Dear Mr. Coleman:
I am writing is response to your recent request to locate a retail
business selling wooden planters, benches and tables, referred to
as The Box Works, at 15630 SW Pacific Highway, otherwise referred
to as WCTM 2S1 IODC, tax lot 200.
This property is zoned C-G (General Commercial ) . The proposed use
of this site is listed as a Permitted Use for this zoning
designation. The Community Development Code Site Development
Review Section states that if the requested modification meets any
of the major modification criteria, that this request shall be
reviewed as a new Site Development Review application.
This request does not meet any of the 11 approval criteria for
qualification as a major modification as listed in Section
18. 120. 070(8) . This is specified as follows:
1) Dwelling unit density will not be affected since this is a
commercial use;
2.) Dwelling unit .,ensity will not be affected since this is a
commercial use;
3) This change will not increase the need for additional on-site
parking. The nature of this use is as a temporary retail
site. The site contains a very large central parking,
maneuvering, and stacking area which will easily accommodate
this use in conjunction with the existing drive through coffee
trailer near the front of the site.
4 ) The requ .t will not result in a change .in the type of
commercial or industrial structures . The proposed temporary
retail use is to be located primarily within an existing
greenhouse which was placed on-site when this property was
used as a retail plant nursery (Garde.rners ' Choice) . This
proposed use will also utilize a portion of the grassy area on
the south portion of the site;
5) The height of the existing structures will not be altered;
6) The request will not result in a change in the type an'I
location of accessways and parking areas where off-site
traffic would be affected. The proposed use is projected to
generate less traffic that the previously approved plant
nursery use. The location of this business shall. not
interfere with the circular traffic pattern previously
approved for the drive-through coffee service. Therefore, the
parking and traffic circulation area near the drive-through
coffee service shall not be affected. Ingress and egress to
the site shall remain the same as currently exists;
7 ) The modification will not produce an increase in vehicular
traffic to or from the site in excess of 20 vehicle trips per
day. The proposed use is projected to generate less traffic
that the previously approved plant nursery use;
8) The request will not result in a change in the floor area
proposed for nonresidential use by more than 10 percent. This
c_�teria does not apply since the expansion is less than 5,000
square feet;
9) The request will not cause a reduction of more than 10 percent
of the area reserved for common open space and\or usable open
space. The majority of this site is open spare as designed
for the previous use;
10) This request will not cause the elimination of project
amenities by more than 10 percent. This use will utilize
existing facilities which are present on-site; and
11) The request will not modify conditions of approval imposed at
the time of site development review approval for the pre-
existing use as this use has relocated to another portion of
the city.
Please note: This approval shall be conditioned upon compliance
with the following items .
1) The Box Works shall be located as shown on the attached site
plan. This is to ensure adequate opportunity to provide
stacking for a minimum of ten vehicles for the existing mobile
coffee use in addition to providing adequare traffic
circulation for additional uses on this site.
7.) Sign permits shall be obtained from the Planning Division
prior to the instillation or use of an_y sign on this site.
3) The applicant shall obtain the consent of the property
owner. (s) , or a legal representative, prior to the installation
of any modifications or improvements on this site.
4) Display of any signs or, items for sale shall_ be at :least 30
feet behind from the driveway entrance so as to no compromise
visual clearance near the southern driveway.
In light of the above analysis, this request is determined to be a
minor modification to an existing site. The Director's designee
has determined that the proposed minor modification of this
eXisting mite will not be significantly detrimental nor injurious
to surrounding properties provided that development which occurs
after this decision complies with applicable local state and
federal laws .
Therefore, this request has been approved.
