Gentlemen:
A fire and life safety plan review was conducted on the above captioned.
project for compliance with the 1985 editions of the Uniform Building Code
(UBC) , Uniform Mechanical Code (UMC) , and the Unifo-~m Fire Code (UFC) , as
amended by Washington County Fire District No. 1's Ordinance 86-1.
My apologies as to the delay in getting this letter out, however, plans
were stamped and conditionally approved at the City of Tigard shortly
after receipt.
1. Firestopping: In all wood framed walls and partitions, f.irestopping
consisting of 2-inch nominally-sized lumber or other approved
materials must be installed at all floor and ceiling levels.
Peneti:ntions in this prescribed Firestopping to accommodate wiring,
plumbing, and other similar utility runs must. be packed with
noncombustible materials in an approved manner so as to prevent the
passage of flame. UBC Sec. 2516
2. Exit Door Hardware: All doors shown an the drawings must be openable
frort, the inside for immediate exit at all times without the use of a
key, special knowledge, or effort. UBC Sec. 3304
3. Exterior Exit Door: Hardware for the exterior doors and key operated
deadlocks may be permitted where there is a sign posted o1 or over
the door reading, "THIS DOOR MUST REMAIN UNLOCKED DURING BUSINESS
HOURS" in letters toot less than one-inch in height i a contrasting

4. Approved Plans on Job Site: One set of approved plans bearing the
stamps )f the Tigard Building Department and this office must be
maintained on the project site throughout all phases of construction
and must be made available to building and fire inspectors for
reference during required construction inspections. UBC Sec. 303
5. Inspections Required: Inspection and approval of construction by a
representative o:` this office is required: (a) prior to the cover of
any new framing elements following the installation of all. utility
runs which will be concealed within wall and partition cavities; (b)

ADVERTISEMENT FOR BIDS
Sealed hids will be received by Bruce Crest, Director- Metropolitan Area Communications
Commission (MACC), at the Main Office/Training Center, 1815 NW 169th Place, Suite
6020, Beaverton, OR 97006-4849 until 1:00 p.m., Febnrary 14, 1989 for the South
Center / Studio Remodel, and will then and there be opened and publicly read aloud.
Bids received after the time fixed for opening will not be considered.
Briefly, the work consists of alterations to the existing studio and related areas,involving
minor demolition, cutting and patching, hollow metal frames and wood doors relocation,
drywall, carpeting,painting,lay-in acoustical ceilings, mechanical and electrical revisions.
Contract Document,may be examined or obtained at the office of LUEY ARCHITECTS,
11945 SW Pacific Highway, Suite 301 Tigard Plaza, Tigard, OR 97223, (503) 684-3622.
Up to two sets of Contract Documents may be obtained by PRIME BIDDERS upon deposit
of$50.00. Any bidder, upon returning sets in good condition within seven days after bid
opening will be refunded his deposit, and any nem-bidder upon so returning sets will be
refunded his deposit if sets are returned no later than five calendar days prior to bid opening.
Deposit sum will be refunded to successful bidder after award of Contract..
Contract Documents may also be examined at the office of Mdropolitan Area Communications
Commission after January 30, i-189.
All bidders must comply with ORS 279.350 pertaining to the payment of prevailing rates of
wage.
No bid will he considered unless accompanied by cashier's check or certified check or bid
bond (with authorized surety company as surety)made payable to the Owner in the amount of
f 10°/, of the maximum amount of the bid and no interest will be allowed on bid security.
The Metropolitan Area Communications Commission reserves the right to reject any bids not in
compliance with all prescribed public bidding procedures and requirements, and may reject for
good cause any and all bids upon a finding of the Commiacion that it is in die public interest to
do so.
No bidders may withdraw his bid after the hour set for the opening thereof or before award of
the Contract, unlem said award is delayed for a period of 30 days.

