VARIANCE V 7-85
APPLICATION: Request by William and Jean Lindsay for a variance to allow a
rear yard setback of Q feet where 15 feet is required on property zoned R-7
(PP) (Resi.dzntial, 7 units/acre), planned development and located at 15505 SW
109th Ave. (Wash. Co. Tax Map 2S1 TODD, Tax Lot 13600) .
DECISION: Notice is herebli given that the Planning Director for the City of
Tigard has APPROVED the above described application subject to certain
conditions. The findings and conclusions on which the Director basea his
decision are as noted below.
A. FINDING OF FACT
1 . Background
The City has not reviewed any previous land use appli:ations for
the subject parcel.
2. Vicinity Information
The adjacent properties are all, developed with single family
residences and are zoned R-7 (PD), except the land to the west
which is zoned R-25 (PD) (Residential , 25 units/acre, planned
development) . The subject property and the surrounding area are
part ` the Summerfield development. App-oval was recently
granted for the development of the land to the west with attached
residential units. The area immediately adjacent to the subject
property is to be utilized as common open space.
3 . Site Information and Proposal Description
The parcel is presently occupied by a sing. @ family residence.
The applicant proposes to replace a covered patio with an enclosed
sun room in the rear yard which will be. attached to the existing
structure. The western side of the addition will be within 9.5
feet of the rear property line instead of the required 15 foot
setback.
4 . Agency and NPO Comments
The Engineering Division and Building Inspection Office have no
objection to the proposal . No other comments have been receiv(.d .
B. Ai.ALYSIS AND CONCLUSION
Section 18 . 134 .050 of the Code requirr.s the following approval criteria
For variance proposals :

1 . The proposed variance will not be materially detrimental to the
purposes of this Code, be in conflict with the policies of the
Comprehensi-ie P].an, to any other app.l-cable policies and
standards, and to other properties in the same zoning district or
vicinity;
2. There are special circumstances that exist which are peculiar to
the lot size or shape, topogr..�phy or other circumstances over
which the applicant has no control, and which are not applicable
to )Lfher properties in the same zoning district;
3 . -he use proposed wi.1.1 be the same as permitt-d ander this Code a-,id
City standards will be maintained to the greatest extent that is
reasonable possihle, while permitting some economic ki3e of the
lard;
4. Existing physical. and natural systoms, sucti as but not limited
traffic, drainage, dramatic land forms or raiks will not be
adversely affected any more than would occur if the development
were located as specified in the Code; and
5. The hardship is not self-imposed and the variance requested is the
minimum variance which would alleviate the hardship.
The primary purpose of the setback standards for the R-7 (PD) zone is to
allow for adequate spacing, air, light, and privacy frr residential
structures. The variance will not have an appreciable efrect upon the
existing properties in the area. B,icause the rear property line abuts a
common open space area, the stru-ture. will not encroach upon an
adjoining residential lot. The variarce proposal is consistent with the
intent of the setback standards contained in the Code.
The location o the house and existing patio has already determined the
locrition of Vie solarium. In order for the addition to have a desirable
configuration, the proposed variance is iecessary .
The residence is a permitted use in tt,c zone ,ind all other arpects of
the building will conform with the Code. The •,ariance will have no
effect upon existing physical. and natural systems.
Finally, the variance request appears to be the minimum necessary to
locate an addition of reasonable size on the property . The applicant
has designed the solarium to fit the lot to the greatist extent possible.
C. DECISION
The Planninq Director approves V 7--85 subject to t'-e following
conditions:
1 . The house shall mainta4n a 9 .5 foot. rear yard setback as shown by
the applicant' s site p'an.
2. The necessary F._ ,its shall be obtained from the City Building
Inspector.

3 . This approval is valid if exercised within one year of the final
decision ate noted below.
