A_PPLICPFION: Request by I . L. Noble and Glenn Turner to partition a O.tl acre
parte' into two lots of 9,312 and 17,29: square feet on property zoned R-4.5
(Residential 4.5 units/acre) and located at 11555 SW 90th Avenue. (Wash. Co.
Tp-4 Map 1S1 35DC, Tax Lot: 8000) .
DECISIO_N_: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described application subject to certain
conditions, The findings And conclusions on which the Director based his
decisior are as noted below.
A. FINDING OF FACT
1 . Packground
No previous land use cases have been reviewed by the City relating
to this property .
2 . Vicinity Information
The subject property is within an established single family
residential neighborhood that. is zoned R-4 .5 (Resident:ial, 4 .5
unit,o'acre) . Lots generally range from 10,000 to 27,000 square
feet in si -e.
3 . Site Information and Proposal )escription
One residen-e is located in the nc,r•t.heast portion of the subject-
property,
ubjectproperty, near 90th Avenue. The applicant proposes to create a
flag lot to establish a new homQsite in the rear portion of the
property . A 25--foot wide access strip will be provided for this
lot on the south side of the existing residence.
4. Agency and NPO Comments
The Engineering Division notes that. the remaining half-street
improvements along the 90th Avenue frontage should be installed.
The Building Inspection Division has no objection to the proposal .
B. ANALYSIS AND CONCLUSION
The Gr•oposed partition is consistent with City Code requirements for
minimum lot -size (7,500 square feet), access, and setback requirements
for the existing house. It should be rtited that a house on the flag lot
will be subject to the standard front and rear yard setbacks of 20 and
15 feet and a 10 foot side yard requirQment Also, houses on flag lots
are subject to height restrictions contained in Section 18.98.030 of the
Community Development Code (copy enclosed) .

C. DECISION
The Planning Director approves MLP 9--85 subject to the following
conditions:
1.. UNLESS OTHERWISE NOTED, ALL CONDIT-IONS SHALL BE MLI PRIOR TO
RECORDING THE PARTITION.
2. Standard half-street improvements (fronting both tracts) i.ncltiding
sidewalk, curb, driveway aprons, storm drainage and utilities
shall be installed along the S.W. 90th Avenue frontage. Said
improvements along S.W. 90th Avenue shall be built to local streei
standard's and conform "o the alignment to be approved by the City
Engineer.
3 . Seven (7) sets of plan-profile public improvement construction
plans and one (1) itemized construction cost estimate, stamped by
a Registered Professional Civil Engineer, detailing all proposed
public improvements shall be submitted to the Engineering Section
for approval .
4. Sanitary sewer plan--profile connection details 0iall be provided
as part of the public improvement plans.
5. Construction r` proposed public improvements shall not commence
until after the Engineering Section has issu?d approved public
improvement plans. The Section will require pr,stind of a 100%
Performance Bond, the payment of a permit foo and a streetlight
fee. Also, the execution of a street cpeninq pet -it shall occur
prior to, or concurrently with the issuance of approved public
improvement plans . SFC THE ENCLOSED HANGOUT GIVING MORE SPECIFIC
INFORMATION REGARDING FEE SCHEDULES, BONDING ANTI AGREEMENTS.
6. 'The partition survey and legal descriptions shall be submitted to '
the Planning Director for reviow and approval . THE CITY SHALL
RECORD THESE DOCUMENTS AFTER THEY ARE APPROVED AND A COPY SHALL. OF
FORWARDED TO THE APPLICANT.
7. This approval is valid if exercised with-.n one year of the final
decision date noted below.
