TRACY LIVINGSTON
APPLICATION: A request by Tracy Livingston for approval of a flexible setback
variance to allow a 12 foot rear yard and a 414" side yard setback where 15
and 5 feet respectively are required on a .19 acre property zoned R-4.5
(Single Family Residential, 4.5 units/acre). Location: 11100 S.W. 95th
Avenue (WCTM 1S1 35DB Lot 10400).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above application subject to certain conditions: The
findings and conclusions on which the Director based his decision are as noted
below.
A. FINDING OF FACT
1. Background
Mr. Livingston applied for a home occupation permit in September to
allow operation of a mobile music entertainment business from this
residence (HOP 87-21) . A misunderstanding between staff and the
applicant resulted in an amended decision. The applicant had not yet
remodeled his home nor had he moved in yet .
Recently the applicant applied for building permits and the applicant
learned that his property lines had been improperly drawn in relation
to the house and as to their actual location. Staff determined that n
flexible setback variance would be required,
2. Vicinity Information
Properties to the immediate north, east and south of this subject
property are also zoned R-4.5. Properties to the west are zoned R-12
(Medium Density Residential, 12 units/acre).
3. Site Information and Proposal Description
The .19 acre parcel presently contains a 700 sgiiare foot single family
structure. The applicant intends to remodel the existing structure
into a 2400 square foot residence with an attached garage. Until the
applicant has been issued an Occupancy Permit from the Auildi.ng
Division, he will not be permitted to operate the bustness from this
location.
The applicant has submitted a new site plan which show, tho corrrrtod
property lines. When t e house was constructed, it was not built
squarely. The existing structure was placed nt an angle on the lot
such that it was square to the n,irthern flag lot. The applicant is
requesting a flexible setback variance so that the house can he built
with square (90°) corners which will remedy the odd shape of the back

of the house. This construction will result in a 12 foot rear yard
setback where a minimum of 15 feet is required and 4 feet 4 inches on
the south side yard where 5 feet is required.
4. Agency and NPO Comments
The Engineering Division has reviewed the proposal and has no
objections to it.
No other comments were received.
B. ANALYSIS AND CONCLUSION
Section 18.146.050 contains the approval criteria by which the Planning
Director can approve a flexible setback variance. The front, rear, side
or corner side yard setback areas may be reduced up to 20 percent provided
the following standards are satisfied:
(1) The reduction of the setback area established by the applicable zoning
district shall be necessary to allow for the enlargement or remodeling
of an existing building;
(2) The garage setback to the front property line satisfies the
requirements of the applicable zoning district;
(3) The standards of Chapter 1.8.102 (VISUAL CLEARANCE) shall be satisfied;
(4) The resulting lot coverage shall not exceed the maximum lot coverage
of the base zone; and
(5) The proposed addition shall not encroach upon any existing easements.
(6) When the proposed addition is within the rear yard, the area adjacent
to the rear property line shall be landscaped with sight obscuring,
plantings in accordance with the standards set forth in 18. 100.080
(LANDSCAPING AND SCREENING).
(7) Setback, buffering and screening requirements that apply when
commercial and industrial zones abut a residential zone shall be
satisfied.
The Planning Division staff makes the following findings with respect to this
proposal:
n. The proposed rear yard setback reduction will amount to exactly 20
percent, while the proposed side yard setback reduction will amount to
only 13 percent.
h. The rediirtion of the sethark awns will imiped be necessary to allow for j
the enlargement or remodeling of an existing strecture.
r. The proposed Addition satisfies the 20 foot minimum setback requirement
for the garage in the R-4.5 zoning district.
d. Vision clenranre area requirements will not be affected by the proposed
addition.

