A FINAL ORDER INCLUDING FACTS, FINDINGS, AND CONCLUSIONS WHICH APPROVES A HOME
OCCUPATION PERMIT (HOP 90-0006) REQUESTED BY J. KNIGHT AND C. WEIS.
The Planning Commission reviewed this application at a public hearing on May
22, 1990. The Commission's decision is based upon the facts, findinqs, and
conclusions noted below:
A. FACTS
1. General Information
CASE: Home Occupation Permit (HOP 90-0006)
REQUEST: To allow storage of small boxes of electronic accessories
and UPS shipments to accounts with deliveries not to Lxceed
three per week.
COMPREHENSIVE PLAN DESIGNATION: Medium Density Residential
ZONING DESIGNATION: R-7 (Residential, 7 un'ts/acre)

2. Background ?nformation
Following enforcement action by the City for operating a home
occupation without a permit or payment of a business tax, the
applicant applied for and was granted a Home Occupation Permit (HOP
89-14) to operate a "wholesale electronics acr_essoLieP bus;^ess" on
the property. This approval, which was subject to conditions, was
issued on June 23, 1989 and became effective on July 3, 1989.
Condition 12. of the attached permit stated "[d)eliveries shall be
limited to vehicles which have no more than two axles and which weigh
no more than 19,000 (gross) pounds". The approval went on to
emphasize that any violation of the conditions would lead to .immediate
invalidation of the permit and to enforcement action.
on July 21, 1989, and oversized delivery truck was observed on the
property and the Home occupation Permit was revoked by the Community
Development Department staff on July 25, 1989. Code enforcement
action followed since the applicant did not Close the business
operation. In April, 1990, the applicant agreed to cease business
operation and to apply foc a new Home Occupation Permit.

Because of the past history of the case and the concerns expressed by
residents in the area, the Planning Director determined that this
application should be reviewed by the Planning Commission through the
public hearing prones rather than by administrative review. This
action is permitted by Section 18.32.090 C. 4. of the Community
Development Code.
3. Vicinity Information
The subject property is located on the northwest corner of S.W. North
Dakota Street and 106th Avenue. Single family residences are located
to the north along 106th Avenue and to the west. Multi-family
development is situated further to the east on Ncrth Dakota Street.
Properties to the north and west are zoned R- 4.5 (Residential, 4.5
units/acre and the area to the east is zoned R-12. ( Residential, 12
units/acre) . Single family residences on larger lots are found on the
south side of North D:kota Street with a mixture of R-2 and R-3.5
(Residential, 2 or 3.5 tin.ite/acre) zones.
4. Site Information and Proposal Description
The subject propertl is zoned R-7 and is developed with a 4,768 square
foot, single family residence that includes a large attached garages,
gravel driveway, and unfinished landscaping. The floor plan provided
by the applicant indicates that the southern, western, and
northwestern portions of the house are existing storage areas. The
building permit plane show that. this "L" shaped storage room area
totals 3,014 square feet. A vicinity map and a floor plan provided by
the applicant are attached as Exhibit "A".
The applicant proposes to use a 160 square foot office and three
shelving areas, located within the storage room, totaling 250 square
feet. A maximum of three deliveries, using UPS type vane or smaller,
is proposed per week. The intended hours of operation are between 9
a.m. and 5 p.m. .
5. Agency and NPO Comments
The Building Division indicates that a paved driveway with a minimum
width of 10 feet should be provided. Due to the size of the building,
Bight obscuring trees should be provided if possible.
The Fire District has no objection to the request.
No other comments have been received.
B. ANALYSIS AND CONCLUSION
Chapter 18.142 of the Community Development Code includes the criteria
for evaluating a Home Occupation Permit. Section 10.142.050 includes
the basic criteria by which all home occupations must comply. Section

