I have received a cop;, of the final inspection exception list that was left -Ith the
Athenours. I would like to comment on that list, and at the same time r.lake my
recommendations to the Athenours:
I These two bedrooms were created within a totally enclosed, 14' high structure. The }1, y\AA1
"bus barn" as your counter staff reterred to it as. The ceiling joists do nothing more than
hold up the sheetrock and light fixtures for the lowered 8'ceilin.,! that we put in. There is } s
no live load considerations. They are closed off and there is no opportunity for storage
loads. In our opinion 2x6 framing is adequate for this situation.
2. As v.e said the rooms are within an enclosed building. The 51/2" of insulation should
be more than adequate. However we wi!1 increase the depth of the insulation at an
additional cost to our contract. The Athenours must approve this extra work. � c;",\1��5

4. The window height in these two rooms is the same height as all other windcws in the
house. 'These walls were also previously inspected and approved for sheetrock cover.

5. The previous Inspections allowed for us to sheetrock the outside walls. This was
corFrmed in Mr. Hendryx's letter dated January 10, 1996. Rick agreed that if we had
electrical cover approval, which we did on 9/21/95, that we could go ahead and sheetrock
the outside walls. The request to cut holes in the finish vork now is not warranted. As
we explained before, all of this fl aming and insulation was inspected on 3 separate
occasions.
6. The photo-- of the sheetrock nailing were sent in to the Cit of Tigard with our letter
back in December of 1995.

In summary 1 would say that it was always my understanding that the main reason for Lp �h
pE-mitting and inspecting work was to protect the homeowner. This issue has now R t
escalated to a point of some personal agenda that is not in any ;way protecting the
homeowner. I would strongly caution the Athenours against spending additional money
and destroying;t'. - i5�nished interior oftheir home. I recommend that they request copies
of the specific , --e sections That reference the items listed.
We do not wan' to appear uncooperative in settling this issue. That much is evidenced by
our numeroij-, meetings, conversations, phone calls and trips down to city hall just to get
this permittel. We do however feel that this issue should be resolved fairly, with the
Athenour's best interest in mind.

inspection to resolve any outstanding issues at this job.
This notice is sent pursuant to Tigard Municipal Code (TM(') Section 1.16.
Alleged Infraction:

Dear Mr. Carstairs:
This letter is to address your concems regarding our )ermit process and the
inspector who performed inspections at 11163 SW 106th Avenue. I would like to
address your concerns in order:
• The Oregon One and Two Family Dwelling Code does exempt interior
partitions from permit requirements when the partitions do not create
habitable rooms. Your approved flans indicate that additional habitable
rooms were created uy this work, therefore a permit is required. You also
indicate that the work is not structural. While the new partitions are not
bearing ("non-structural"), you framed new ceilings, wi ;ch is "structural". Our
inspector did arrive on . ite based upon a call that work requiring a permit was
;:proceeding without a permit. You indicate that our inspector ". . . agreed the
work was 'borderline; if it did or did not require a permit." The inspector, Rick
Bolen, has indicated that he made that type of statement based upon viewing
only a portion of the total work underway. You further indicate that Rick said
". . . they will issue it over the counter with a simple sketch." Rick indicates
that he aid not say this.
• You indicate that our counter staff refused to issue a permit without three (3)
sets of to-scale drawings, showing setbacks, property lines, etc. This is our
normal process. However, review of the approved -'-ns indicates we did
approve a simple sketch which does not show set' cks or property lines.
Because of our limited staffing, we do not provide plat. gview at the counter.
• You indicate that Rick czme by the property for a second time and said he
would talk to "Bob" (our residential plans examiner) and gave a verbal
approval to install sheet rock. Further, you indicate that several days later
Rick made a third visit to the site and indicated what you needed to sketch for
Bob, declined to observe sheet rock work in progress, and issued you a Stop
Work Order ("Red Tag"). Our records indicate this was done on 9/22/95.
LL Rick does recall giving a verbal approval to sheet rock fcr a very limited
portion of the work, but that tie left the stop work order because work had
continued in spite of his requests that you limit what you were doing and
obtain a permit.

