VARIANCE CASE NO. V 5-84
APPLICATION: Request of Jack Durrett to vary the street side yard setback
from 15 to 10 feet and to vary the required distance between a primary
building and accessory structure from 15 to 4 feet in the R-4.5 (Resideu`ial ,
4. 5 units/acre) zone on property located at 11960 SW 121st Avenue, Tigard
(Wash. Go. Tax Map 1S1 34, Tax Lot .3700).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED gyne above application subject to certain conditions. The
findings and conclusions on which the Director based his decision are as noted
below.
A. FINDING OF FACT
1. Background
No previous cases have been reviewed by the Cit) on this property.
2. Vicinity Information
The property is on the southeast corner of 121st Avenue and
Katherine SLreet within Leron Heights Subdivision which consists
of single family residences on lots that range between 11,000 and
21 ,000 square feet . Similar residential development is located on
the west side of 121st Avenue.
3. Site Information and Proposai Description
The property contains a residence which has a driveway on
Katherine Street. 'I1le house had an attached garage which has been
converted to increase the living area. The applicant proposes to
use the existing driveway and construct a c,etached two car garage
that conforms with the architecturai style of the house. The
variance is requested to allow a 10-foot street side yard setback
and a 4-foot distance between the residence and the garage.
A solid wood fence with a 10-foot setback along Katherine Street ,
is east of the driveway. The proposed garage will he situated
immediately south of the fence on the east side of the driveway.
The garage will maLntain an 18-foot setback from the rear yard
property line to 'he east.
4. Agency and NPO Comments
The reviewing agenc.es and NPO #7 have no objection to the
proposal.

B. ANALYSIS AND CONCLUSION
In order to approvc a variance, the criteria in Section 18. 134.050 must
be satisfied. The proposed garage is consistent with these criteria for
the following reasons. The location of the garage is consistent with
all other applicable provisions of the Code and its location represents
the minimum deviation from the setback requirements to alleviate the
hardship. The garage is allowed in the zone and the structure will not
encroach upon adjacent properties. Because of the fence which will be
in front of the garage, the garage should not have a significant visual
impact.
C. DECISION
Variance � 5-84 is approved subject to the following conditions:
1. The garage shall be located as shown on the site plan submitted by
the applicant. The garage shall have a rai.nimum setback of 10 feet
from Katherine Street and 15 feet from the eastern lot line.
2. The existing driveway shall be utilized for the new garage. Any
modification or relocation of the driveway must be approved by the
Engineering Division.
3. This approval is valid for the period of one year from the final
decision date noted below.
D. PROCEDURE
