RE: Antenna Support Structure Application
Gentlemen:
Herein attached is my application for a new Antenna Support Structure and Building
Permit for my new residence located at 12200 S.W. 116th Avenue in Tigard. My wife
and I just purchased this property in March of 1996 from Mr. & Mr. L.A. Fellows. As you
know, Washington County is running about three months on recordings so it may still
show the former ownership.
In July of 1995 you approved a similar sI-ucture for me at my previous address of
12185 S.W. 128th Ave. A copy of Mr. D'Andrea's approval letter is enclosed. That
project was completed, received final approval and easily weathered the winter storms
which were some of the worst in thirty years.
Unfortunately '.he installation was not as successful from an electronic interference
standpoint and I had one neighbor who objected to the aesthetics of the installation.
So I moved and purchased a property where I can reasonably expect to avoid those
problems previously experienced.
The ne,,,v installation will be less visib!e to neighbors due to the large lots and setting
which backs LID to unbuildable land, as described by the County assessor. Second the
electronic interference will be eliminated by elevating the antennas to a higher point
above ground. I was receiving interference from sources that I, nor Mr. Chick Colty of
PGE, could identify. Moreover I was causing interference to one neighbors home
electronic equipment.
My attorney, Mr. Robert Herndon of West Linn, 656-1694, has reviewed the C, C & R's
`. and in his opinion this planned tower does not violate any deed restrictions. A copy of
the restrictions are included herein.
My engineer, Mr. John Thomas of West Linn, 697-8123, has onL again developed a
safe structural design with careful attention to wind loading issue., foundations, house

bracket and guying details. Mr. Thomas is a licensed Oregon P.E. and both Mr.
Thomas and Mr. Herndon are Federally licensed amateur radio operators with many
years of experience with similar installations.
The proposed antenna support structure will be attached `.o the house in the back yard.
Accordingly it should fall under Code Section 18.98.01 C which excludes it from height
restrictions and application of Section 18.144.070(A)(3) setbacks which woUld apply to
a free standing st;uctw e.

Planning Division has reviewed this request and found that the structure complies with the
requirements for accessory structures.

The proposed tower is designed to be attached to the residence. As such, it is considered as a part
of the principal structure and must comply with standard side and rear yard setbacks. Section
18.144.070(A)(3) which requires setbacks equal to, or g,-eater than, the height of the accessory
structure is not applicable to this application as this tower is not a freestanding tower.
This request has been approved subject to the following condition:
