DECISION:
A. FINDING OF FACT
1. Bacloground
No previous land use related request for this Site have been
reviewed 1Ty the City of Tigard.
2.. Vicinity Informatiarn
AL1 Properties -%bitting *:p suujest site are zoned R-3.5
(Residential, 3.5 writs per acre) and are developed with single
family residences. Directly west of the subject site, cr fiEin:3 SW
103rd Avenue, is a »redeveloped parcel, alrso zoned R-3.5, planted
with several 12 to 15 foot fix trees.
3. Site Information arxi proposal
The subject site contains a single family residence with a grwe].Ad
Parking area, exter113.ive larxiscaping including a large cedar tree in
the south half of the front yard, several other trees, shrubs arr_i
pasture area. The site slopes gradually to the north-east from the
Present graveled ptirking area which In approximately sixteen feet
from the roadway. Access to the site is via SW 103rd Avenue, which
is functionally cleessified as a local street and, at this time, 1.8
paved without sideweelks or curbs.
The applicant proM;es to construct a detgclred garage to a height
of 15 feet in the site's front yard, 16.5 feet from the front
property line as illustrated in Exhibit A.

4. Agency and NPO Cr_nmL-nts
The Engineering Division, the Building Division, the Tiger 'dater
District, Portland General Electric, ana the Tigard Fire De ,art:ment
reviewed tlue proposal and offered no objections or conamts.
No other- canuvants M:a-e received.
B. IMLYSTS AND CONCLUSION
Section 18.144.070 of the Carmmity Development: Code contains the
approval criteria whereby the D..rector can approve an application for an
accessc y structure. The relevant criteria in this case i.riclude a
maximum size of 500 square feet, side yard setback of 5 feet, no
encrow.hment unon adjoining properties, rights--of.-may or easemmts. a
maximum height of 12 feet, no detached structures in a front yard; and
c wpliance with the Uniform Building Code. In &Aditiom, the R-3.5 zone
has a front ydrd building setback of 20 feet. The applicant is
proposing to construct a detached accessory strric*arre which mjets all
relevant criteria except for the proposed locatial in the fiont yard, ,a
16.5 foot frust yard setback, and a height of 15 feet. Thome
variations from the Code sta-Aards are discussed below.
Section 18.134.050 of the Code rexplires that a variance request be
consistent with the intent of the Ccarprehensive Plan and the Code, that
special circumstances exist, that City standards will be maintained to
the maximum extent passible, and chat the need for the variance is not
self-imposed.
Potential locations For the garage are severely limited because of the
sloping terrain to the north of the residenroe, t1v-- inaccessibility of
the Year yard, them location of the septic system drainfield, and the
mature vegetation on the property. Considering these limitations, the
only practical site for a detached is in the front yard. All othex
optjons would require considerable grading, rurnnil of the septic
system, or r-moval of mature landscaping.
The variance to the front Yard building setback is necessitated because
of the location of the septic system drainfiald, which has been �.dTi Pied
by the ':aunty Sanitarian. The proposed 16.5 foot setback will not cause
any visual encroac)rmmt upon other nearby properties and adequate area
will remain to allow for future street improvements or expansion. Since
the entrance to tYn garage will face south and riot toward 103rd Avem,
sul:fici-mt space shall be available for rvw)ring and manuvering vehicles
outside of the street right-of-way.
The appl.tcant is rcx Mting an rdditional 3 feet of building height (15
ft. vs. 12 ft. requir d. by Ccxie) to increase the storage spiv-v in the
Wilding and to match tle roof pitch with the house. Because of the
distance of the proposed building f_-cm othf:r stnucturen and residences
in the vicinity and the screening offordFA by the existing vegetation in
the front yard, this slight increase in height should not have any
adverse affect.
C. DECISION
Based upon Oe above find.`._ngs and conclusions, the Director's designee
approves M 88-27 and V 88-40 subject to the following conditions:
