Evaluation is a guideline that should be im-
posed on all signs , not just the freestanding signs now under dis-
cussion. It is not reasonable to send every sign applicant to the
Design Review Board. This would penalize the sig-t-i applicant by delay
in securing permits , and would requiree tr much time to attend the
meetings in Tigard and surrounding commu � : Les . It is unfair to the
Design Review Board, as it would pose thL iroblem of too much to
evaluate it the allowable time.
The solution to that is as follows : Appoint one of the staff you now
have working with the Planning Section and give them the authority
to make judgement as to esthetic value. If they feel an application
for a :sign permit does not meet the guidelines , then that proposal
shouid be rejected on that basis . In fairness to the applicant , he
hould he ,granted a right of appeal before the Design Review Board.
Some objections will be raised as to the capability of anyone on the
current planning staff to judge aesthetics . Anyone who has been to
many Design Review Board meetings knows that the staff recommendation
is approved most of the time , a conservativE estimate would be 90%
of the time. In my position as a sign contractor , I have worked with
present stafF, and feel that they are capable of such a position.
On a trial basis , I might recommend trying my suggestion for given
time , and then have the Design Review Board review some of the evalu-
ators decisions .
This approach is only %alf a solution to the problem. The other half
is already in Cite sign code. The existing sign erode has the "teeth"
to Pnflurce action on existing signs , that are todays problem. I am
enclosing a few pictures of signs taken in the Tigard area , with the
purpose in mind to illustrate that size restrictions alone do not
solve the sign blight by themselves . The sign pictures I am submitting .
ar.e acceptable under the present code, and will be acceptable under
Uie new size restrictions . My point is to illustrate the need for
more emphasis on aesthetics . That combined with the chapters 16.44 ,
sections 030 , and 040. Chapters 16 . 48 sections 0*10 , 020 , and 030.
if enforced would make considerable impact on the signing which now
exists in Tigard.
I would not be opposed to aesthetic evaluation on any sign that I
reques4 a permit on. I have the confidence , and background as a sign
coijlactor, that the signs I manufacture and install are of high
standard, both from the stand point of desgin and quality. I have
a double interest in this community. I own a sign business and
commercial. property in the downtown business area , and have been a
Tigard area resident for the past 13 years . I care about the Visual
appearance , especially from the sign aspect . That care has been
reflected by the quality of my product, and I am sure that care
can be attested to by your staff members .
Unfortunately, the word "sign" is a four letter word, and thru past
effort; of a few greedy sign companies , and a "'don' t give a damn
attitude" of some of the past building department. employees of the
City of Tigard, "sign" is now synonomous with a. few other four letter
words. After thirty years in the sign business , Y find that analogy
extr.emel,J distasterull.
Signs have a dual purpose : 1 . Identification as to business location,
and 2. Adverti3ements of products available.
Signs can be an asset to this community , both economically and
aesth-�ctically. But not thru continued restrictions . rather thru
enfor,:ement of existing code restrictions and AESTHETIC EVAT.JJATION.
In closing, I would like to ask that the passing of any further
size and height restrictions , be tabled until the Nov. 16th Planning
Commission Meeting. If this :quest is granted, it would give me
an opportunity to lend credibility to my proposals by making a reV4ew
of some of the existing signs in the Tigard area, for instance ,
portions of P , ' fic Highway. I will volunteer my time and shoulder
expenses that .�,:e incurred. My study would evaluate existing signs
in relation to the five guidelines set down by staff, and five of the
biggest reasons for the visual deterioration of some of our business
areas . 1 . Neglected maintainance. 2 . Inept attempts by do-it-
yctirselfers . 3. Signs installed without permits . 4. Non-conforming
signs . 5 . Poorly designed and cons�ructed. signs by amatuers and
self appointed sign experts.
I started this letter with an apology, so it only seems proper that
I close i.t with an apology for its length. As I have previously
stated, I have been in the sign business for thirty years , and am
very disappointed at the direction it seems to be heading. Thrii no
fault of my own, I seem to have been reduced to the level of carpet
baggers , and speculators of shady character. I would like to see
that situation corrected, and nothing could give me more joy than to
see it happen here in the city I have chosen to live in.
Thank you for your kind indulgence , I am looking forward to the
opportunity to present to you my study on existing, signs .