18.142.055 contains a number of discretionary criteria that may be
applied to specific proposals when deemed appropriate.
The Planning Commission finds that the proposed home occur with
,modifications, is consistent with the criteria contained ction
18.142.050 based upon the following:
1. The proposed use will be lawful and will be conducte- by the
vesiden*.s of the property.
2. The business activity, including storage and office space, must
not occupy more that 258 of the total square footage of the
residence or 1,192 square feet in this case. The applicant's
accounting of the office area is appropriate, but the shelf space
calculation must include adjoining floor area necessary to gain
access to the shelves.
3. The residential use of the property will remain the primary use
of the property if limited as set forth in the conditions of
approval noted in Section C. below.
4. There will be no exterior indication of the business use ouch as
signage.
5. No outdoor storage of materials is proposed and this will be
assured by the conditions of approval noted in Section C. below.
6. No retail sales, other than phone sales, shall occur on the
property and customers or clients shall not be allowed on the
premises.
7. As limited below, the use will not have any adverse impacts upon
adjoining properties as described in Section 18.142.050 A. 9. of
the Code.
8. No paid employees, other than persons residinq on the property,
are proposed. This will be assured by conditions of approval in
Section C. below.
9. No parking in addition to what is provided is need to accommodate
the resident : and the business. The applicant has two light
vehicles which will be used in addition to the delivery vehicles
that will visit the property.
10. Three deliveries per week is the maximum amount permitted for a
home occupation. The applicant states that deliveries shall not
be more frequent. It important to note that this number includes
pick up or delivery of business related materials made by the
applicant with his vehicles in addition to those made by others.
The Planning Commissicn finds that the proposed home occupation should
be subject to several of the criteria contained in Section 18.142.055
to address the following issues:

1. In order to reduce the potential for dust and to comply- with
Section 18.108.070 of the Code, the ei:ti.re driveway and parking
area should bp Vo; md.
2. Access co the property for the business should be limited to the
existi :g driveway location on 106th Avenue and not be allowed
onto North Dakota Street, which is desiiinated as a minor
collector street.
3. The property has not been landscaped and t!:e addition that will
be partially used for the business is quite large. The site
should be landscaped with an appropriate ground cover such as
turf or ivy. Also, trees should be planted on the east and south
sides of the building to help screen the storage addition and the
periodic loading that will occur in front of the building.
4. The vehicleE to be parked or stored on the site should be limited
to the van and pick-up truck (or vehicles of a similar type)
noted in the application as well as a recreationbl vehicle and
passenger automobiles. Delivery vans shall only be on the
property for the purpose of loading and unloading material.
5. Delivery vehicles should be Amited to two axles and a rated
gross vehicle weight (as defined in ORS 801.298) of 19,000
pounds, regardless of the actual amount of payload in the
vehicle. This size is equivalent to a UPS delivery van.
It i.s the conclusion of Commission that the limitations noted above
and the conditions listed below will act to adequately mitigate any
adverse impacts caused by the business activity•.
C. DECISION
The Planning Commission approves HOP 90-06 subject co the following
conditions:
PRIOR TO COMMENCEMENT OF THE HOME OCCUPATION, THE FOLLOWING CONDITIONS
SHALL BE SATISFIED. IF ANY OF THESE CONDITIONS ARE VIOLATED, THIS
HOME OCCUPATION PERMIT WILL BE IMMEDIATELY INVALIDATED AND CIVIL
INFRACTION VIOLATIONS WILL BE ENFORCED BY THE CITY. IF REVOKED, A NEW
HOME OCCUPATION PERMIT APPLICATION WILL NOT BE ACCEPTED BY THE CITY
FOR A PERIOD OF AT LEAST ONE YEAR.
1. The applicant shall submit a landscaping plan, for Planning
Division approval, which includes:
A. Ground cover for the entire lot area which is not paved.
b. A minimum of four trees with a minimum diameter at four feet
in height of 1.5 inches located in the vicinity of the
driveway and loading area to provide visual a-reening.

