It is the intent of this department to assist ,you in accomplishing your goal wherever possible. In our meeting of March 24, 1989 at the site, you asked what is the minimum needed to be completed in order to obtain an occupancy permit, and also what could be omitted or provided temporarily in order to obtain a temporary occupancy permit. The City and Fire Department would prefer to have the entire building completed, however, the minimum required for a complete occupancy permit includes at least the following: 1. All Fire and Life Safety items must be installed, and operational (th? most obvious would include smoke detectors, fire alarms, handrails, guard- rails, stairways, exit doors, fireplace hearths) . 2. Cooking and sanitation facilities must be installed and operational (this would include a toilet, bathroom sink, tub or shower, kitchen sins, range, non-absorbent surface floor cover in bathroom, weather stripping for exterior doo_ q, ceiling insulation 3. Completion of site grading, landscaping, paving, gutters and downspouts. In the case where some items cannot be completed before your deadline, I can accept some temporary measures to facilitate a temporary occupancy approval. As Follows: 1. Should you fail to complete the hearths on the fireplaces, the placing of a minimum 26 gauge sheetmetal pad equal to the required hearth dim. erasions and anchored to the floor will be acceptable. The use of the same type sheetmetal for covering large gape around the fireplace box, where tile trim would normally be placed will also be acceptable. The bathrooms are required to have an impervious floor covering, should you not be able to install the vinyl flooring, I will accept a h"avy coat of latex primer/dealer to be applied to the subfloor, as a temporary cover. 3. '!ou indicated some of the range hoods may not be installed. There is no section in the code that requires them to be provided, so this need not be an issue. Should you decide not to install them at a later date, the bottom end of the duct must be capped off. 4. The lack of weather stripping on exterior doors will be acceptable, with the condition that it be completed prior to occupancy of the unit. 5. Dishwashers and garbage disposals are not required for occupancy, however, an inspection will be required upon their installation. F. You have indicated a shortage of ranges for some units. I will allow issuance of a temporary occupancy permit for the building with the cond•- tion that the ranges be provided prior_ to occupancy of the unit. In all cases the fire alar►ns, smoke detectors, handrails, and guardrails must be completed and operational. This conclusion was drawn after numerous conversations with respected parties of Building Code Enforcement Agencies and Wood Products Manufacturing Associations, as well as members of this office. If the City of Tigard is willing to accept responsibiliry for this substitution, the Fire District will not stand in its way to make such substitutions, however, the Fire District stands on the record of not approving the proposed materials and is not willing to accept responsibility for current, or future problems that may occur. It is understood that Jim Jaqua has made physical inspections of the majority or a reasonable number of fireplace chimney shafts/recessed fire place enclosures to ensure that adequate fire resistive protection has been provided to building fran ..g elements in these areas. These inspections were conducted without a representative of the Fire District. The Fire District in this case is willing to accept Mr. Jaqua's inspections and findings, but is on record that it didn' t make joint Inspections. This office received Fire Alarm System Plans from the City of Tigard on November 23 , 1988, which were stamped "Date Received on August 19, 1988" (initialed J.G. ) It is assumed by thii: !`.an., Examiner that. this is City of Tigard received stamp. Plans were received within 5 days of receipt by this office and found not acceptable by the requirements specified in Uniform Building Code Section 12,92(b) . It is the Fire District's understanding that a number of the buildings have been wired with non supervised alarm systems. This is unacceptable to this department as it is toc easy to disarm such a system rendering it inactive in the threat: of. an emergency when needed. A, FINDING OF FACT 1 . Background Tax lot 100 and adjacent tax lots 200, 300, 400 and 500 were annexed to the City of Tigard in July, 1907. The zoning designation was changed at that time from Washington County' s R-24 zone to the City of Tigard's R-25 zone for all parcels except tax lot 500. Vicinity Information The property is bordered on the south and west by mostly open lands also zoned R-25. Some single family residences exist on these parcels. The area north of the subject property and across Durham Road is zoned R- 7 (PD) (Residential, 7 units/acre, Plannod Development) and is occupied by the Summerfield planned community . The area in Summerfield Closest to the subject property contains single family residences and the Summerfield Brookside Condominiums . 1he area east of the subject site is zoned R-12 (PD) (Residential, 12 units/acre, Planned Development) and contains the newly developing Swanson' s Glen subdivision. 