INSTRUCTIONS TO BIDDERS
Art. l DEFINITIONS
1.1 All definitions are applicable as set forth in the Abbreviated Farm of Agreement
Between Owner and Contractor, AIA D)current A107, and Division E Supplementary
Conditions.
1.2 Bidding documents include the Advertisement for Bids, Instructions to Bidders, Bid
Foran and proposed Contract Documents including any Addenda issued prior to receipt
of bids.
1.3 Addenda are written or graphic instruments issued prior to execution of the Contract
which modify or interpret the bidding documents,including Drawings and
Specifications, by additions, deletions,clarifications or corrections. Addenda will
become part of the Contract Documents when the Construction Contract is executed.
Art. 2 BIDDER'S REPRESENTATION
2..1 Each bidder by making his bid represents that he has read and understand the biddir►g
documents.
2.2 Each bidder by making his bid represents that he has visited the site and familiarized
himself with the local conditions under which the Work is to be performed.
2.3 Bidders may visit the premise prior to bidding by contacting Mr. Sam Dana,Television
Engineer, at 629-8534 for appointments.
Art 3 BIDDING PROCEDURES
3.1 Each bid shall be made in accordance with Division C, Bid Form, and all blank spaces
in the form shall be filled; numbers pertaining to Base Bid shall be stated both in
writing and in figures. If bid is made by a partnership, it shall contain names of each
partner and shall be signed in the firm name followed by signature of artner signing for
firm. If bid is made by a c orporaticm, the corporate seal shall be affixed thereto. and it
shall be signed in the name of the corporation, followed by signature of officer
authorized to sign for corporation and printed or typewritten designation of office held
in corporation; and signature shall he properly attested by secretary of corporation.
Address of the bidder, street number(or post office box number), City and State, shall
he typed or printed on Bid Form.
3.2 A bid is invalid if it has not been deposited at the designated location prior to the time
and date for reoeipt of bids indicated in the Advertisement for Bids or prior to any
extensicxi thereof issued to the bidders. At time and place set for opening and reading
of bids, each and every bid received prior to scheduled dosing time for receipt of bids
Iwill be publicly opened and read aloud.
3.3 Unless otherwise provided in any supplement to these Instructions to Bidders,no
bidder shall modify,withdraw or cancel his bid or any part thereof for twenty(20)days
after the time designated for the rcoeipt of bids in the Advertisement for Bids.

3.4 Prior to receipt of bids, Addenda will be mailed or delivered to each person or firm
recorded by the Architect as having received bidding documents. Contrac toe-'
submitting a bid shall acknowledge receipt of each Addendum in Division C, Bid
Form,and be responsible for determining that all subcontractors,material suppliers,
etc.,have knowledge of said addenda and that their bid to him include same.
z.5 Two copies of the Bid Form will be furnished each bidder. One copy shall be
submitted and other retained by bidder.
3.6 The Bid Form invites bids on definite drawings and specifications. Only amounts and
information asked for on the Proposal furnished will be considered as the bid. Each
bidder shall bid upon the work exactly as specified and provided in the Bid Form.
3.7 Each bid shall be sealed in an opaque envelope and shall contain the Bid Form and
sw:ety for bid in form of Certified Check or Bid Bond The outside,front face, of
envelope shall show name and address of Owner, name of bidder and project name.
3.8 Each bid must be accompa_*ried by either a Certified Cheo-k drawn on a bank authorized
to do business in the State of Oregon and complying with ORS Chapter 279 and
executed in favor of Cwner for an amount equal to at least 10 percent of total amount

4.1 Each bidder sh All examine.,the bidding documents carefully and, not later than seven(7)
days prior to the date for receipt of bids,shall make w•itten request to the Architect for
interpretation or correction of any ar-rbiguity, inconsistency or emir therein which he
may discover. Any interpretation or correction will be issued in Addendum by the
Architect. Only written interpretations and corrections by Addendum shall be binding.
No bidder shall rely upon any interpretation or correction f;iven by any other method.
Art. 5 SUBSTITUTIONS
5.1 Each bidder redo, nts that his bid is based upon the materir►ls and equipment.described
in the bidding documents
5.2 No substitution will he considered unless written request has been received by the
Architect for approval at least seven(7)cakrndar days prior to the date for receipt of
bids. Each such request shall include a complete dmliption of the proposed substitute;
drawi cgs,cuts,performance and test data;additions to, deduction from,or revisions in
other's work necessitated by the u..w of proposed product, and any other(data or
information necessary for a complete evaluation. Request for approval too be in
duplicate with a self-addrr9sed stamped envelope. A sample copy of a 'Substitution

