Royce for an Administrative Variance to zllow a three foot side yard setback where five feet is normally required on property zoned R-4.5 (Single Family Residential, 4.5 units per acre maximum). Location: 10730 SW 115th Street (WCTM 1S1 34BD Lot 7012.) . DECISION: Noti^e is hereby given that the Planning Director for the City of Tigard has APPR04ED the above application subject to certain conditions. The findings and conclusions on which the Director based his decision are as noted below. A. FINDING OF FACT 1 . Background Information No previous applications have been reviewed by the Planning Division with respect to the subject property. 2. Vicinity Information Properties in all directions are zoned and developed R-4. 5 (Single Family Residential, 4.5 units per acre maximum) . 3 . Site Information and Proposal Description There is presently a 1475 square foot residence on the property. The applicant proposes to construct: a 280 square foot enclosed family room on the southern face of the building where a covered patio now exists. The proposed addition would extend two feet into the side yard. Five foot public utility easements exist on the front, rear, and both side yards of the property. The applicant states that a growing family and a desire to remain in their present home necessitates the addition. lie further states that construction of the family room onto the existing patio would provide direct circulation From the kitchen into the backyard. Corsultation with a contractor revealed that other locations for the addition would be cost prohibitive due to vaulted ceilings and a sloping roof. Finally, the applicant states that using the patio location would not give an "added-on appearance" to the home. The adjacent residence to the south is presently 18 feet 3 inches at the nearest point to the property line. 4. Agency and NPO Comments The Building Division has reviewed the proposal and has the following comments: An encroachment into the 3 foot setback area will require fire protection of the building walls , We recommend a minimum side yard setback of 3 feet 6 inches in order to avoid the above situation. It appears there is 3kmple room on the other side of thi building to expand. No other comments were received. B. ANALYSIS AND CONCLUSION The following criteria are given in S.=ction 18. 134.050 of the Code for granting a variance: 1 . Th- proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity; 2. There are special circumstances that exist which are peculiar to the lot size or shape, topography, or other circumstances over which the applicant has no control, and ••�iich are not applicable to other properties; 3 . The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land; 4. Existing physical and natural systems, such as but rot limited to traffic, drainage, dramatic land forms, or parks will not be adversely affected any more than would occur if the development: were located as specified in the Code; and 5. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The primary purpose of the Qetback standards for, the R-4.5 zone is to allow for adequate spacing, air, light, and privacy for residential structures . The variance will not have an appreciable effect upon the existing residences in the area. Only 14 feet of the southern face of the proposed addition is three feet from the property line and all other portions of the house meet the applicable setback standards . If the family room is constructed as proposed, fire walls would be needed and windows would be prohibited. Elimination of windows from a family room would undoubtedly be undesirable. C.
