A. FINDING OF FACT
1. General Information
CASE: MLP 10-83
REQUEST: To partition one parcel of 37,462 square feet into three
parcels of 8,400, 8,400, and 20,662 square feet.
COMPREHENSIVE PLAN DESIGNATION: Medium Density Residential
ZONING DESIGNATION: R-12 Family (Multiple Family Residential, 12
units/acre)
RECOMMENDATION: Approval subject to the conditions listed in this
report.

LOT AREA: 37,462 square feet
NPO COMMENT: NPO #5 has not responded in writing to this request.
2. Background
No previous actions have been taken on the property.
3. Vicinitv Information
The zoning to the south and west is also R-12. Most of this area
consists of large lots except for Bond Park I subdivision which has been
recently recorded. Small acreage parcels to the north are zoned R-7
(Single Family Residential, 7 units/acre) and the area to the east is
j zoned I-P (Industrial Park) . 'the Fenno Creek floodplain is adjacent to
the eastern property line.
4. Site Information
The property is presently developed with one residence which is proposed
to be located within the 20,661.6 square foot lot. The two 8,400 square
i foot lots are presently undeveloped. A 15-foot wide panhandle on the
north side of the property will be retained as part of the larger parcel

also proposed to have a 15—foot vide panhandle extending to 76th Avenue
immediately south - the access strip for the lar -r lot. the western
8,400 square foot t will have direct access to t, Street.
5. Agency Comments
The Engineering Division has the following comments:
a. The existing sanitary sewer line in the 76th Avenue right-of-way
shall be extended southerly to the south property line to provide
service to the property and allow for future extensions to the
south.
b. A sanitary sewer completion agreement and performance bond will be
necessary to ensure construction of the line extension.
C. A non-remonstrance agreement shall be signed regarding future
street improvements on 76th Avenue.
d. An additional 5 feet of right-of-way shall be dedicated along the
76th Avenue frontage.
Written responses have not been received from any other reviewing
agencies.
B. ANALYSIS AND CONCLUSIONS
The proposed partitioning is consistent with the applicable standards
and policies contained in the Development Code and Comprehensive Plan.
Standards relating to lot width and area, and setbacks can be met by
this request. It should be noted that the configuration of the large
lot should allow for compliance with setback requirements for the R-12
zone.
If the paved driveway is located within 10 feet of the northern property
line, screening must be provided on the north side. If a common drive
is anticipated for the two flag lots, reciprocal easements must be
recorded with the approved partitioning map.
C. RECOMMENDATION
The Planning staff recommends approval of MLP 10-83 subject to the
following conditions :
1. Construction of proposed public improvements noted in A.5 above
shall not commence until after the Engineering Division has issued
approved public improvement plans. The Engineering Division will
require posting of a 100% performance bond, the payment of a
permit fee, the execution of a street opening permit, and
construction compliance agreement (for sanitary sewer) just prior
to, or at the time of, its issuance of approved public improvement
plans.