FREE-STA:;DING SIGNS
EXISTING CODE :
(A) Number Permitted: One multi-faced free-standing sign
designating the principal goods, products, facilities or services
available on the premises shall be permitted on a street or highway
frontage . Where a frontage exceeds three hundred feet in length ,
one additional free-standing sign is permitted for such frontage.
(B) Height Limit : No free-standing sign shall exceed in height
the distance of any portion of the sign to the center of the ad-
jacent public right-of-way (see Figure 1 ) . The maximum height of
any portion of a sign or sign structure shall be forty-five feet
from ground level at its base regardless of location . The minimum
clearance below the lowest portion of a free-standing sign and
the ground below shall be fourteen feet in any driveway or parking
area.
(C) Area: The maximum permitted area of a free-standing sign
shall be computed on one and one-half square feet of area per lineal
foot of street or highway frontage for the first one hundred feet
of such frontage, plus one square foot of area for each foot of
frontage over one hundred feet , but not exceeding seven hundred
fifty square feet of sign area per sign face , or a total of one
thousand five hundred square feet for all sign faces (see figure 2) .
(4) When a premises fronts on more than one street , the pro-
perty may be permitted to have one multifa( ed, free-standing sign
for each such street frontage provided, however , that only the
lineal frontage of that street tows.rd which the sign faces may be
considered in establishing the maximum permitted size of such sign .
( 5) Where a premises fronts on two or more streets, the owner
may elect to combine the total street frontage and erect only one
free-standing sign with the area to be determined by the total
length of the combination of such frontages provided that the
maximum area shall not exceed the limits specified in subdivision ( 1 ) .
(6) Two or more owners of adjacent separate premises zoned for
commercial use may combine their street or highway frontages and
erect one free-standing sign whose size shall be determined by the
combination of those frontages but shall. not exceed the sign area
permitted by subdivision ( 1 ) . No other free-standing signs shall
be permitted on either of the adjacent premises if the owners make
such an election .
(7) Where two free-standing signs are permitted on the same
frontage for the same premises, the combined total of sign area
for all sign faces shall not exceed that specified by subdivision ( 1 ) .
(8) No free-standing sign , or any portion of any free-standing
sign , shall be located on or be projected over any portion of a
street , sidewalk or other public right-of-way or property . Signs
may be located within setback areas only as provided in Section
16.28.040.

"It shall be unlawful to erect any ground sign whose total height
is greater than 20 feet above the level of the street upon which the
sign faces, or above the adjoining ground level , if such ground level
is above the street level . "
PERTINENT INFORMATION
The major flaws in the existing code are :
o The size of the sign is determined by the amount of frontage.
Therefore signs can be erected that are not architecturally
in scale with the buildings .
o Size of the sign has no relationship to the identification
needs of the business. Businesses with the most frontage get
the largest signs .
o The sign code does not protect adjacent businesses or the
public from overly ostentatious signs . As Pacific Highway
continues to develop the clutter and confusion will increase.

REASON FOR NEW CODE :
There is presently no code that takes into consideration premises
that have more than one tenant . What has happened in the past is that
the first tenant uses all the legal sign space, or in the larger shop-
ping centers such as Tigard Plaza and Village Square the free-standing
signs becomes a hodgepodge of varying styles, shapes, and sizes.,
ITEMS TO CONSIDER:
o Owner of a premise with more than one tenant should see that
a free-standing sign is constructed that. provides space for
future tenants.
o One format should be established for a sign which is used by
more than one tenant.
o A minimum :size should be determined for each sign section so
that the sign i legible from the street .
o The minimum letter height outlined under free-standing signs
should be followed.
o The complex name should be on the sign and should be larger
than the tenant 's signs .
o The number of tenants allowed to advertise on one sign should
be regulated.
o Space on the sign should be reserved for units that cannot
be viewed from the street.
o Shopping centers should e.dvertise only the complex name.
Tenants would be identified by wall signs.

