DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above decisions subject to certain condition. The findings and conclusions on which the Director based his decision are as noted below. A. FENDING OF FACT 1 . Background Information A Lot Line Adjustment (M -86) was recently approved by the Planning Director involving the subject property and the parcel immediately to the west. 2. Vicinity Information Properties in all directions are zoned R-4.5 (Residential, 4.5 units per acre) . 3 . Site Information and Proposal Description The subject property is presently undeveloped. The applicant has decided riot to implement: the lot line adjustment and has determined that a partition would be preferable. The smaller parcel will have frontage on Pinebr•ook Street and the large parcel will have access to the street via an easement across t!ae property to the west which .is also owned by the applicant. In addition, the applicant proposes to constr•u,.t an accessary building to the used in conjunction with the residence on the parcel immediately west for storage of a boat and recreational vehicle. The structure will be located on the northern portion of the 15,357 square foot parcel . A variance is requested to allow a size of 769 squ,4re feet and height of 21 feet at the peak of the roof. 4 . The location of the storm drainage and sanitary sewer lines, which are designated as approximate on the applicant submittal, shall be. positively identified prior to issuance of building permits. Should the lines lie on the applicant' s parcel or be so situated that conveyance of a public easement is desirable in order to facilitate City operation and maintenance thereof, such shall be done by the applicant prior to issuance of a building permit or recording of the partition. b. A joint use and maintenance agreement should be executed for the common driveway for the proposed northern parcel and the property to the west. C . the parcel contains a drainageway and depending upon the location of future development, a Sensitive Lands approval may be necessary to ensure adequate storm drainage. The Building Inspection Division has no objection to the proposal but it advises that adjacent neighbors should be notified of the proposed building size. The Tigard Water Di.stcict, P.G.E. , Tualatin Rural Fire Proteotion District, and Northwest Natural Cas Co. have no objection to the request. NPO #6 supports the partition proposal . B. ANALYSTS AND CONCLUSIONS The proposed partition is consistent with Community Development Code requirements for minimum lot size (7,500 square feet), and lot dimension in the R-4 ,5 zone . Additional dizcussion is warranted relating to access, a public sewer line which crosses the property, a drainageway on the east side of� th Rarcel, and the variance request, l. . Access The Code requires that an accessway serving two parcels have an easement width of 25 feet. the strip of land on the westerly adjoining parcel is 20 feet wide and is developed with a driveway , In order to meet the Code, a 5 foot wide access easement should be provided along the western side of the proposed 7,686 square foot parcel in order to comply with the 25 foot standard. 2. Sewer Lines A public sewer line crosses the subject property as well as the parcal to the west, but the exact location ha• not been verified. The application illustrates the line alignment based upon the manhole locations. The proposed accessory structure will not encroach upon the line or the necessary easement and sufficient building area is available on the proposed northern parcel (15,357 square feet) . As suggested by the Engineering Division, the line location should be verified in order to assure proper maintenance of the sewer system. Drainageway A drainageway runs downhill. to the north along the easterly property boundary. the proposed partition and accessory building will have no appreciable effect upon the drainageway . Both parcels will have adpqu«te buildable area to allow the retention of this low area. If any fill or construction is to occur within the drainageway, a Sensitive Lands approval must first be granted by the City to ensure that adequate drainage capacity will be. maintained. 4. Variance Accessory structures are allowed outright in residential zones with a maximum area of 500 square feet and a height of 12 feet. A variance which meets the criteria contained in Section 18 , 134.050 of the Community Development Code must be granted prior tc constructing a larger building. The relevant criteria are listed below: 1. The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity . 2 . There are special circumstances that exist which are peculiar to the lot: size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; 3 . ThH use proposed will be the same as permitted under- this Code and City standards will be maintained to the greater extent that is reasonably possible, while permitting some economic use of the land; 4 . Existing physical and natural systems, such as but not. limitcd to traffic, drainage, dramatic land forms or parks will not be. adversely affected any more than :•+ould occur if the development were located as specified in the Cade; and 5. The hardship is not self--imposed and the variance requested is the minimum variance which would alleviate the hardship. The primary purpose of the size and height restrictions for accessory structures is tj prevent the location of large structures in close proximity to residential uses . The proposed building will be larger and taller than permitted by the Code but the building will have three times the required setback (15 rather than 5 feet) from the north and a larger setback from other property lines . The 15 foot rear yard setback conforms with the zoning requirement for a residence. Also, there is a considerable amount of vegetation on the subject property and surrounding parcels which acts as a visual buffer. The closest: residences to the nort'i are over 30 feet and approximately six feet above the floor elevation for the proposed building. . With a total area of 15,357 square feet for the proposed lot containing the building, adequate space would be available for two accessory buildings at 500 square feet each. One building rather than two or more would appear to be a more desirable option. C. DECISION The Planning Director approves MLP 6-86 subject to the following conditions. 1 . UNLESS OTHERWISE NOTED ALL. CONDITIONS SHALL BE MET PRIOR TO RECORDING THE PARTITION WITH WASHINGTON COUNTY. 2 . The partition survey and legal descriptions shall be submitted to the Planning Director for review and approval PRIOR TO RECORDING. 3 . Joint use and maintenance agreements shall be executed and recorded on City standard forms for the common driveways.