Art. 6 ACCEPTANCE OR RFJEU—nON OF BIDS
6.1 Bidder acknowledges the right of Owner to reject any cr all bids and to waive any
informality or irregularity in any bid received. in addition,bidder recognizes the right
of Owner to reject a bid if bidder failed to furnish any required bid security,or to
submit data required by bidding documents,or if bid is in any way incomplete or
irregular.
6.2 Bidde, acknowledges the right of Owner to consider competency and responsibility of
bidders and to award eontiact by drawing of lots between bidders involved if two or
more bids shall be for the same amount for the same work, and to return bid unopened
if only one bid is received.
6.3 Owner reserves the right to hold bid and bid security of three lowest bidders for a
period of 20 days after time of bid opening;and upon making award of Contract will
reject all other bids and return certified checks or bier bonds except for three lowest
bidders. Each of the three 1(7nst bidders may withdraw his bid and request return of
his bid security if his bid has not been accepted within 20 days after opening of bids.
6.4 The Owner reserves the right to instate and reinstate any or au alternate within 30 days
after award of Contract at same cost stipulated in bid.
6.5 Successful bidder will be notified by Owner or Architect of acceptance of his bid and
will be provided an Agreement between himself and Owner. Contractor shall then
execute the Agreement and provide Performance Bond and copies of required policies
of insurance within 5 days of said notification.
6.6 The Abbreviated Form of Agreement Between Owner and Contrac,or, AIA Document
A 107, as issued by the American Institute of Architects,will be used as the form of
agreement between Owner and Contractor.
Art. 7 PERFORMANCE BOND
The Performatra 5ond shall be executed in a statutory torn of Public Works Contract
Boad satisfactory to the Owner and shall comply with Chapter 279 of Oregon Revised
Statues,the provisions of which shall be incorporated therein and made a part thereof,
and with surety company licensed to do business in thn sate of Oregcxl.
The Performance Bond shall be in amoimt equal to 100 percent of the Contract Sum and
shall be flrmished in triplicate.

employees pursuant to the laws of the State of Oregon;prompt payments to all
persons supplying labor or material for any prosecution of the work provided

Section 279.320 of the Oregon Revised Statutes.

SUPPLEMENTARY CONDITIONS
The Following supplements modify,change, delete from or add to the Abbreviated Form of
Agreement Between Owner and Contractor(includes General Coditions), AlA Document
A 107, 1997 Edition. Where any Article of the Agreement or General Conditions is modified or
any Paragraph, Subparagraph or Clause thereof is modified or deleted by these supplements,
the unaltered provisions of that Artical, Paragraph, Subparagraph or Clause shall remain in
effect.
Art. 2 DATE OF COMMENCEMENT AND SUBSTANTIAL COMPLETION
2.1 The Work to be performed under this Contract shall be commenced upon receipt of a
signed Agreement Betwe;i,Owner and Contractor.
2.2 The Contractor shall achieve Substantial Completion of the entire Work not later than
April 15, 1989.
2.3 When the Work, or any separate portion thereof, is substantially complete, Owner shall
have the right Vi occupy same without violating any terms of the Contract.
In case of prior occupancy, Owner and Architect shall inspect area to he occupied and
Architect will list items of lite Work yet to be completed or corrected to indicate
progress or status of Contract to date of occupancy of area designated. This grant of
prior occuriancy will he set,forth in a Certificate of Substantial Compiletion indicating
areas to be occupied, items of the Work to be completed or corrected, date of
occupancy and signed by Architect.,Owner and Contractor indicating approval of such
occupancy.
Owner shall protect Contractor against any damage that may be caused by prior
occupancy and shall cooperate with Contractor to expedite the Work to its completion.
Occupancy of areas designated docs not relieve Contractor in any way of completion or
correcting any itern of the Work that is fcmrnd in noncompliance with Contract
Document upon final inspection of the Work as a whole.
Art. 4 PROGRESS PAYMENTS
4.3 Not later than ten days folowing the end of the period covered by the Application for
Payment ninety-five percent (950,40)of the portion of the Contract Sum properly
allocable to labor,materials and equipment incorporated in tl,e Work and ninety-live
percent(95%)of the portion of Contract Sum properly allocable to materials
and equipment suitably stored at the site or at some other location agreed upon in
wr:ting, for the period covered by the Application for Payment, less the aggregate of
previous payments made by the Owner, and upon Substantial Completion of the entire
Work, a sum sufficient to increase the total payments to ninety-rive percent(95%)
of the Contract Sum, less such amounts as the Architect shall determine for all
incomplete Werk and unsettled claims. The amount retained after Suhstwitiril
Completion of Work for all incomplete Work and unsettled claims will not be less than
two hundred percent(2.00%)of the value of incomplete Work and unsettled claims.
"Retainage" means the difference between the amount earned by the Contractor on the
Contract and the wimount paid on the Contract by the,Owner.