2. The plant materials desrribed in the approved landscaping plan
shall be installed within 90 days of the final approval date

3. The driveway and parking area shall be paved and no gravel
driving surfaces shall be permitted. The paving shall be
accomplished to the satisfaction of the City within. 90 days of

4. The applicant shall submit, for Planning Division approval, a
floor plan for the office and storage uses which does not exceed
1,192 square fs;et. This calculation shall include the office
room, the shelf areas, and the floor area necessary to gain

THE FOLLOWING CONDITIONS SHALL APPLY TO THE OPERATION OF THE HOME
OCCUPATION. IF ANY OF THESE CONDITIONS ARE VIOLATED, THIS HOME
OCCUPATION PERMIT WILL BE IMMEDIATELY INVALIDATED AND CIVIL INFRACTION
VIOLATIONS WILL BE ENFORCED BY THE CITY. IF REVOKED, A NEW HOME
OCCUPATION PERMIT APPLICATION WILL NOT BE ACCEPTED BY THE CITY FOR A
PERIOD OF AT LEAST ONE YEAR.
1 . The Home Occupation use and storage of materials and predicts
shall not occupy more than 1,192 square feet of tha, residence
groes floor area.
2. The use shall be a secondary use to the primary use of the house
as a residence.
:i. There shall be no paid employeea working in the home in
conjunction with the business who are not residents of the home.
4. There shall be no customers or clients coming to the residence in
conjunction with the business.
5. There shall be s.n digns or advertising visible from the exterior
of the premises.
6. There shall be no outdoor storage of materials or products
related to the business on the premises. Parki.nq or storage of
vehicles outside shall be limite ' to passenger automobiles and
the two light trucks (pick-up ane van) rioted in the al-plication
or similar vehicles. Indoor stc •age of ma+ ?rials or products
shall not exceed the limitations imposed by the provisions of the
Building, Fire, Health, and Housing Codes or other conditions of
approval contained herein.
7. There shall be no noise, obnoxious odors, vibrations, glare,
fumes, electrical interference, heat (detectable to normal
sensory perception outside the structure) , traffic, and discharge
of materials, gases, or fluids into the sanitary sewer or et-orm
drainage systems which are in excess of what is normally
associated with residential unes.

B. The Home Occupation Permit shall be renewed annually.
9. A business tax shall be paid annually for the business.
10. Deliveries shall be limited to vehicles which have no more than
two axles and which have a rated gross vehicle weight, as defined
in ORS 801.298, of no more than 19,000 pounds, regardless of the
payload in the vehicle.
3.1. There shall be no more than three (3) deliveries per week related
to the business use to the residence by all suppliers including
those made by the property residents.
12. The use shall provide and maintain off-street loading and
maneuvering space for all deliveries for turning and maneuvering,
of vehLcles on the site and not in the public right-of-way.
13: No direct vehicular access related to the business shall be
permitted onto S.W. North Dakota Street.
14. The applicant shall agree to allow periodic in!!pections by a city
representative during normal business hours to determine if the
above conditions are being satisfied.
It is further ordered that the applicant be notified cf the entry of this
order.

6. There shall be no noise, obnoxious odors, vibrations, glare, fumes,
electrical interference, heat (detectable to normal sensory perception
outside the structure), traffic, and discharge of materials, gases, or
fluids into the sanitary sewer or storm drainage systems which are in
excess of what is normally associated with residential uses.
7. No exterior or other on--site advertising visible from the exterior shall
be allowed.
8. The use shall not require any additional parking other than that which
is required for the residence.
9. There shall be no more than 3 deliveries per week to the residence by
all suppliers and/or the business owner.
10. All requirements set forth by the City Building Division which it deems
necessary to bring this use into compliance with the provisions Of the
Uniform Building and Fire Codes shall be satisfied by 2:00 p.m. July 11,
1989.
11. The use shall be required to provide and maintain off-street loading and
maneuvering space for all deliveries. Thr loading space shall have
sufficient area for tu.:ning and maneuvering of vehicles on the site and
not in the public right-of-way.
12. Delivcries shall be limited to vehicles which have no more than two
axles and which weigh no more than 19,000 (gross) pounds.
13. The Home Occupatijn Permit shall be renewed annually.
14. A business tax shall be paid annually for the business.

