You were recently asked to determine if a valance is needed in the window of
the house being constructed on the above referenced lot. It is my
interpretation of. section 18.98.030 (A)(3) of the Community Development Code
that windows may not be allowed in a structure on a flag lot when they "face
dwelling unit windows or patioes on an abutting lot". Therefore, unless this
condition exists, the window may be in excess of 15' in height. From my
discussions witP you and Brad Roast, it appears that the windows as
constructed on the east end of the house do not violate the intenL of the code
provisions as they are 25 feet from the east lot line and 17 feet from the
southerly line. The only lot that abuts the site which is concerned, at 985.5
View Ct. , does not have its privacy infringed by the 3ubjec.t window due to the
orientation of the window and the angle of the glass. It is my interpretation
that the code provision does not apply to the window on the east end of the
mouse.

The owners have professed in writing an intention to install valatces
or other media to bring the window exposures in alignment with -he City's
requiremento.
The undersigned, Wally Powell, owns and occupies the property adjoin-
ing the south 'joundary of lot 10, and if the steps proposed to be taken
to comply with the stated requirements are fulfilled, and the valances
are installed prior to or incident to the occupancy of the statute, there
will be no further protestations filed.
The attention of the City is invited also to the fact that the set-
back requirement of 7 feet on the right side of the structure does not
conform to Section 18.98 090 of the Code, although the building permit
application as approved appears to authorize the change from 10 feet to
7 feet.
It is our purpose herein to bring this to the City's attention, par-
ticularly noting that there are two other flag lots in Lhe same subdivision
where the same problem could arise if careful checking of any proposals to
develop the lots are not properly eval+(ated.

In short then, the valances as proposed to be installed as set forth

And, due to the vent openings along the top of the valance, we will still

At the City Council meeting of March 12, 1984, the Council dealt with the
interpretation of Section 18.98.030 of the Community Development Code as it
cok.,.erns the above named property. Following a presentation by Mrs. Clinton
and my input, the Council determined that condition #3 of Section 18.98.030
has not been fully ;net. It reads :
"3. Windows 15 feet or more above grade shall not face dwelling
unit windows or patios on any abutting lot unless the proposal
includes an agreement tr plant trees capable of mitigating direct
views without loss of solar access to any dwelling unit, or that.
such trees exist and will be preserved."
The Council sound that since the wLiduws on the southerly side are in excess
of fifteen feet high, the property owner must take steps to either: 1)plant
trees in conformance with section 3 or 2) take steps to reduce the window are,,
so that there is no window space above 15 feet above grade. I have cxplainei
to the Council that it is the property owner's righ` to choose a solution.
Since it is the Council 's finding th-t the Community Development Code Serciun
18.98.030 (3) ha:; not been fully met, please_ require that the ,.,;perty owner
take steps to alleviate the problem prior to issuance of a completion notice
and certificate of occupancy. I'm sure that you recognize the sensitivity of
this issue given the community input.
Please advise me of the property owner's chosen course of action and the

SUBJECT: Mary Clinton Issue - 14185 SW 98th Ct. , Construction
On Monday, February 27, 1984, Mrs. Mary Clinton appeared before the City
Council to voice her objection to the construction or a two-story house at
14185 SW 98th Ct. , next to Mrs. Clinton's property at 9865 SW View Ct. Prior
to presenting the issue to the Council, Mrs. Clinton had discussed the issue
with me as well as Ed Walden and Brad Roast of the Building Division. Each of
us has visited the site to determine if any irregularities exist. Following
is a description of the issue and our findings.
Issue - Mrs. Clinton's prime concern is that the new c.mstruction reduces the
view from her property. Prior to initiation of construction activity, she had
a clear northerly view from her property across vacant land owned by Pete
Janzen (land which was subdivided into McDonald Acres). Mrs. Clinton feels
that she has a property right to the view which should be preserved. A copy
of. her February 13, 1981+ letter is attached which outlines her concerns. My
response on February 21 is also attachr.d.
Analysis - Upon visiting with the Building Division, Mrs. Clinton was informed
that the lot on which construction is taking place is a flag lot. As a
result , development of the lot is governed by Section 18.98.030 of the
Community Development !,ode (page 111-158) , Building Heights and Flag Lots.
The section reads as follows :
18.98.030 Building Heights and Flag Lots
A. The maximum height for a single-family, duplex, attached or multiple
family residential structure on a flap lot or a lot having sole
access from an accessway, private drive or masement shall be 1 1/2
stories or 25 feet , whichever is less, except ti,at the maximum height
may be 2 1/2 stories or 35 feet, whichever is less, provided :
1 . The proposed dwelling otherwise complies with the applicable
dimensional requirements of the zoning district;
2. A residential structure o4) anv abutting lot either is located 5U
feet or more from the nearest point of the subject dwelling, or
the residential structure exceeds 1 1 /2 stories or 25 feet in
height on any abutting lot ; and