3 . Site Information and Proposal Description Tax lot 100 is an undeveloped open field. the parcel slopes to the southeast. The parcel has 68? feet of frontage on Durham Road and 379 feet of frontage on SW 108th Avenue. The applicants propose to develop a 128 unit, 17 building apartment complex on the site. The development would include 16, three-story residential buildings containing 8 dwelling units per building. Also proposed is a single story office and recreation building and an outdoor swimming pool and spa. Half street improvements ar•e proposed on SW 108th. Irite rnaI circulation would be through a network of 24 foot wide driveways. 192 parking spaces are proposed----66 in garages, 64 in carports, and 62 uncovered parking spaces. Handicapped parking spaces have riot been designated. Ir, addition, Lhe site plan dues not illustrate parking lot, lighting. The proposed site plan calls for approximately 48 percent of the site to be landscaped. the landscaping plan calls for the development to be bordered by 43 Norway Maple trees planted on 40 foot centers. The interior of the site is to bo landscaped with a variety of deciduous and evergreen trees, lower hushes, and lawn. A contoured, three foot high mound containing eight white birch trees is proposed to be located between t:he swimming pool area and Durham Road. The landscaping plan indicates that a site obscuring fence is planned for the site' s perimeter. The fence' s proposed height has riot been provided. A six foot high fence is planned to surround the pool area. The development- is proposed to be connected to the sanitary sewer system through installation of an 8 inch public sewer line to «n existing manhole located approximately 200 feet- northwest of the site in Durham Road. Water service to the site is provided by a 12 inch line along Durham Road and an 8 inch line along SW 108th Avenue. Water service developmenton the site would include iris tallation of 5 fire hydrants. Stormwater drainage would be provided through a subsurface drainage network draining to the .outhwest corner of the site, and from there, through a 15 inch sturm sewer to an existing drainage way approximately 150 feet west of the site. 4. Agency and NPO Comments -rhe Engineering Division reviewed the proposal and offered the following comments : 1 . Durham Road is designated as a major collector street. Majf+r• collector streets typically have a minimum 60 foot right-of-way and 44 foot pavement width. Since Durham Road links Hall Blvd. and Pacific Highway, greater widths are necessary due to the higher traffic levels expected in the future. A 90 foot right- of-way has typically been required for Durham Road for previous development:. Currently Durham Road is a 2 lane, paved street with no curbs, sidewalks or streeL-light-s. The right-of-way is 20 feet wide from the centerline fronting this site and 45 feet wide on the opposite side. Currently, half-street improvements exist fr•um Pacific Highway to 113th to the west, and from Hall Blvd. to 92nd Avenue to the east. Half- street: improvements along the Durham Road frontage would widen the existing pavement approximately 10 feet. This additional width and frontage length would not be sufficient to allow an additional lane. The future vertical profile will need to include a slight realignment or flattening to meet sight NOTICE OF DECISION - SDR 88--06 - DURHAM ROAD INVESTMENTS - PAGE 2 distance design standards for a major collector street. -therefore half--street improvements would riot be practical on Durham Road at this time. 2. S.W. 108th Avenue is designated as a minor collector street. 'The developer of the Dover Landing subdivision, south of Lhe subject site, recently made interim improvements to 108th Avenue consisting of widening the existing pavement to approximately 1.0 feet wide and overlaying the existing pavement from Durham Road to the subdivision. No curbs, sidewalks or, str•eet-lighLs were installed. The right--of—way is 40 feet: wide, 20 feet from the centerlin" on both sides. The vertical profile is adequaLe for the designated classification' s design standards . The submitted plan for the Durham Rued Investments' proposal shows half-street improvements on 108th Avenue including curb and curb return at Durham Road, sidewalk along the project frontage and pavement widening to 16 feet from the centerline. The standard for minor collector streets is 20 feet from centerline to the curbs . 3. The proposed apartment complex will access 108th Avenue approximately 265 feet from the centerline of Durham Road to the cent:erlinp of the proposed 24 foot wide driveway , The Community Development ::ode requires 2 accesses, 24 feet wide each, fur a 128 unit apartment: complex . Access is riot permitted to Durham Road due to the spacing requirement of intersections and a second access off 108th Avenue would have to be located closer to Durham Road. This clo%er access could cause congestion problems at the 108th/Durham Road intersection and therefore is not recommended for this site. 4. Storm drainage is proposed to be collected on site from the roof and paved areas by a main pipeline along the site perimeter and is discharged into an existing 36--inch diameter pine which crosses under Durham Road. Offsite storm drainage on 108th Avenue is collected by a catch basin at the southern end of the sitE frontage and discharged into the west border pipeline. 'The west border pipeline is proposed as a publicc line on private property within a 10 foot wide easement. No change is proposed to the storm drainage along Durham Road. A 15 foot wide easement is typically requiced for public storm drain easements . 