APPLICATION: Request by J2M3, I:nc. , for Lot Line Adjustment approval to
adjust two parcels of 14,200 (Tax Lot 1200) and approximately 19, 166 square
feet (Tax Lot 1300) through transfer of a 10 foot by 100 foot area so as to
result in parcels of 15,200 and 18,166 square feet; for Minor Land Partition
approval to partition Tax Lot 1200 into two parcels of 7,600 square feet each;
and to approve a Variance to the Community Development Code' s standard
depth-to-width ratio of 2.5: 1 to allow a ratio of 3: 1 . The parcels are zoned
R-4.5 (Residential, 4.5 units/acre) . Location: 141475 SW 81st Avenue and 8200
SW Bonita Road (WC:T'M 2S1 12BC, lots 1200 and 1300) .
DECISION_: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described applications subject to certain
conditions . The findings and conclusions on which the Director based his
decision are as noted below.
A. FINDING OF FAC:f
1 . Background
A Minor Land Partition application for this property was approved in
December 1985 (MLP 16-85) . In December 1986, the applicant was
granted a six--month extension of this approval . Because of a request
by the Engineering Division to modify and update certain conditions of
approval, the approval was amended by the Planning Director and a new
decision issued (MLP 87-03) . The primary amendments to the decision
concerned replacement of earlier conditions of approval related to
required half-street improvements with a requirement that a
nonremonstrance agreement for future improvement of SW Bonita Road and
SW 181st- Avenue be executed. The nun--remonstrance agreement and other
conditions of approval were accomplished and the p_!rtition recorded
with Washington County. Tax Lot 1200 was one of three lots created by
the partition.
2. Vicinity Information
Parcels to the north and west of the subject properties are zoned R--7
(Residential, 7 units/acres) . The subject parcels and parcels to the
south are zoned R-4.5 (Residential, 4,5 units/acres) . A single family
residence has been curistructed on the parcol located immediately north
of Tax Lot 1200.
3. Site Information and Proposal Description
'Tax Lot 1200 in currently undeveloped, cleared, and moder•tate i v sloped
to the northeast. The lot fronts on SW 81st Avenue. An eight-inch
sanitary sewer liner with I.wo 4- inch laterals has been installed along
tho western edge of the property. A 4-:inch roof drain line has also
been installed.

Tax Lot 1300 currently contains a single family residence on tho -
northern half of the lot. The applicant proposes a Lot Line
Adjustment to transfer a ten-foot wide by 100-foot long area from the
southeast corner of Tax Lot 1300 to be added to Tax Lot 1200. The
house on Tax Leat 1300 would continue to i:ieet required setbacks of the
R--4.5 zone. Tax Lot 1300 would Lhen be 18, 166 square feet in size.
The resultant size of Tax Lot 1200 would be 15,200 square feet. The
applicant proposes to partition this lot into two lots each measuring
50 feet wide by approximately 152 feet deep. Both parcels would be
served by the newly installed storm and sanitary sewer laterals.
Because the lots that would result from this partition would have a
depth to width ratio of 3: 1 when the Community Development Code iAllows
a maximum ratio of 2.5: 1, t-he applicant- requests a variance to this
requirement.
4. Agency and NPO Comments
The Engineering Division commented that a joint use and maintenance
agreement for the private storm sewer, serving Lhe proposed parcels and
the two parcels to the north needs to be recorded. In addition,
cleanouts for the storm sewer need to be installed at the south end of
the line and somewhere in the middle of the line so that the cleanout:
is no more than .100 feet from both the end of the line and from Bonita
Road.
The Building Division, PGE, GTE and Tigard Water District reviewed the
proposal and offered no comments. No other comments were received.
B. ANAL.YS*lS AND CONCLUSION
The proposed Lot Line Adjustment meets the approval criteria set forth in
Chapter 18. 162.060 of the City of Tigard Community Development Code and
conforms with the Comprehensive Plan. Both parcels would continue to meet
the minimum lot size requirements of the R-4.5 zone. No structure
setbacks would be affected by the proposed Lot Line Adjustment since no
structures presently exist on Tax Lot 1200 and the residence on Tax Lot
1300 is far enough removed from the area of adjustment that setbacks are
riot impacted.
The Communitv Development Code allows for approval of a Minor Land
Partition if the proposal complies with the Plan, statute and ordinance
requirements, dimensional requirements of the applicable zone, City and
service providing agency public improvement standards, and if adequate
public facilities are available to the site. In this case, these criteria
are satisfied with the exception of noncompliance with the Code
requirement for maximum depth--to--width ratio.
Code Section 18. 134.050 provides for granting Variances to requirements of
the Ce-de upon determination that the variance will not be detrimental to
adjacent properties and physical and natural systems. and that City
st.Wndards will be maintained to the greatest extent reasonably possible by
minimizing the extent- of the variance. In the present case, the requested

variance to the depth-to-width ratio is minimal (20%) and will have no
foreseeable detrimental effects on adjacent properties or physical and
natural systems. The primary intent of the required depth-to-width ratio,
to prevent the creation of large lots with the potential for additional
building sites that cannot easily receive access because of the narrow .lot
width, will riot be violated in the present case because the lots created
are approximately the sire of the minimum lot size and therefore have no
potential for additional partitioning. The criteria, therefore, are
satisfied.
C. DECISION
The Planning Director, approves M 87-20, MLP 87-•-12, and V 87--26 subject iu
the following conditions. The conditions shall be met prior to recurding
the lot line adjus{:ment and minor- partition with Washington County. The
conditions shall he met to the satisfaction of the Engineering Division.
1 . Three copies of the lot line adjustment and partition survey and .legal
descriptions shall be submitted to the City for review and approval. i

2.. A joint use and maintenance agreement fur the private storm sewer
shall be. executed by the applicant. The agreements shall be
referenced on and become part of all applicable parcel deeds. Staff

3. Cl.eanouts shall be installed at the end of the private storm sewer
line and at some point in the middle of the line that .is no greater
than 100 feet from either end of the line. Staff contact: Gary Alfson
4. This approval is valid if oxercised within one year of the final
decision date rioted below,
