At 8:30 A.M. a representative of City of Tigard, Buildings Departm�nt,
the job foreman of Canterbury Woods Condominiums , and myself made a
final inspection of L'uilding 6.
The following notations ave made regarding this inspection:
1 . In condominiums with loft areas , pocket doors going from
the living room into the kitchen have either been covered
by sHQetrock , covered by wood -frame, or have been removed.
2. In the loft areas attic acc�iss tas be(.n provided, but it
is only 18" x 26". The representative of Canterbury Woods
said that the height was being increased to 36". It would
not be possible to increase the width to 22" because the !

telephone prewire connections are in the way.
3. In basement areas with doors between each basement storage
area, doorways have been provided. Some doorways do not
have doors installed, others have 1 3/4" solid wood core
doors with a wood frame. Neither the wood door nor the
frame are labeled. None of the alarm locks are installed.
The basement areas have been sheetrocked. The foreman
was told to have the sheetrockers increase the number of
nails in the sheeting and most areas have not yet been
taped.

I was asked by the City of Tigard to siqn off the occupancy permit.
On the basis of the fact that not all the items are completed in the
building, it would be my opinion that the occupancy permit should not
be signed until such time as all these items are completed.
A letter addressed to Peter Hoffman, August 17, 1979, from the State
Fire Marshal states in part that (the door and frame will be ?0-minute
rated with self-closing latch , but not lockable. These doors will be
marked for "Emergency Use Only" and be equipped with a security alarm
system. In addition, the entrance doors to each of the storace areas
will be lockable from the outside only to allow egress from within
in case of fire). This would be in reference to notation #3,
It should be additionally noted that in Building 6 there is presently
one condominium occupied by one lady; whose furniture, clothing, bedding,
kitchen accessories , etc. were all moved in. It was obvious that the
unit was being used as a residence.

Subject: Occupancy Permits - Canterbury Woo0e.
Dear. Mr. Hoffman:
This is in response to your letter of August 31, 1979 requesting occupancy
permits for the units in buildings No. 8 and No. 9 of the Canterbu Woods
Condominiums.
As I have stated before, as City Administrator 1 will not allow the issuance
of Certificates of Occupancy nor allow the occupancy of any unit in any of
the buildings in the Canterbury Woods Planned Development until such rime as
the buildings and related development of the property conform to and comply
with all the applicable City ordinances and requirements, or until such time
as a court order is issued forcing me to issue Certificates of Occupancy.
All of the units in buildings No. 8 and No. 9 have been inspected by the
City Iiuildi.ng Official and, as you know, have passed final inspection, except
for the fireplace vents and the attic access panels (these deficiencies may
have been corrected since the last inspection) .
There are, however., items other than the buildings themselves that must be
completed and approved before occupancy permits will. be issued. They are as
follows:
1. Planting of two (2) more 20-foot fir trees in the large "gap" near
the eastern property line. While you have planted eleven large,
beautiful fir trees along t'ie east aide of your development, you
have not met, in my opi.niot, and in the opinion of the City Council
members and the Planning Commissioners, the! intent of the Planning
Con,misnion to achieve "tnlXiiw.!m screening,."
2. Installation of a 5-foot high fence alot.g the entire length of the
eastern property line, erected in such a manner as to pry-serve the
large trees.

Council. However, inasmuch as you are so close to obtaining occupancy permits,
I strongly suggest you quickly co-npletc, the items liSc-c above and, upon their I

Your proposal in paragraph two, to substitute two layers of 5/8" Type X
Gypsum Board on the interior sides of the exterior basement walls with
solid block at the joist space meets with our approval.
It should be noted that Pat Franzen also discussed this substitution with
Tualatin Fire District-, Acting Fire Marshal Jack Palmer, and Tigard Build-

CANTERBURY WOODS CONDOMINIUMS
FIRE & LIFE SAFETY CODE PROBLEMS RESOLVED .
The intent of the Fire & Life SafEty Code will be met when the
buildings are ready for occupancy, says State Fire Marshal Clyde
Centers.
Agreements between thA State Fire N.arshal, City of Tigard, Tualatin
R.F.P.D. . and Hoffman & Hoffman, Inc. of the Canterbury Woods Condo-
miniums -,-,ill lead to an orderly completion of a code complying res-
idential occupancy.

It is the opinion of the State Fire Marshal that the State of Oregon Structural
Specialty Code and Fire & Life Safety Code does not specifically address the
question as to whether the loft areas as conE trusted in the Canterbury Woods
Condominiums are a third story or a mezzanine as addressed in Sections 414
and 3?02(a).
A. Since the loft areas are in various degrees of completion, and it would be
an unfair hardship on the owner to await r, code change to clarify this subject,
the State Fire Marshal has elected to utilize Scc+ion 106 of the State of Oregon
Structural SpE-cialty Code and Fire & Life Safety Cade to address the subject
and assure the occupants that the intent of the fire and life safety sections of
the code have been met. The loft areas were computed and found to be in the
33 1/3% range based on the common atmosphere of the living-dining room-
kitchen, and adjacent halls which are all open to the loft. This open area will
provide the occupant(s) of the loft area the opportunity for seeing, smelling, or
hearing any potential hazard such as fire, which rr. y occur within the areas
of the common atmosphere.
To further protect the occupants of the entire condominium, the following
methods of c�lnGcruetion shall be required:
1 . One-hour fire resistive tenant separation (walls and floor ceiling assemblies) .
2 . Approved single station detectors shall be lo.:ated in the ceiling of the loft
space in a location to be approved by the local fire marshal.
i . The pocket doors between the kitchen, living-dining area shall be permanently
blocked open.

