APPLICA"PION: A request for approval of an accessory structure permit, to
construct a detached garage and an administrative variance to allow a 14'6"
high building when the Code allows a maximum height of' 12 feet , The property
is . 31 acres in sire and is zoned R--4.5. (Single Family Residential, 4.5
units/acre) . Location: 12435 SW 12Lit. (WIM 2S1 3BB, Lot 6900) .
DECISION: Notice is hereby given that the Planning Directur's designee for
the City of Tigard has approved this request subject to certain conditions.
The findings and conclusions on which the Decision is based as noted below.
A. VINDING Of FAC-1
1 . Background
No previous applications have been reviewed by t:he Planning Division
with respect to the subject property. A lot line adjustment request
by the same property owner will bo processed shortly .
2. Vicinity Information
Properties to the north, west: and oast are also zoned and developed
R-4,5. Properties i.nunediatrly to the south are in Washington County
and are zoned R-6 (Singly- family residential , 6 units/acre) .
3 . Site Information and Pr•nposal Description
The site is presently occupied by a single family residence. The
applicant wishes to construct a 24' x 16' detached garagr� on the
southwest corner of the property . The building height will be 14'6" .
4 . Agency and NPO Comments
B. ANALYSIS AND CONCLUSION
Section 18 . 144 .070 of the Code contains the approval criteria whereby the
Director can approve, approve with modifications or deny an application
for, an accessory structure. -the relevant criteria are;
(T ) for parcels within a ruxsi.dont:ial zom, that aro. less than 2.5 acres in
size, any accessory building within a residential Zona shall have no
mure than 500 square feet of gr-oss flour arra.

(2) In no case shall the accessory building(s) and princir>al structure
exceed the maximum lot coverage allowed by the base zone.
( ) No accessory building or structure shall be allowed in an, - quired
front yard.
(4) Except as provided in Section 18 . 144 .070(b)(6) below, accessory
structures in residential zones shall maintain a rear and side yard
setback of 5 feet. Accessory structures within commercial and
industrial zones shall comply with the set:back requirements of the
applicable zone.
(5) 'Ihe applicant shall present document.atiori of the po:;session of any
required license by any federal., state, or local agency.
(6) Any accessory building or, structure attached to the principal building
or structure must comply with all setbacks of the zoning district.
(Attached means wall-to-wall or any permanent roof attachment such as
breezeways) .
(7) No accessory building or structure shall encroach upon or interfere
with the use of any adjoining property or public right-of--way
inc.lud.inc; but: riot limited to streets, alleys, and public or pri.vato
eas,omonts .
(8) Any accessory structures shall not exceed an average. height of 10
feet, but at no point shall exceed 12 feet- in height, (as defined in
Section 18.26 .030) (See Chapter 18 .98 BUILDING HLIGH-f LIMITATION,
I::XCEP f.1ONS) .
(9) All accessory structures shall be built in accordance with tho Uniform
Building Code.
-Ihe proposed accessory building meets the maximum size requirement of no
more than 500 square feet. The building will bn 384 square feet. T-he
proposed building will not exceed the maximum lot coverage requirements
for the R-4.5 zone and it will riot- be placed in the front: yard. Rear and
side yard setbacks of at. least five feet, will be. m4intained. The
accessory structure will riot encroach upon any neighboring properties or
the public right--of--way.
our records indicate the residence is serviced by a septic tank and is not
connected to the City sewer system. The applicant should identify the
location of the septic tank drain field so that it can be determined
whether an encroachment will occur by I'he siting of the garage. Private
easemc�nt.R have not been idont..ified by the applicrint on the property
either. Finally, conformance with the Uniform Buil-iing Code will be
verified via the building permit process ,
Tho applicant proposes to build a -:trucLuro 2,5 feet in excess of LhQ
maximum height. the Coda will allow for accessory kmildinds . This
necessitates evaluation for a variance.

Section 18 , 1134.050 of the Cade contains approval criteria whereby the
Director can approve, approve with modifications or- deny a variance
request, They are:
(1) The proposed variance will not be materially detrimental to the
purposes of this Code, lies in conflict- with the policies of the
Comprehensive Plan, to any other applicable policies and standards;
and to other properties in the same zoning district: or vicinity;
(2) lhery are special circumstances that exist which are peculiar to the
lot size or shape, topography or other circumstances over which the
applicant has no control, and which are not applicable to other
properties in the same zoning district;
(3) The use proposed will. be the same as permitted under this Code and
City standards wil' be maintained to the greatest extant that is
reasonably possible, while permitting some economic use of the land;
(4) Existing physical and natural systems such as, but riot limited to,
traffic, drainage, d,-amat.ic land forms or parks, will not' adversely
affect any more than would occur if the development: worn located as
specified in the Code; and
(5) "Ihe, hardship is not, self imposed and the variance requested is the
minimum variance wl-d,,h would alleviate the har•ds-hip.
Staff is in the process of revising the Accessory Use chapter to propose a
new maximum height of 15 feet for accessory structures . Staff has seen an
increasing number of variance requests to the maximum accessory structure
building height ranging from one.-half a foc)t to a couple of feet.
The proposed accessory structure will face a vacant lot in the rear and a
lot occupied by a single family residence at its southern side yard . The
additional 2.5 foot height at the roof peak will not have a detrimental
effect upon adjoining properties, City Code would allow construction of a
residence with a height of 30 feet and a side yard setback of five feet..
The proposed variance will riot be materially detrimental to the Code or
the policies of the Comprehensive Plan or to any other policies and
standards. Existing physical and natural systems will riot he affected.
City standards will be maintained to the greatest extent possible.
C. DECISION
The Planning Director's designee for the City of Tigard hereby APPROVES
M 88--24 and V 88--38 subject to the following conditions:
1 . UNLESS 0-1-11MI:Sr. WILD, ALL CONDITIONS SHALL BE MET PRIOR 10 ISSUANCE

2. The applicant: shall submit detailed plans of the property showing the
