DECISION: Notice is hereby given that the Planning Director's designee for
the City of Tigard APPROVED the above described lot line adjustment
application subject to certain conditions. The findings and
conclusions on which the designee has based his decision are a3
noted below.
A. FINDING OF FACT
I. Background
Sattler Park Estates received preliminary approval in 1979 (ZC
78-22, Ord. 79-52) , however, the project did not proceed. Then,
in 1981, a revised proposal featuring 34 common wall unite, 3
single family residences and a 3.7 acre open space area at the
northern end of the property was proposed. This project did not
materialize.
In 1984, an application for Mallard Lakes, a 37 singie family
residential subdivision (PD 84-4, S 84-9, V 84-14), was
submitted by Mr. Wardin. Originally, the application was denied
by Tiqard's Planning Commission► and later appeal to city
Council. Council returned the proposal to the Commission for
further consideration where it was later approved.
2. Vicinity Information
All properties adjacent to the subject parcels are zoned R-4.5
(Residential, 4.5 unite per acre) . With the exception of the
properties to the north of the subject parcels, a Planned

Development (PD) overlay applies alc-ig with the R-4.5 zoning
designation.
Parcels to the north and the west are developed with single
family residences. The parcel to the south is developed as open
space/parkland with a pond, shrubs and walkways. The parcel to
the east is designated as a City park, bit is not developed.
3. Site Information and Proposal.
The subject parcels are at the northern end of the Mallard Lakes
subdivision located on S.W. 91st Avenue, which is functionally
classified as a local street, is paved with curbs and sidewalks,
and ends in a cul-de-sac. Tax Lots 14901 and 14900, each contain
a single family residence and are well landscaped with lawn,
fencing, shrubs and trees. Tax lots 15000 and 15100 are vacant
and undeveloped.
4. Agency and NPO Comments
The Tigard Fire District reviewed the proposal and offered the
following comment:
A. The Fire District has no problem with the proposal
provided structures on the subject sites have adequate
setbacks that comply with the Building Code.
The Engineering Division, the Building Division, Tigard hater
District, NPO #6, General Telephone, Portland General Electric,
and Northwest Natural Gas have all reviewed the proposal and
offered no comments or objections.
B. ANALYSIS AND CONCLUSION
Section 18.162.060 of the Tigard Community Development Code contains the
following standards for approval of a lot line adjustment:
1. An 3dditiona.l lot is not created by the lot line adjustment and
the existing parcel reduced in size by the adjustment is not reduced
below the minimum lot size established by the approved zoning for
that district.
2. By reducing the lot size, the lot or structure(s) on the lot
will not be In violation of the site development or zoning districts
regulations for that district..
In a review of the applicant's proposal, no additional. parcels will be
created and the location of the existing structures will not be in
violation of City standards.
The proposed lot line adjumtment would satisfy all. of the above
criteria.

C. DECISION
The Planning director's designee hereby APPROVES lot line adjustment
M 88-23 subject to the following conditions:
UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO RECORDING
THE LOT LINE ADJUSTMENT WITH WASHINGTON COUNTY.
1. A lot line adjustment survey map and legal description shall be
submitted to the Planning Division for review and approval prior to
recording with Washington County. (Staff contact: Michael Matteucci,

THIS APPROVAL IS VALID IF EXERCISED WITHIN ONE YEAR OF THE FINAL
DECISION DATE. NOTED BELOW.

accordance with Section 18.32.290(A) and Section 18.32.370 of the
Community Development Code which provides that a written appeal
must be filed with the City Recorder within 10 days after notice is
given and sent. Appeal fee schedule and forms are available at
Tigard City Hall, 13125 SW Hall Blvd. , Tigard, Oregon.
The deadline for filing of an appeal is 3:30 p.m. January 24, 1.989.