e. There is no maximum lot coverage in the R-4.5 zoning district so long as
all applicable building setbacks can be met.
f.. The proposed addition will not encroach upon any existing easements. The
applicant knows of no existing easements traversing the property.
g. The applicant shall be req- ired to plant site obscuring plantings in
accordance with Sections 18.146.050(x)(6) and 18.100.080.
h. The property is zoned residential so the buffering and screening
requirements for commercial and industrial properties do not apply.
Based on the above findings and recommendations, staff recommends approval of
this proposal.
C. DECISION
The Planning Director for the City of Tigard hereby approves M 87-14
subject to the following conditions:
1. UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO ISSUANCE
OF OCCUPANCY PERMITS.
2. The applicant shall plant site obscuring plantings in accordance with
the provisions of Section 18.100.080 (LANDSCAPING AND SCREENING
Sections Attached). Contact Deborah Stuart at 639-4171.
3. The applicant shall pay the remaining amount due on the City sewer
recount for this property totaling 003.25.
4. This approval is valid if exercised prior to the expiration date given
below.
D. PROCEDURE

I have discussed the sewer service billing problems we discovered
on SW 95th Avenue in Tigard with Tom Blankenship who is in charge
of administering the Agency' s contracts with. our various member
cities . Since the homes I discussed with you are all located
within Tigard city limits , Mr. Blankenship would like City of
Tigard to do the sewer service billing for all the properties
involved.
I am providing you with a list of all the properties in dispute
and with the most current owner information we have for them.
In the case of properties that have been billed in the past by
U.S .A. or not billed at all . I have indicated that billing by
City of Tigard should begin as of 7/1/80 . U.S .A. will. send a
letter to the property owners explaining the change in billing
procedure that will occur on 7/1/80 and will handle billing and
collection of sewer service charges for the properties through
.Tune 1980 .
Please let me know if you have any questions or encounter prob-
lems with this transfer of billing responsibility to the City.
In the future, we hope to initiate a uniform procedure for
correcting the billing jurisdiction for annexed properties atld
preventing situations like the one on SW 95th from occurring.

Per our conversation on 1-16-80, 1 am sending you o,ir bill for 1979-80
sewer service charges for your property at 11070 SW 95th_. Since 1970
we have combined billing for this home with the billing for 11100 SW
95th and failed to correct our records wren 11070 SW 95th was segregated
to a separate tax lot number.- - We have instructed Assessment and Taxation
to credit your account for,_11100 .5W_.)9th dr the $72.00 1979-80 charges
now being billed to you oA1'�--s "pirat=e statement-. by the Agency.
In the process of researching this matter, we have discovered some additional
billing errors that have occurred regarding the two homes. I would like to
explain these errors to you and let you know the steps we are taking to
correct them. Beginning in Ap-il, 1977, through an error, the City of Tigard
began billing your house at 11100 SW 95th for service charges, even though the
Agency was also billing you Service charges on your annual tax statement . Your
tenanPi paid the billings Otey received from the City through March, 1979.
To correct the uouble charf,es that were made on 11100 SW 95th from April, 1977
thro..,1h March, 1979, the Agency will now credit your tax charges for that
period on 1S1 35AC 1300 as follows ; Tax year 1976-77 (4/77-6/77) $15.00 credit,
Tax year 1977-78 (7/77-6/7L') $60.00 credit, Tax year 1978-79 (7/78-3/79) $54.00
credit. In addition you can digregard the billings you have received from the
City of Tigard for the months of April, 1979 through March, 1980. Your charges
for 11100 SW 95th for the months of April., 1979 through June., 1980 will be
included in your property tax charges for that period.
I understand that taxes for 1S1 35AC 1300 have not yet been paid for 1976-77
forward so I will ask the Tax Department to correct your account for the years
involved and send you corrected Tax Statements reflecting the changes. For
convenience we have left service charges for 11170 SW 95th on the account for
11100 SW 95th for the tax years of 1976-77, 1977-78 and 1978-79.
To correct the confusion we discovered regarding billing jurisdiction for the
varLous properties on SW 95th Avenue-)beginning July 1, 1980, City of Tigard

will take over responsibility for billing all the homes in that area.
Therefore, starting in July, 1980, instead of being charged an annual
service fee by U.S .A. on your tax statement, you will receive quarterly
sewer billings directly from the City of Tigard and all sewer fees will
be paid to them.
I certainly apologize for any inconvenience our multiple errors have
caused you and hope w2 have now straightened out your accounts to your
satisfaction. Please call me if you have any questions about the
corrections and changes we have made.
