The back portion of the lot is undeveloped although the land has been scraped and leveled in preparation for development. The applicant is proposing to build a F 0 square foot day care center on the back portion of the property. Agency and NPO Comments Tne Engineering Division has reviewed the proposal and makes the following comments: a. It is conceivable that tax lot 900 could be partitioned in the future. Although we recommend that the easement along the west boundary line of tax lot 800 be a private right--of_w,,4.y, the applicant should be advised that if lot 900 were ever to be partitioned and the proposed building was to be constructed and connected to the line now proposed to be installed to serve the new building„ Such future building connection world need to be via a separate service line run to a public sewer line and not to a private line. b. Concrete sidewalk, curb, and driveway aprons already exist. The Building Division has reviewed the proposal and makes the following comments : An easement will be required for. the storm and sanitary sewer crossing over adjacent properties. NPO N3 has reviewed the proposal and makes the following comments: It seems that this violates buffering requirements between residential and commercial , The playground is one of the main activity centers of day care and it is right next to back yards of homes with no setback. A six foot brick or concrete wall should be required if nothing else. B. ANALYSIS !!arklnq The required number of parking spaces for a day care use is five space per classroomspaces plus one . As proFosed, the development would provide ,new spaces in addition to parking already existing as part of the Gaarde Park Plaza complex . Of these, 8 are wholly located on tax lot 900. With the inclusic,n of these parking spaces, 11 spaces will be provided on the subject property. In addition, portions of 3 other parking spaces are located or, tax lot 900. Since 7 classrooms are proposed for the day care, 12 spaces are needed. Because of the unusual situa':ion of having 3 partial spaces on the property along with 11 full space::; it is determined that the park irig requirement will be met. Under provisions of the Community Development Code (CD), one handicapped parking spa(::' shall be provided with this development. This will need to be placed as near the main point of entry to the center as possible. Access and Egress The property will be using acce:.s an(j egress on Pacific Highway . Although current access will occur in conju,•icti.)n with the Gaarde Park Placa complex, an access permit will be required from the Star.e Highway Division. Landscai_ng and Screening Because the property being commercially developed i.s contiguous to a residentially zoned area, spnrial provisions for screening out noise and activity are required . Section 18. 1.00. 130 of the Community Development Code (CDC) stipulates that a ten foot buffering strip must: be provided along the edge of the commercial property that abuts the residential area. The applicant has indicated on the site plan that the landscaping and buffering requirement will be met with a combination of vine maples and shore pine trees in conjunction with a chain link fence on the interior of the property line faced with a five foot redwood slat fence on the exterior. The testimony received at the hQaring indicates that the abutting neighbors are concerned about: the noise generated by the children in the outdoor nlay area. in order to more adequately address this issue, the Commission proposes that the applicant provide a revised plan for- noise buffering. C. CONCLUSION The appellant contends that the day care is no: an appropriate use in this situation and should not be permitted , The Commission finds th:.-At "day care facilities" are a permitted use in the C-G zone (Cormuni.t,y Development Code, Section 18.62.030[2]) and there is no basis in the Code to deny the usc . Also, the proposed development meets all Code requirements for building setbacks, height, and landscaped area. The Commission finds that the amendment to the original site and landscc.ping plan as noted below in Condition 6 will address noise and buffering c,�ncerns as provided in Chapters 18 .90 (E:nvi.ronmental. Performance Standards) and 18. 100 (1_andscpaing and Screening) and Section 18. 120. 18 (^ite Development Review approval standards) in the Community Development Code. D. Prior to building occupancy, the site and landscaping plans shall be. modifieJ to include a four foot high berm, heavy vegetation and site obscuring fence along the north and west property lines and sound absorbing panels on the north and west sides of the building. In addition, an acoustical engineer shall prepare a recommendation for Planning Director apprestal which meets or exceeds the sound absorbing capability of the above modifications. The Planning Director shall review the recommendation with both the applicant And the apellant. A revised site/landscaping plan shall then be developed which is consistent with the acoustical enginel+r' s recommendation. 7. The landscaping materials shown on the approved plan (Condition N6) shall be installed prior to occupancy . R. The proposed private sanitary and storm sewer sy:;t.em details shall be provided as part of the Building Permit plans. 9. The proposed (privately operated and maintained) parking lot and access details shall be provided as part of the building permit plans. It shall be constructer' to a local street structural standard. 10. This approval is valid if exercised within one year of the final decision date noted below. Background A portion of this prr.perty was initially developed when the Gaarde Park Plaza shopping center (SDR 21--78) was developed. At that time only the eastern half of the parcel was utilized for the development, that portion being used for a parking lot.