4. The existing two-.hour fire walls will be completed in such a manner as to
continue down through the basement with penetrations protected as approved
by the State Fire Marshal.
B. Basement areas as outlined in the plans dated October 2, 1978 and amended
on July 19, 1979 are acceptable with the following provisions:
1. Each storage area shall have an exit door. In addition, a door shall be
located at the rear c,f each storage unit with a minimum width of 36" .
This door and frame will be 20-minute rated with self-closing latch, but
not lockable. These doors wil' be marked for "Emergency Use Only' and
be equipped with a security alarm system. In addition, the entrance doors
j to each of the storage areas will be lockable from the outside only to allow
egress from within in case of a f�lrc. Permanently designated aisles, 36"
wide, shall be provided on each side of the separation wall as to assure a
secondary exit.
2. All ex*jrior walls and separation walls, with the exception of the two-hour
fire walls, shall be of one-hour fire resistive construction.
3. Mr. Peter Hoffman shall provide the State Fire Marshal with a copy of the
By-Laws which will address the use of the bar,ement storage: areas,
maintenance of the fire exit, security alarm and the fire exit aisle.
It should be noted that the items dealing with the loft area apply to all buildings
containing lofts , and the requirements for the basement areas pertain to buildings
#6 and #7.
It should be further noted that these alternate methods of construction and
materials were discussed with Tigard Building Official Ed Walden, Acting Fire
Marshal Jack Palmer, Tualatin RFPD, and Fire Inspector Jim Kenworthy, Tualatin
RFPD, and they shall provide the State Fire Marshal with a letter of con,,urrence.

Substantial changes will be necessary before they will approve
the present installation. Please refer to a letter from Mr.

At this time we have not received clarifica':ion of the status of
additional space under the roof centerline nor have we received
clarification of i^sues in the basement areas.

Chimney chases
Dear Aldie:
Peter Hoffman has asked me to reivew the chimney chases at the
Canter!Dury Snoods Condominiums. As you may know all metal pro-
jections above the roof have been painted but are left exposed.
Our drawings show one-hal.f of the chase encloqed and one-half
exposed.
I have looked over the finished product and feel that the exposed
chimneys are not unsightly and. in fact are less not?.cable than
if they were exposed as we had them originally shown. The fact
that the site is very wooded is of course the major factor for
the chases are lost within the trees. The chimney chases would
tend to accentuate roof penetrations rather than play them down.
I am t.heref.ore asking that this be reviewed by either the design
review board at their next meeting or the Tigard Planning
ConLmission on the August. 9th meeting.

You have asked me for a letter stating my opinion on the condition of the
trees relative to the site and its new buildings.
v I beleive a tremendous job has been accomplished in saving as many trees
as there are. There were some mistakes mostly with those machines which
must do the digging. T have been with the project as a consultant from
the beginning, except when the trees were being removed for road and
building sites. The amount of expence in trimming and fertilizing which
y_ has already been completed has been very high. The results of this,
`r l' however is showing, for we had very little damage from the ice storm.
The health of those trees remaining at this writing is very good. Some
back fill and root pruning needs to be completed before april . If you
follow through with the fertilizing at that time as I have lined out plus
1 a good watering program and periodic inspection by an arborist. I can
see no reason that this project could not serve as a model to those con-
tractors developing building sites on tree laden lots.

+1 Gentlemen :
There has been some question as of late regarding the legality
J of an additional amount of upper floor area proposed for the
Canterbury Woods housing development . Particular emphasis has
been placed on the approval of the original P - D. and hour this
relates to what is currently being constructed .
I would like to point out that the initial approval was , in
fact , granted on a three-story concept ( see site plan enclosed
plus ,,mitten submittal material ) . These units , to be sure ,
were one , two and three-story units combined into one building .
The currlen-E—proposa-l" is !or a two story development . The neer
loft space addition was an afterthought proposed because of the
amount of open (unusable space) evident once the trusses r•rere
set in place . Nate that the addition takes advantage of the
existing building configuration-- it does not add to it . The
change is an interior , not exterior alteration . Since the space
is open to the 1iv-ing area it act,, as a loft or 7.ezzanine level .
On page 45 of the Uniform Building Code the definition of mezza-•
nine is listed as "an intermediate floor placed in any story or
room" . If that area is less than 33 1 /3% of the total of the
room it. occupies it will not be considered a floor.
The proposal for, Canterbury Woods is for a loft. addition of
212 square feet and therefore could be considered a floor• _y_
definition . This addition is allowed unTer fable 5- Q,page 61
of tfi^Gniforrl luilding Code which states that if the building
is of UQ�hour construction , a three-story building is prr•ahis-
sible . Additional structural_ engineering with reyar•d to thr•ee-
story structures (.e .-, equivalent 3x4 studs at 16" o . c . on
i 1 or:-er floor) will also be carried through by the Owner.