I . BASIC FACTS:
1 . The existing code 16 . 28.010 (a) reads "the building
official shall give sixty days written notice by registered
mail to the owner of the sign. If the owner of the build-
ing, structure, or premises upon which such sign is
located fails to remove the sign within thirty days after
receipt of written notice. . . "
II . ,INDINGS:
1 . The existing time limit of 60 days notice is in excess of
what can be reasonably expected. A shorter time period
would necessitate the owner attending to the matter
promptly .
2. The amount of time specified for written notice and the
amount of time specified before the City can have the
sign removed should be identical .
3. Registered mail currently costs $2.48 a letter, restricted
certified mail costs $1 . 58 a letter. Restricted certified
mail serves the same purpose legally as registered mail
and would involve a savings to the taxpayer .

the plot plans shall show the approximate location of

12) No freestanding sign, or any portion of any freestanding
sign shall be located on or be projected over any portion of
a street, sidewalk or other public right-of.-way or property.
Sign may be located within setback areas only as provided in
Section 1E.I.0.040.
-3) When a premise contains more than a single tenant but is
not defiiied as a shopping center, the provision of a free-
standing sign shall take into consideration the needs of all
the separate tenants. The design shall be prepared by a
professional designer and take into c::onsiderstion the need
for providing a signing system which is harmonious in
appearance and legibility. Building, owner shall provide at
his own expense a common support for all tenant signage.
Said support should be engineered to withstand 20 lb. per
sq. ft. wind load of completed display ur to an additional
509 of sign copy area may be permitted when deemed necessary
by the Planning Director to adequately identify the
separate tenants.
14) Shopping centers or industrial parks, defined as an area
of not less than eight business units consisting of no~: less
than 4 acres shall establish A sinfrlP format. The design
shall be prepared by a professicnal sign designer. The
sign shall include the complex name, and address. Up to an
additional 50% of sign area may be permitted when deemed
necessary by the Planning rirector to adequately identify the
center. This increase should. be Judged according to unique
identification needs And circumstFinces which necessitate
additional area to make the sign :sufficiently legible. When
a shopping center or industrial perk has more than one main,
entrancc on separate frontagAs a ;second freestanding sign
may be allowed. The two allowablo� signs shall face separate
frontages and are not intended to be viewed simultaneously.

At the October 26thoi.nt study� 3 sessio n on free standing
signs, the following items were discussed and agreed upon:
1. That all free standing signs should be subject to
Design Review in that they are a structure and as
much a part of the sites architecture as a building.
2. That the maximum height and area shell be taken from
the chart presented in Street Graphics instead of
solely on street frontage as in the existing code:

MEMORANDUM
FROM : Dick Bolen, Planning Director
On November 2, 1976, the Planning Commission will consider a
proposed sign code revision which would place free-standing signs
under Design Review Board ,jurisdiction, while at the same time reducing
the permitted sign size and height . These revisions will benefit the
appearance of Tigard and the Planning Commission needs to hear from
the Citizens of Tigard in addition to the usual contingent of sign
company lawyers. We, therefore, ask that you attend the meeting or
submit your written comments to the Planning Department prior to the
meeting.
The sign code revision is the la.st item on a short agenda and
should be heard at about 8 : 30 PM at Twality .Junior High School , Lecture
Room, 14650 W 97th Avenue.

ment policies in room 409 of the administration complex.
On Thursday, Oct. 28, the Washington County Welfare Advisory
Huard will meet at noon in room 103 of the county building to discus.;
client representation and to plan involvement in the 1977 legislative
session.
Also on Thursday, the Washington County Traffic Safety Commis-
cion will meet at 8:30 a.m. in room 418 of the administration buiidiny
to discuss bus routing problems within the Tigard School District.