This letter is a follow up of today's meeting with Mrs. Weis, Marvin Bowen,
Ren Fox, Deborah Stuart, Coy Humphrey and myself. the building code issues
surrounding the uae of your garage for business purposes was discussed, and
some possible alternatives to gain compliance were given as follows:
o The north and west exterior walls of the garage are to be covered_ with
two layers of 5\8 inch type "X" gypsum wall board on the inside face of the
walls. The gypsum wallboard shall extend from the floor level, vertically
to the underside of the roof sheeting. The first layer shall be attached
with 1-5\8 inch long sheetrock nails spaced at 9 inches apart. The second
layer shall be placed so the joints are staggered from the first layer, and
nailed with 2 inch long sheetrock nails spaced at 7 inches apart. The second
layer shall have all joints and nail heads cover with gypsum plaster.
o In lieu of a parapet wall on the north wall, a layer of 5/8 inch type "X"
gypsum wallboard can be applied to the underside of the roof framing extended
a minimus of 10 feet horizontally from the will along the walls entire
length. The gypsum wallboard shall be attached with 1.-5/8 inch long
sheetrock nails, spaced 7 inches apart. All joints and nail. heads shall be
covered with gypsum plaster.
o The garage/business murt be separated from the residence by a full one hour
occupancy separation ( this requires that all walls common with the residence
have one layer of 5/8 inch type "X" gypsum wallboard on each side of the
wall from the foundation to the roof sheeting) . All doors in the wall must
be one hour rated firedoors, including frames. All other openings shall be
protected by approved fire dampers.
o A minimum of one 2A-10Bc fire extinguisher shall be provided in the garage/
bus.inens.

You have asked for an interpretation of the Community Deveiopment Code relating
to the calculation of floor area for a home occupation business. This issue
was brought forth relating to the above application which has not been approved
at this time. My interpretatijn will first deal with this issue in general and
then focus upon the specific case. Also, the issue of semi-truck deliveries to
home occupations will be reviewed.
Floor Area Calculations
Section 18.142.050 A. 2. a. states that for a home occupation "the use and
storage of materials and products shall not occupy more than 25 percent of the
combined residence and accessory structure gross floor area". The floor area
devoted to a business activity would include rooms or distinct portions of
rooms where office or material storage is occurring.
Home Occupation Permit 89-14
The home occupation application for a residence located at 11163 SW 106th
Avenue (HOP 89-14) involves an attached garage that is presently being use for
storage and a small office area. Materialn are being stored on a number of
shelves that line the walls of the recently constructed garage addition. The
total square footage of the house (1,652 eq. ft. ) and the new addition (3,114
sq. ft. ) is approximately 4,766 square feet. Unenclosed areae such as the
carport and deck are not considered as building floor area.
The applicant indicated in the home occupation application that only one tier
of shelves totaling 906 square feet would be used along with a small office
area for a total of 1,200 square feet. In actuality, three tiers of shelving
have been installed.
The area of the shelves in the garage is not an appropriate measure for
determining the magniturie of the business because their number and size can be
easily changed and the Code clearly refers to "gross floor area". Since the
shelves line t.-iree sides of the garage as well as interior floor space, the
entire 3, 114 square foot garage should be included as part of the business use.
Although matpri.als are only stored on the shelves, it is apparent that most of
the garage area is needed for moving materials to and from the shelves. As a
result, the home occupation application may not be approved because
aPproximately 65 percent of the groes floor area of the residence would be
devoted to the business use.
A floor area calculation for the business can be reduced if the applicant can
illustrate that an identifiable portion of the garage will never be used in
conjunction with the home occupation. Based upon the total size of the house
(4,766 sq. ft. ) , the home occupation, including storage and office azea, can
not exceed 1,192 square feet.
Deliveries
The home occupation reviewed &rive is receiving semi-truck deliveries at a rate
of two or three per week. Sect.lon 18.142.050 A. 12. allows a maximum of three
deliveries per week w'.thout specifying the maximum size of the delivery
vehicle. Thire aspect of the business conforms with Code requirements, although
I am certain that it is not the kind of activity the City Council had in mind.
If the visits by semi-trucks become a problem, the City would have the
authority to amend the Code to prohibit trucks exceeding a specified weight
limit for home occupation deliveries.