7.5 Miscellaneous Definitions: The term "provide"as used in Sections of Specifications
shall be understood to require the inclusion of all labor necessary to produce the
construction required by the Section and all materials, systems and equipment
incorporated in Work of the Section. I
g The term "furnish"as used in a Section of the Specifications shall be understood to
only require supplying to the project site, including delivery and unloading, the therein
specified materials and equi;oment to be incorporated or placed in the
construction.
7.6 Execution, Coorelation, Intent&. Interpretations: Should any discrepancy arise
between elements of the Contract Documents, precedence shall be given in the folowing
order:

Art. 13 CHANGES IN THE WORK
1 13.4 When a Change Order with cost to Owner is determined by-,ost and a percentage fee,
the percentage f-e shall l-e a maximum of fifteen percent(15%). This fee has been
determined to be a reasonable allowance for overhead and profit of the Contractor and
affected Subcontractors.
When computing Change Orders with cost to Owner, superintendence, performance
bond, and insurance shall be considered a part of overhead. Costs to the Contractor
and to Subcontractors shall be actual costs for materials, labor(including fringe
benefits), taxes, transportation and other items of labor and materials.
Art. 17 INSURANCE
17.7 At all tunes during the performance of die Work, the contractor shall carry liability
anti property damage insurm ,e covering all operations of the Contractor and all
persons employed directly or indirectly by the Contractor upon or in a,.nnection with
the Work. Policies shall be in form and with insurance company or companies
satisfactory to the Owner and licensed to do business in the State of Oregon.
This policy shall be the primary insurance, exclusive of any insurance carried by the
Owner, and the insurance evidenced by -ertificate shall he exhaused fust,
notwithstanding the fact that the Owner, have other valid collectible insurance
coveritig the same risk.

existing material and equipment to be reused in the Work when the Contract Documents
do not require the Contractor to correct ceMiin defects or to examine that material and

Art. 21 WAGE RATE LAW AND CERTIFICATION FORM
21.1 The Contracwr shall comply with all privisions of URS 279.350 regarding the
payment of the prevailing rate of pay for workers upon public works. Reference is
made especially to the requirements of ORS 279.348 to 279.356 which relate to wage
!,ates to paid on public works. The minimum rates of wage to be paid to workers
on this project shall be as published by the State Bureau of Labor and Industries for the
area of the project.
The Contractor and Subcontractors shall execute and submit to the Owner certificates
and affidavits pertaining to wages paid once before the first payment,each time the
prevailing wage rate changes, and once before final payment is made of any sum due
on account of a contract for a public work.

This booklet contains the Prevailing Wage Rates for the building and
construction trades in the State of Oregon. These rates are effective
January 1 , 1989. These rates have been amended in accordance with ORS
279.348 through ORS 279.365.
Prevailing Wage Rates are the minimum wages that must be paid to all
workers employed in the construction, reconstruction, major renovation or
painting of any public works. Copies of these rates must be incorporated
into all bid specifications when the advertisement for a public works
contract is issued. A provision that Prevailing Wage Rates be paid must
also be put in the contract. The rates in affect at the time the bid
specifications are first advertised are those that apply foi- the duration
of the project, with one exception; if during the bidding process the
Prevailing Wage Rates change, the public contracting agency has the
option of amending the bid specifications to reflect such changes.

rates determined for Oregon by the Secretary of Labor of the United States
pursuant to the Davis-Bacon Act; certain changes have been made to better
relect prevailing practices in Oregon. Pursuant to ORS 279.348 to ORS
279.365, these rates have been adopted for use on public works contracts in