5. The propo.�pd landscaping plan shows a fence and several trees to be planted along the west property line. The fence and trees will create an impact on the accessibility of the storm drain pipeline. Therefore, the pipeline should be located a minimum of 15 feet from the trees and fence. No othp� comments were received, B. ANALY'3IS AND CONCLUSION This development plan generally satisfies Community Development Code requirements related to density (128 units allowed; 128 units proposed), parking (192 parking spaces required; 192 spaces provided. 128 covered spaces required; 130 covered spaces provided), building setbacks, vision clearance area for the access drive, private and shared outdoor recreation areas, and landscaping (48 percent of the site landscaped; minimum landscaping required is 20 percent) . The proposed use, multiple family dwellings, is a permitted use in the R-25 zone. Certain aspects of the proposed site development plan require further discussion below. a. Parking The proposed site plan does not designate appropriately sized, located, and sigood handicapped parking spaces. The Community Development Code requires a minimum of one handicapped parking space for every 50 required parking spaces; therefore, 4 handicapped parking spaces should be provided. No plan for site and parking lot lighting has been provided. Various Code sections require appropriate locations and amounts of .,ite lighting (Section 18. 106.020(q) and 040(m) - - parking lot lighting; Section 18. 120. 1870(a)(5) -• Privacy; and (a)(9) — — Crime Prevention and Safety) . A revised site plan shall address th.ase requirements as well as the need for handicapped parking spaces . b Access and Egress The site plan proposes one 24 foot wide access on SW 108th Avenue approximately 265 feet south of Durham Road. Section 18. 108.070 of the Code requires 7. accesses for a multiple dwelling unit development serving 100 to 200 residential units. In the present situation, access is not permitted to Durham Road due to i.he spacing requirements of intersections . Any additional accesses would therefore be required to be located on SW 108th Avenue. Any addit:ionoi access on SW 108th Avenue would tend to increase congestion rather than reduce congestion. The landscaping plan' s proposal for- the maple tree ; to be planted on 40 foot centers places the trees in line with the apartment unit windows in or-der- to sl:reen views from these units to adjacent properties . The landscape designer should endeavor to maintain this effect whe.► revising the plan to place the trees on the eastern boundary on 30 foot centers. The revised landscaping plan must also remove the Colorado Blue Spruce planned to be located at the northwest corner of the site within the required vision clearance area. Trees or bushes within tine required vision clearance area may be less than three feet tall or else must riot have branches below eight feet. Additionally, the fence within the r,equir•ed vision clearance area must be no taller than three feet, The Planning Division has found that the proposed site development and landscaping plans, as modified by the conditions of approval, satisfy or exceed all applicable Community Development Code requirements related to buffering, screening, privacy, and vision clearance area. Although the objectives of these Code requirements may not be fully realized until the vegetation reaches maturity, the proposed plans provide adequate consideration for these objectives arid the materials to obtain them, The owners of the parcels immediately east of the site have asserted in a letter to the Plannirig Division that the proposed site development and landscaping plans do riot provide adequate screening of views between the pr•oper•ties . The neighbor has r.questod that the City r•equir•e that. second arid third floor- windows in the ape.zir•tmenLs either be nonopening and frosted or else that the windows be located high enough on the internal wall to prevent views from the apartments to the adjacent yards . Further, the neighbors assert that the fence and Norway Maple trees would provide inadequate privacy between the proper•tiHs. Section 1.8. 100.090(a) provides that the Director may allow a ferice to exceed standard fence height r•equirement:s in order to mitigate against potential adverse effects. In the present situation, the standard allowable fence height: would he threes feet along SW 108th Avenue--the front of the development, six feet high along Durham Road, and eight feet high along the other sides. The Director finds it reasonable to allow the fence surrounding the proposed apartment complex to be as high as eight feet in all areas except the northwestern corner of the site in order to mitigate against the possible adverse effects of street noise on the development and the potential effects of the proposed development's density upon neighboring properties. The fence in the northwestern corner of the site cart be no taller than 3 fret tall for a distance of 30 feet from the corner in order, to maintain a clear vision area at the intersection. A fence between six and eight feet high is subject to building permit &pproval . Fence height scall be noted on the revised landscaping plan. The fence along the eastern boundary of the site should be at least six feet tal', to provide adequate privacy between the site and .adjacent properties . e.