Dear Mr. and Mrs. Weis:
We are writing to inform you that the City of Tigard will be with:701di.ng
approval of your home occupation permit until it nae been determined by City
staff that your business and residence are in full compliance with City ,Lome
occupation and Uniform Building Code regulations.
A field visit conducted by City staff made apparent several discrepancies
between what was indicated on your home occupation and building permit
applications and what is actually occurring at your residence. The following
observations were made by staff pertaining to your home occupation:
1. Three shelves and not one are being used for an minimum low
estimate of 1992 square feet of floor space (42% o. the total gross
floor area) ;
2. Additional space on the warehouse floor and possibly on an
additional set of shelves and office area boosts the total floor
area used for the bu3iness much higher; and
3. The home occupation ordinance restricts the use of a residence for
business purposes to no more than 25 percent of the combined groes
floor area of the "garage" and residence or no more than 500 square
feet total for the business. Since Deborah did i of quote you the
500 square foot figure, the City will be satisfied with a 25
percent ceiling on groes area devoted to business usage.
4. Therefore, the gross floor area in use for business purposes needs
to be reduced to no more than 25 percent of the combined gross
floor area of the "garage" and residence, which staff estimates to
be 1191.5 square feet.
The Building Division has issued building permits for the construction of a
garage and storage area as related to a residential structure. They recently
learned that you are using most of the garage for business purposes. This
change in use of the building wiLl require that the structure be constructed
as required for a commercial building. If you are to continue to use more than
10 percent of the garage floor area for burliness purposev, the following will
also be required:

1. Three sets of plans showing the exact layout of the business area,
exit doors, the adjacent residence and the proposed construction
of the fl-ewalls shall be submitted for review and approval (submit
plans prior , o commencing work);
2. The north and west walls of the building must be of One Hour fire
resistive construction (this requires one layer of 5/8 inch type
"X" gypsum wallboard installed on the inside face of the walls and
one layer of 1/2 inch gypsum sheathing installed on the outside of
the wail under the siding;
3. The north firewall must extend a minimum of 30 inches above the
roof line;
4. The garage/storage building must be separated from the residence
by a full. One Hour Occupancy separation (this requires that all
walls common with the residence have one layer of 5/8 inch type "X"
gypsum wallboard on each side of the wall from foundation to roof
deck. All. doors in the wall must be One Hour Rated firedoors,
including frames. All other openings shall be protected by approved
fire dampers; and
5. A minimum of one 2A-10BC fire extinguisher shall be provided in the
garage.
The above-mentioned deficiencies are in violation of. Tigard's Community
Development Code, Chapter 18.142, Secticn 18.142.050(a) (2) and (3) ,
Approval Criteria for Home Occupations, and the Uniform Building Code
Section 502.
We have instructed the City's Code Enforcement Officer, Coy Humphries,
to postpone the first summons and citation action sent to you because
you did, in good faith, submit for a home occupation permit. Coy is
requesting that the judgeset over the hearing to June 13, 1989.
However, if the above problems are not corrected by 3 p.m., May 31,
1989, the City will instigate civil infractions proceedings against
you.