Apprentices and Trainees
Apprentices and trainees may be employed on public works. To qualify as an
apprentice or trainee, the worker must bp registered in a bonafide
apprenticeship or training program of the U.S. Department of Labor, Bureau of
Apprenticeship and ?raining (BAT) or with an'v State Apprenticeship and
Training Agency recognized by BAT . The apprentice or trainee is to receive
all fringe benefits and a percentage of the journeyman' s wage rate; the
appropriate percentage shall be determined by the apprenticeship or training
committee. All other workers must receive rates as published.
Zone Pay
In certain trades, the basic hourly rate of pay progressively increases based
upon the distance between the job site and a designated landmark ; this is
commonly referred to as zone pay. To determine the hourly wage, find the
correct zone based on the number of road miles the job site is from the
closest designated city (based either on distance from city hall or from
geographical center of the city, depending on the trade) and add the amount
for that zone to the basic hourly rate. Zone pay, unlike travel pay, is the
basic hourly wage upon whicit overtime is computed.

Bid Specifications e
The specifications for Pvery public works contract must include the current
Prevailing Wage Rates in effect at the time the specifications are first
advertised. A statement incorporating the existing rates by reference will
not �3tisfy this requirement (ORS 2)9.352) .
NOTF : If a public agency fails to include the Prevailing Wage Rates in the
contract specifications or fails to include in the contract the
provision that. Prevailing Wage Rates must be paid, the liability for
any unpaid prevailing wages could be exclusively that of the agency.
Fringe Benefits
Payments for fringe benefits are in addition to the basic hourly rate. Fringe
benefits means the amount for:
a) medical or hospital care; pensions on retirement or death;
compensation for injuries or illness resulting from an occupational
activity, or insurance to provide any of IL-he foregoing;'
b) unemployment benefits, life insurance, disability and sickness
insurance or accident insurance;
c) vacation aid holiday pay;
d) defraying costs of apprenticeship or other similar programs; and
e) other Such bona fide benefits.
N01L : For the purpose of Prevailing Wage Rates, fringe benefits do not
include any benefits which may be required by federal , state or ,ocal
law (e.g. Workers ' Compensation, Unemployment Insurance, etc . ) .
Fringe beneFits may be paid to the worker in cash or to a third p.;rty
aoni;rnistering a fringe benefit program. When an hourly rate in excess if the
required prevailing base rate is paid, the amount by which the rate is
exceeded may be credited toward payment of fringe benefits.
Overtime
Workers employed on a public works job for more than eight hours in a day or
40 hours in a week must be paid overtime for each additional hour so worked
(ORS 279 .334) . Overtime is calculated at no less than one and one-half times
the basic hourly rate as determined by the Commissioner of Labor (not
including fringe benefits which are paid at the straight rate for every hour
worked) . In the computation of overtime, travel pay does not need to be
included but zone pi.,y differentials do.
Work performed on Saturday, Sunday or legal holidays must also be compensated
at time and one-half .T Legal holidays for purposes of Prevailing Wage Rates
include the following: 1 ) New Year' s Day on Jilouary l ; 2) Memorial Day on the
la,,t Monday in May; 3) Independence Day on July 4 ; 4) Labor Day on the first.
Monday in September, 5) Thanksgiving Day on the fourth Thursday in November;
6) Christmas Day on December 25.
NOTE Contractors who are signatory to a collective bargaining agreement
may be subject to different overtime requirements (ORS 279 .334[3]) .