Since the original approval for three-story units was approved
at the time the P . D. was granted , I assume this will not be an
issue . There is no requirement which states that the height
must be consistant with that of the underlying district in a
P . D . This reference to underlying zones applies to lot coverage
and lost size . The __district makes no mention, of building
heLgbt, and in fact in 10. :,6 . 050 the Code is very specific,
"In cases of conflict be,.r•reen standards of the underlying dis-
trict and the Planned Development district , the standards of
the Planned Development district shall apply . " (Ord. 71 -4
Exh . "A" 1971 ; Ord . 70-32 S 185 . 3 . 1 1970. ) In our instance the
three-story-concept was clearl_y_s.ho�an , discussed and was approved
as part of the P. D.
This project is in keeping with the purpose of a Planned Develop-
ment which states as it ' s purpose " . . . to provide opportunities
to create more desirable environments through the application
of flexible and diversified land development standards under a
comprehensive plan and program professionally prepared . The
planned development: district is intended to be used to encourage
the application of techniques . . .which will result in s-aperior
livin_q�or development arrangements , with lasting values.'' Better
utilization o proposed structures such as loft spaces would
follow that intent.
We propose therefore to follow the previous rrrovals through
zoning with regard to three-story structures . In addi �ion we
will make those buiId_ing_s conform"-to fie qne-tiQur requirements
and of the Uniforml6ulding Code .—

one-hour, two-hour fire resistance. Access ways to such shafts require self-
closing and latching Class B fire door assemblies one-hoer rated, one and
one-half hour rated. Sec. 1706

either in separate water tank port or in port for hot water line. Shutoff valves may not
be located between a water tank and relief ve've.
29. A firefighting water supply is required within 500 feet of building that is capable of
producing 500 gpm (minimum) for 10 minutes for each 5,000 square feet of floor area within
building up to a maximum of 500 qpm for 30 minutes, or provide a 5,000 to 15,000 gallon
reserve water supply as required.
30. Interior wet standpipes at least 2 inches in diameter located and equipped as per Sec. 3804
are required. Couplings and connections required to be American National Standard Thread.

Proposed Use:
The applicant is proposing to build 76 multi-family units in
accordance with the approved planned development .
Site Description:
The site is 7. 16 acres in size and slopes to the south with an
approximately 40' grade change from the north property line to
the south. Three quarters of the site is in climax growth fi.r.
trees.

Site Plan and Architectural Review:
The applicant is proposing to ce .ist.ruct 9, two-story buildings around
a circular loop road . Each building incorporates a landscaped
court yard, garages and covered decks . The siding is specified
as either stained cedar or light brawn aluminum. Since the main
theme of the Planned Development was to blend the units into
the natural. setting, cedar siding would be preferred.
The major concern with the site, is that as many trees as pcssible
be saved. Because of the dense growth, a tree survey is infeasible
at this stage, however, after the grading of the loop road a
tree survey should bu done in order to determine the exact
location of parking spaces and buildings. Those trees which
will be adjacent to con;.tr;.,ction ar,tivity should be examined
by a certified tree surgeon for th,� necessary branch and root
pruning, and treatment for changes in grade.

Therefore a revised landscape pian and irrigation g plan :for the
portion north of the tree line . fulfilling this portion of the
Planned Development program should be received prior t,
issuance of a building permit, . Details for dumpster screens,
mailboxes , and picnic areae should also be included in this
submission . A landscape pian for the area south of the tree
line should be receivec before issuance of occupancy permits. The
reasoning behind this deviation from normal procedure is that a
better plan can be designed after the buildings are in place since
tt will coincide with vegetation loss due to construction activity .
The site plan also specifies a large number of trees to be removed

According to the adopted Planned Development program "Areas within
the tree line will be left as much as possible in their natural
state . . . preserve the major grouping of tall fir trees" .
Therefore the trees should be retained in this area and the
cleared portion of the site used for activities that require lawn.
According to the Tigard Police Department the proposed project
is in one of higher crime areas of the City . Since the Planned
Development incorporates a trail system through heavily wooded
' areas it was their concern that some type of lighting be provided at
poin+ 3 along the trail and near the picnic areas. Therefore the
play s►:ould be reviser] to include decorative vandal-resistant
lights in the appropriate locations .
Code requirements for parking have been fulfilled , however it is
staff 's experience that overflow parking for guests should be
provided when possible. It is appropriate for this development in
particular since double p4rking in the loop road could cause a
great deal of congestion . Therefore additional parking should be
added where possible along the northern property line.
No drainage or grading; plan has been submitted. 'These should be
submitted for Planning and Building Departments approvpl and
should he oriented so Zs to have a mi.nimutn impact on the site.

area, how would you look at additional compensatory factors such as
exterior ladder, open area detection systems, or partial automatic sprinklers
as a trade off?