3. Windows 15 feet or more above grade shall not fact, dwelling unit
windows or patios on any abutting lot unless the proposal
includes an agreement to plant trees capable of mitigating
direct views without loss of solar access to any dwelling unit,
or that such trees exist and will be preserved.
B. Where an agreement is made to plant trees capable of mitigating
direct views, the agreement shall be deemed a condition of approval
under the provisions ,if Section 18.32..250 (F).
The Building Division has reviewed this portion of the Code with the building
plan for 14185 SW 98th Ct. and found that the above criteria for the granting
of an exception has been met. Specifically, the maximum allowed height for
the building is 2 1/2 stories or 35 feet, whichever is less, because the three
conditions cited under Section 18.98.030 are met. That is: 1) the proposed
dwelling complies with the applicable dimensional requirements, the setbacks
for the zoning district; 2) a residential structure on an abutting lot is
located 50 feet or more from the new dwelling unit; and 3) if windows are over
15 feet above grade they shall not face dwelling unit windows or patios on
abutting lots unless trees are planted to mitigate direct views. Conditions
#1 and lit are not i dispute. Mrs. Clinton has, however, in the past
contended that condition #2 has two segments which she believed both must be
meta I have explained to her that to meet the requirement only one of the two
alternatives must be met in order to provide the protection intended by the
code.
Condition #3 is in dispute. Mrs. Clinton contends that the windows being
constructed on the south side of the property are in excess of 15 feet high
and face her property. Her argument is not without merit, however, a closer
look at the intent of the Code and the specifics of this window unit is
necessary. The Code says that "windows 15 feet or more above grade shall not
face dwelling unit windows or patios unless trees are planted to mitigate
direct views. The windows in questions, shown on the South Elevation drawing
taken from the building permit application, are actually about 17 feet from
the grade to the top of the windows. Thes" windows, however, will serve a sun
room and act as a passive solar system. The room height will be fully two
stories, that is, the upper half of the windows will not accommodate the
possibility of a person standing behind them looking out. To see out ti;k!
windows, one will be standing on the first floor. The purpose of the
astriction is to preserve privacy. I contend that privacy will be preserved
at the highest point will be approximately 17
even though the window height

substantially below that of Mrs. Clinton and her neighbors, and because the
normal use of the windows will not result in persons utilizing the sun room
facing dwelling unit wie.iows or patios on abutting lots. If , however, the
Council feels that further protection of Mrs. Clinton' s privacy is necessary ,
we may request that the property owner plant trees to mitigate direct views.

Given the distance and grade differences, I do not believe this is necessary.
I should note that I have viewed the new construction from Mrs. Clinton' s
house and I have been inside the new home to judge the privacy issue. I
believe that the windows of the new home will not intrude on the privacy of
the neighbors.
You will find enclosed portions of the plans submitted for the home and a memo
to me from Ed Walden, Building Official, stating that the height of the
structure is allowable under the Code.
I recommend that the City Council take no action on this matter.

Dear Mrs. Clinton,
In response to your letter of February 13, 1984, 1 would bike to assure
I you that the City's comprehensive nlan and commueity development code are in
existence to serve the -needs of the enti.re community. The plan is a balanced
attempt to preserve the rights of all citizens in an equitable manner. As I
pointed out to you when I visted your home on Tuesday, February 14th, the plan
now being implemented was developed by the community with the staff. I do not
contend that it satisfies the concern's of all the people, how they m;.ght use
their property, how they might prevent neighbors from using their property in
a manner which interferes with an individual's enjoyment, or how they m'aht
make the greatest profit from their land. The plan dyes, howdver, reflect the
overall philosophy of Tigard.
Your particular concern of how to protect your view is a valid one. As I
expressed to you, however, the majority of means of preservation of vies are
accomplished by private action, not governmental. To preserve a view either
purchase of adjoining property, purchase of development rights from adjoining
properties or covenents, conditions, and restrictions are the most common
methods. For a government to enter into this area to the extent which you
might desire would require us to write An ordinance acc-.:ptable to the City
Council and the community at large which defines which views should be
protected, what a view is, how much of the view is protectable, and who has
the greatest right to view the higher , sound or the lower ground. 1 do not
believe that the citizens of Tigard want the City to make these decision which
are more commonly wade by cooperative neighbors and property Downers.
In answer to your question, as I and my staff have pointed out to you, the
Community Development Code and Uniform Building code are the documents which
the Building Division. applies when issuing permits and conducting field
inspections during building construction. I have pointed out the specific
sections of the code as have Brad Roast and Ed Walden on earlier occasions.