Certification of Payroll
The law requires eve-y contractor and subcontractor to file certain
information on wages paid to each worker employed on a public works contract .
This statement must completely and accurately reflect payroll records for the
work week immediately preceding the submission. A contractor or subcontractor
must complete and submit the certified statement contained on Form WH-38 as
well as the information required on the weekly payroll side of the form. A
copy of Form WH-38 and instructions for completing it are included in the back
of this booklet; xeroxed copies may be used for filing.
The schedule for submitting payroll information is as follows: once within 15
days of the date the contractor or subcontractor first began work ori the
project and once before the final inspection of 'the project by the public
contracting agency; in addition, for projects exceeding_ 90 days, submissions
are to be made at 90 day intervals. Payroll information is to be filed with
both the public contracting agency and the Wage and Hour Division, Bureau of
Labor and Industries, 1400 S.W. Fifth Avenue, Portland, Oregon 91201 . The
payroll information must be kept by the contractor and or subcontractor for
three years .
COMMONLY ASKED QUESTIONS
1 ) What are "Prevailing Wade Rates?"
A prevailing wage rate is the minimum wage, including fringe benefits to
be paid workers employed on contracts for public works . Different rates
are established for specific trades and specific geographical areas .
2) Who must be paid "Prevailing Wage Rates?"
i All employees of a contractor or subcontractor engaged on a public works
project when the total price of the project is $10,000 or more must
receive at least the Prevailing Wage Rate (PWR) for time worked on the
project , unless otherwise exempt .
Supervisory and office/clerical employees are not required to be paid the
PWR. A person who owns and operates his/her own truck or other hauling
equipment on construction nrojects (Owner/Operator) is not required to be
paid the PWR.
3) What about contracts when Federal funds are ised?
When more 1.hin $2,006 of federal funds are involved, the contract is
usually subject to the provisions of the Davis -Bacon Act, not Oregon
statutes. Further information may be obtained from the U.S. Department of
Labor, Wage and Hour Division, Portland, Oregon (2.21 -305!) . However, in
the event that federal funds are involved, but the contract is not
regulated under Davis Bacon, Oregor's Prevailing Wage Rates Statutes may
apply (ORS 279.348 - 279 .365) .

4) I_ don't have a pension fund . How do I calculate fringe benefits?
Workers must receive at a minimum the sum of the basic hourly rate plus
all fringe benefits for each hour worked on a public works contract.
F-ringe benefits may be paid either to a third party trust account or in
cash directly to the worker.
5) What if the employees_are _non t paid on an hourly basis?
All workers must receive at least the basic hourly rate of wage and fringe
benefits for each hour worked on the project. If an employee is paid
other than on an hourly basis, the equivalent hourly rate (for both wages
and fringe benefits) must still be at least equal to the rates published.
6) How do I classify workers?
Virtually all of tle job classifications/trades normally used in the
construction industry are represented by the job classifications used in
this PWR publication. These classification titles should be used
according to common practice. Try to fit your workers into existing
classifi( ations. If you have questions about how to classify workers,
contact the Wage and Hour Division at 229-5750 in Portland or at one of
the offices listed on page 1 of this booklet.
Laborers who do basic work requiring no specific skills, training or
knowledge are generally classified as Group 1 laborers.
(Note that Landscapers are classified as Laborers, and Ornamental
Ironworkers are classified as Ironworkers . )
7) When are new rates determined? flow long are they effective? I
Prevailing Wage Rates are determined once each ,year by the Commissioner of I
the Bureau of Labor and Industries . The Commissioner may amend the rates
at any time. The rates are usually amended at least once each year. The
rates in effect at the time the bid specifications are first advertised
are those that apply for the duration of the contract, with one
exception. If during the bidding process the prevailing wage rate
changes, the public contracting agency (not the contractor) has the option
of amending the bid specifications to reflect such change.
8) How do I post Prevailing Wage Rates?
Every contractor or subcontractor employing workers on a public works
project is required to post the applicable Prevailing Wage Rates in a
conspicuous and accessible place in or about the work-site.
Rates need to be posted for the duration of the job. Contra tors and
subcontractors who intentionally fail to post the PWR can he made
ineligible to receive any public works contract for up to three years .

