MINOR LAND PARTITION MLP 90-0014
EARL AND 1ARGERY BARDELL - APPLICANT/OWNER
APPLICATION: A request for Minor Land Partition approval to divide one parcel
of approximately 2.95 acres into 2 parcels of approximately 12,000 and 116,502
square feet. ZONE: R-4.5 (Residential, 4.5 units per acre) LOCATION: 1.5070
SW Blot Street (WCTM 2S1 12CB, tax lot 100)
DECISION: Notice :is hereby given that the Planning Directors designee for the
City of Tig&rd has APPROVED the above described application SUBJECT TO CERTAIN
CONDITIONS. The findings and conclusions on which the decision is based are
noted below.
A. FINDING, OF FACT
1. Background
The s,xbject property was annexed to the City in May, 1982 (Boundary
Commission Proposal Number 1820) . No other applications for this
property have been reviewed by the Planning Division.
2. Vicinity Information
Parcels immediately to the southwest are zoned R- 7 (Residential, 7
units per acre) . All. other surrounding parcels are zoned R-4.5.
All surrounding parcels aro either developed or are presently
developing with cjngle family residences.
3. Site Information and Proposal Def,cription
The subject site f ants SW 81st Avenue. A single-family residence
is locattad in the southwest quadrant of tho site. A freestanding
carport is located at the rear of the north side of the residence.
There is an sicce"s o:ive which to blocked by a chain link crate
located on tha south eine of the rPeidence= directly across .from
the termiius of SW Rose Street. There are a variety of deciduous
and everg,-een trees located around the residence and a vegetable
garden located on the northern side . A substantial amount of
natural brush .in located at the northorn and northeastern portion"
of the site with the balance of the site covered by natural
grasses.

4. Agency and NPO Comments
The Engineering Department has the following comments:
a. Both of the proposed parcels front to S.W. 81st Avenue, a
local street requiring a right-of-way 50 feet in width. The
street is unimproved except for a narrow paved roadway.
Subsection 18.164.030 A.l.c(v) of the Cade permits the
Director to accept a future improvement guarantee in lieu of
street improvements on property zoned residential if the
proposed lard partition does not create any new streets. No
additional street improvements have been constructed along the
adjacent parcels and the owner of the parcel on the opposite
side of S.W. 81st Street was required to provide a future
Improvement guarantee in lieu of street improvements as a
result of MLP 89-10. Cone,?quently, a future improvement
guarantee in lieu of street Improvements is acceptable.
b. The parcel Blopen eastward, away from S.W. 81st Avenue. This
results in the smaller parcel draining towards the larger
parcel requiring on-e.ite disposal of rainfall runoff from the
smaller parcel.
C. Sanitary sewer service is provided by an exinti.ng ]].no in S.W.
81st Avenue. However, this line may not be deep enough to
serve the site if the larger parcel is further subdivided.
d. An erosion control plan will be required as hart of the
buildin-4 permit submittal. The plan shall conform to "Erosion
Control Plans - Technical Guidance Handbook, Novrmber 1989."
Storm water management facilities c,r a fee in lieu of their

The Building Department has the follo.4ing comments:
a. A plan showing the locations of the private utilities for the
existing house must be provided., If the utilities will erose
new property lines, they shall, be provided with easements.
b. If the new lot is going to have a strr►cture constructed on it,
there must be some consideration given to how the storm
drainage is to be provided In this area. If :there is no
public storm sewer in the street, or no storm drain ditch,
will it be acceptable to discharge storm water directly onto
the street? If the applicant is not required to provide a
public system, then a condition of approval shall. be, a
private onsite storm drainage system is to be provided as
approved by the Building Division.

C. if the properties are to connect to the public sanitary sewer,
they shall show proof of participation in the cost of
construction of the public sewer, or be subject to a $3,000.00
"In Lieu of Assessment" fee.
Fire District #1, School District 23J, NPO #5, Portland General
Electric, General Telephone, and Tigard Water District have
reviewed the proposal and have no objections to it.
No other comments have been received.
B. ANALYSIS AND CONCITISION
The proposal meets the minor land partition approval criteria of Section
18.162.040 (Partition Approval Criteria) . It conforms with the City's
Comprehensive Plan and complies with all statutory and ordinance
requirements and regulations. All proposed lots conform to the 7,500
square foot minimum lot size and dimeneion.rl requirements of this title.
C. DECISION
The Planning Director's designee for the City of Tigard APPROVES
MLP 90-0014 subject to the following conditions:
THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO RECORr.ING THE MINOR
LAND PARTITION WITH WASHINGTON COUNTY.
1. A Plan shall be submitted showing the locations of the private
oti.litiNs for the existing house. If the utilities will crone new
property lines, they shall he provided with easements. STAFF

2. A partition survey plat and an outbound description shall be
submitted to the Engineering Department before recording. The plat
shall clearly show any public utility or sewer easements. STAFF
CONTACT: John Hagman, Engineer-'.ng Department X639-4171) .
Additional right-of-way shall be dedicated to the Public along the
S.W. 81st Avenue frontage to increase the right--of-way to 2.5 feet
from the centerline. The description shall be tied to the existing
right-of-way centerline. The dedication document shall be on City
forme. Instructions are available from the Engineering Department.

4. An agreement shall be executed by the applicant, on fnrsds provided
by the City, which waives the property owner's right to oppose or
remonstrate against a future Local Improvement District formed t-:)