• You indicate that you were told that Bob was on vacation and was the only
person on staff who could do the plan revic v. There were other persons on
staff who were prepared to do "back-up" pian reviews as necessary in Bob's
absence, however, the Building Division failed to properly communicate this
to the counter staff. We apologize for any frustration this miscommunication
caused you. We will strve to better communicate staff coverage in the future
to avoid a similar occurrence. As it tums out, you submitted your plan on
5/22/95 (the day Rick issued the Stop Work Order) and Bob approved them
the same day (he got to them before he left). Counter staff then did their
processing and called you on 9/28/95 to indicate that the permit was ready.
Your letter confirms this call. It further states that "[o]bviously the work was
now comoletec+." Clearly you continued and completed the work in violation
of a Stir Work Order. In fact, you did not pick up the permit until 10/18/95.
• On 10/19/95, Rick came to do a final inspection which you had requested on
our inspection regUest line. When he arrived he observed that the work was
now complete. You indicat,3 that he was rude, demeaning, and threatened a
lawsuit before storming out in a huff. This type of attitude by any of our staff
is not acceptable, and we regret any perception of such. Rick denies that he
was rude and demeaning, but does recall expr3ssing his frustration at your
refusal to obtain permits prior to continuing/completing the work and a
' comment regarding "court" being our next enforcement alternative. Rick has
been reminaed that his attitude is to remain purely professional in spite of his
frustrations. I agree that the attitude which you allege spreads a very
negative and damaging message to our customers. I appreciate your
comments regarding this and I assure you that we take them ver,; seriously.
• You have requested that we send you an approved final building inspection. I
regret that we are unable to do so without further inspection of the work to
verify compliance with the applicable codes. I can give you the benefit of the
doubt that you perceived the work to not require a permit, and therefore did
not obtain one prior to commencing the work. I can further understand that
r perhaps there was a miF.understanding between you and Rick regarding what
work you could do prior to getting the permit. However, you clearly, and by
no your own admission, continued to work in violation of a Stop Work Order
issued on 9!22/95, and did not obtain your permit until three weeks after you
were informed it Was ready. Because of the possibility of a
-nisunderstanding, we are willing to perform a limited inspection of the
framing and insulation work and accept photographs of the sheet rock nailing,
as opposed to requiring you to expose all work for inspection.

To complete the process, please call Rick Bolen at 639-4171 x319 and arrange
for a site visit. Rick will indicate what ceiling and wall openings are necessary to
observe the framing and insulation and will rev:IcMw the photos.

This letter is both to voice a concern and a complaint regarding the permit process and the
particular inspector that was involved.
A couple of months ago I con►racted with the Athenours to Cxtend 2 bedrooms into the
existing storage area, and remove a closet and hal: wall to enlarge another room. None of
the work was structural nor did it alter the exterior footprint of the building. The
Athenours contracted directly with an electrician and that work was permitted and

I went to the building department the following day. They refused to issue a permit with
out 3 sets of drawings, drawn to scale. The drawings had to show the set backs, property
lines etc. The following day the inspector came by the house for a second time. By now
the electrical cover inspection had been approved. I explained to him the problem at the

We made the drawings and submitted them. As 1 understand it "Bob" went on vacation 9Id
and he is the onlyone in the entire City of Tigard building department that can do a plan

review check. About a week later i was left a phone message that the the permit was
ready to pick up. Obviously the work was now completed.

We called for a final building and electrical inspection. Again, the electrical final was
issued without a problem. In fact after the first electrical inspector left, another showed
up a couple of hours later to do the same inspection. (a I►
The building inspector however showed up at the house for the fourth time with both guns
loaded. He refused to acknowledge the fact that he had looked at the work before and
given his verbal OK to install the sheet rock. Because he refused to come into the house
and look at the sheet rock work on his third visit, I had taken pictures of the sheet rock
walls and nails just in case. The inspector refused to accept the pictures. fie was rude and
demeaning. Ile went on a verbal rampage saying how he and the city were sick and tired
of this house and all that had gone on. He threatened both me and the home owners with
a law suit and stormed out in a hufTVx, �jQ�p�J a+,'

That is our complaint. Our concern is that this type of attitude spreads a very negative
and damaging message to the contractors and homeowners in the City of'Tigard. It also
continues to justify those buil-ers and home owners whose attitude it is to build with out a
perm;t if there is any way.
My contract work with the Athenours is complete. They are satisfied with the
workmanship and final product. They have also asked me to voice their disappointment
and concern over this inspection process.
I am enclosing the pictures of the nailed sheet rock walls. All of the walls are interior
walls and don't require insulation. I suggest you just mail a copy of the final building
approval and close this issue without firrther aggravation.