9) What can I do about a contractor who is not complying with Oregon ' s PWR
law?
File a complaint with the nearest office of the Oregon Bureau of Labor and
Industries or contact the Wage and Hour Division, Bureau of Labor and
Industries, 1400 S.W. 5th Avenue, Portland, Oregon 97201 (229-5750) .
Other Bureau offices are located in Bend (388-6330) , Coos Bay (269-4575) ,
Eugene (686-1623) , Medford (776-6013) , Pendleton (276-7884) and Salem
(378-3292) . You may also complain to the contracting agency, which has
the contractual authority to pay PWR claims directly to a contractor' s or
subcontractor's workers (ORS 279.314) .
10) What happens to contractors who do not comply with PWR statutes?
Contractors and subcontractors who pay less than the Prevailing Wage Rates
may be liable to the workers affected for the amount found due plus an
equal amount as liquidated damages (ORS 279.356) . Contracting agencies
also have the contractual authority to withhold payments due or to be due
to the coni-actor or subcontractor in order to pay the unpaid prevailing
wages directly to the worker (ORS 279.314) .
Contractors and subcontractors who intentionally refuse to ;iay the
Prevailing Wage Rate to workers employed on public works or to post the
PWR on the job site may be determined to be ineligible to receive any
public works contracts for a period of up to three years (ORS 279.361 ) .
Workers employed by the contractor or subcontractors have a right of
actio;i against the surety of the prime contractor for any unpaid
prevailing wages.
A list is kept of all contractors, subcontractors, and other persons
ineligible to receive public works contracts and subcontracts . When a
contractor or subcontractor is a corporation, the individual officers and
agents of the corporation can be debarred, in addition to the
corporaticn. As a result, individuals who intentionally fail to pay or
post the PWR are prevented from simply moving from one corporation to
another.
11 ) How much do I pay apprentices?
To qualify as an apprertice, the worker must be registered in a bona fide
apprenticeship program of the U.S. Department of labor, Bureau of
Apprenticeship and Training (BAT) or with any State Apprenticeship Agency
recognized by BAT . The apprentice is to receive all fringe benefits and a
percentage of the journeyman' s wage rate; the appropriate percentage shall
be determined by the apprenticeship committee. All other workers receive
rates as published.

12) What records must I keep? For how long?
Contractors and subcontractors are required to keep records necessary for
determining if Prevailing Wage Rates were paid. These records must
include the Payroll and Certified Statement Form ;WH-38) as well as the
following: The name and address of each employee; the ,-jork
classification(s) of each employee; the rate(s) of wages and fringe
benefits paid to each employee; the rates) of fringe benefit payments
made in lieu of those required to be provided to each employee; total
daily and weekly compensation paid to each employee; daily and weekly
hours worked by each employee; apprenticeship and training agreements ; any
payroll and other such records pertaining to the employment of employees
upon a public works contract.
These need to be kept for a period of three (3) years from the completion
of the public work contract. Records relating to public works contracts
must be maintained separately from records relating to private
projects/contracts.
13) What forms are ublic_agencies required to file with the Bureau of_ Labor
and Industries? _ _
Public agencies are required to prepare and file with the Commissioner of
the Bureau of Labor and Industries a list of every public improvement that.
the agency intends to fund during the subsequent budget period
(ORS 279 .023[2]) . If, after the original filing, the agency plans
additional public improvements, a revised list is to be submitted
(OAR 839-.16--008[2]) .
The "Notice of Award of Public Works Contract" is to be filed with the
Wage and Hour Division within 3C days of the date when a contract is
awarded which requires the payment of Prevailing Wage Rates ( i .e. , is
regulated under ORS 279.348 to 279.365) .
Copies of the "Planned Public Improvement Summary" (Form No. WH-118) , the
"Capital Improvement Project Cost Comparison Estimate" (WH-119) , and the
"Notice of Award of Public Works Contract" (WH -81 ) can be found at the
back of this booklet.
14) Does a contracting agency have any power to enforce payment of Prevailing
Wage Rates on its up blic works projects?
Yes . According to ORS 279. 314, all public contracts for work or services
must contain a clause or condition permitting the contracting agency to
pay a worker's past due wage claim, charging the payment against funds due
or to become due to Oe contractor.

INSTRUCTIONS FOR COMPLETING PAYROLL AND CERTIFIED STATEMENT FORM, WH-38 (Rev 3/84)
General : This form meets needs resulting from the 1983 amendments to the
rP evai'Ting Wage Rate Law. Under this amended law, the contractor is required to
pay not less than frinqe benefits as predetermired by the Bureau of Labor and
Industries, in addition to payment of not less than the predetermined rates. The
contractor's obligation to pay fringe benefits may be met ether i,

