Re. 4- Accessory Structure Application
Dear Mr. Fulton:
I
This letter is in response to your request to construct a fifty (50) foot radio tower/antenna. The
Planning Division has reviewed this request and found that the structure complies with the
requirements for accessory structures.
The proposed tower is not located in the requited front yard and r 7,,nplies with applicable side and
rear yard setbacks. Due to its design and location, the accessory ,tructure would not be expected
to emxoach upon, or interfere wit(. the use of an adjoining property or public right-of-way
including streets, alleys and public or private easements. The Tigard Community Development
Code Section 18.98.010 states that, projections such as chimneys, spires, towers excluding TV dish
receivers, aerials, flag poles and other similar objects not used for human occupancy, are not
subject to the building height limitations of this title. Therefore, the proposed radio tower is not
restricted to the 30 foot height requirement of the R4.5 zoning district.
The proposed tower is designed to be attached to the residence. As such, it is considered as a part

of the principal structure and must comply with standard side and rear yard setbacks. Seddon
18.144.070(A)(3) which requires setbacks equal to, or greater than, the height of the accessory
structure is n-' applicable to this application as this tower is not a freestanding tower.