FRINGE BENEFITS -- Contractors who pay all required fringe benefits: A contractor who pays
rTinge`ben-evils To approves plans, Tun s, or programs in amounts not less than were
determined in the applicable wage decision of the Commissioner of the Bureau of Labor and
Industries shall continue to show on the payroll the basic cash hourly rate and overtime rate
paid to employees. Such a contractor shall check paragraph 4(a) of the Certified Statement
to indicate that he/she is also paying to approved plans, funds, or programs not less than
the amount predetermined as fringe benefits for each craft. Any exceptions shall be noted in
section 4(c).
Contractors who pay no frin5e benefits: A contractor who pays no fringe benefits shall pay
Yo—the employee,ann insert in the straight time hourly rate column of the payroll , an amount
not less than the predetermined rate for each classification plus the amount of fringe
benefits determined for each classification in the applicable wage decision. Inasmuch as it
is not necessary to pay time and a half on cash paid in lieu of fringes, the overtime rate
shall be not less than the sum of the basic predetermined rate, plus the half time premium on
basic or regular rate, plus the required cash in lieu of fringes at the straight time rate.
In addition, the contractor shall check paragraph 4(b) of the Certified Statement to indicate
that he/she is payingg fringe benefits in rash directly to employees. Any exceptions shall be
noted in Section 4(c).
Use of Section 4(c) , Exceptions
Any contractor who is making payment to approved plans, funds, or programs in amounts less
than the wage determination required is obliged to pay the deficiency directly to the
employees as crash in lieu of fringes. Any exceptions to Section 4(a) cr 4(b) , whichever the
contractor may chec�, shall be entered in Section 4(c). Enter in the Exception column the
craft, and enter in the Explanation column the hourly amount paid the employee as cash in
lieu of fringes and the hourly amount paid to plans, funds, or programs as fringes. The
contractor shall pay, and shall show that he/she is paying to each such employee for all
hours (unless otherwise provided by applicable determination) worked on the project an amount
notless than the predetermined rate plus cash in lieu of fringes as shown in Section 4(c).
The rate paid and amount of cash paid in lieu of fringe benefits per hour should be entered
in column 6 on the payroll . See paragraph on "Contractors who pay no fringe benefits" for
computation of overtime rage.
Column 7 - r.ross Amount Earned: Enter gross amount earned on this project. If part of the
employees'- - wage wasearl projects other than the project described on this payroll ,
enter in column 7 first the amount earned on the project and then the gross amount earned on
all projects, thus $63.00/120.00.
Column 8 - Deductions: Four columns are provided for showing deductions made. If more than
Tour deductions should be involved, use first 3 columns; show the balance of deductions under
"Other" column; show actual total under "Total Deductions" column; and in the attachment to
the payroll describe the deductions contained in the "Other" column. All deductions must be
in accordance with the provisions of ORS 652.610. If `.he employee worked on other jobs in
addition to this project, show actual deductions from gross wage, but indicate that
deductions are based on gross wages.
Column 9 - Net Wages Paid for Week: Self-explanatory.
Certified Statement Re uirzd by ORS 279.354: While this form need not be notarized, the
erre Sts emeit is subject to the penalties provided by ORS 279.990. Accordingly, the
party signing this required statement should have knowledge of the facts represented as true.
Space has been provident between items (1 ) and (2) of the Statement for describing ar,
deductions made. If all deductions made are adequately described in the "Deductions" column
above, state "See Peductions column in this payroll ." See paragraph entitled "FRINIJ

for a definite duration approved by the Owner.

Clean, repair, resurface or restore existing surfaces to their original condition,

where material is factory finished, in material manufacturer's standard calor

work. If such is not practical, refinish entire plane of surface in patch occurs.
E. All fluid applied materials are of same thickness and number of coats as for
like locations.

A. GENERAL
I . Do all work in accordance with regulations of serving electrical utility, National
Electrical Code, National Electrical Safety Code, National Firecoeles, and otiter
applicable codes.
2. Whenever the requirements of the Electrical Specifrrations or Drawings exceed
those of the applicable code or standard, the requirements of the Specifications
and Drawings shall govern.
3. This Contractor is bound by the General Conditions, Supplementary
Conditions, Special Conditions, and Division 1 bound herewith in addition to
this Specification and accompanying Drawings.
4. Bidders shall view the site and shall include all costs incurred by existing
conditions in the hid proposal.
13. QUALITY ASSURANCE
