A fire and life safety plan review was conducted on the abc- - captioned
project for compliance with the 1985 editions of the Uniform Building Code
(iJBC) , Uniform Mechanical Code (UMC) , and Uniform Fire Code (UFC) as amended
by Tualatin Rural Fire Protection District's Ordinance 86-5.
1. Firestoppi.ng: In all wood framed walls and partitions, firestopping
consisting of 2-inch nominally-sized lumber or other approved
materials must be installed at all floor and ceiling levels
Penetrations in this prescribed firestoppi.ng to accommodate wiring,
plumbing, and other similar utility runs must be packed with
noncombustible materials in an approved manner so as to prevent the
passage of flame. (UBC Sec. 2516)
2. Inspections Required: Insp-etion and approval of construction by a
representative of tFAs office is required: (a) prior to the cover of
any new framing elements following the installation of all utility
runs which will be concealed within well and partition cavities; (b)
upon completion of construction and prior to occupancy of the tenant
space. (UBC Sec. 305)
3 . Approved Plans on Job Site: One set of approved plans bearing the
stamps of the Tigard Building Department and this office must be
maintained on the project site throughout all phases of construction
and must to made available to building and fire inspectors for
reference during required construction inspections. JJBC Sec. 303)
4 . Certificate of Occupancy Required: Prior to the use and occupancy of
the project (space), a certificate of occupancy or other written
instrument of approval must be obtained from the City of Tigard
Building Department. (UBC Sec. 307)

I discussed the method of installation for the HD 5 's with
our structural engineer, Sam Holmes . He .stated that the
design loading for these holdowns were not in a critical
range and the modifications were acceptable .

to the anchor bolts , and the holdowns have been located
the required 5 -1114" from the sill .
The formed upper 3/4" dia. machi_ie bolt was .ised for the
new lower bolt hole, and a 5,18" dia. x 5" long lag screw
was used in the upper hole .
With regard to your earlier inquiry about using staples in
lieu of nails , for 1; 2" plywood with all edges blocked,
the : 4 gauge x 2" long staple at 3" o. c . at panel edges
and 6" o . r_ . at intermediates will provide adequate shear
strength.

4. Agency and NPO Comments
The Engineering Division is opposed to the variance primarily
because of the apartment units at the end of Walnut Place and the
lack of any sidewalks at the present time.
The Builoing Inspection Division has no objection to the request.
NPO N1 re,:ommends denial of the variance.
P . ANALYSTS AND CONCLUSION
Section 18. 134 .050 of the Code requires the following approval criteria
for variance proposals;
1 . The proposed variance will not be materially detrimental to
the purposes of this Code, be in conflict with the policies
of the Comprehensive Plan, to any other applicable policies
and standards; and to other properties in the same zoning
district or vicinity;
2. There are special circumstances that exist which are
peculiar to the lot size or shape, topography or other
circumstances over which the applicant has no control, and
which are not applicable to other properties in the same
zoning district;
3 . The use proposed will be the same as permitted under this
Code and City standards will be maintained to the greatest
extent that is reasonable possible, while permitting some
economic use of the land;
4 . Existing physic:a] and natural systems, such as but riot.
limited to traffic, drainage, dramatic land forms or parks
will not be adversely affected any more than would occur if
the development were located as specified in the Cade; and
5. The hardship is not self--imposed and the variance requested
is the minimum variance which would alleviate the hardship.
Policies 8 . 1 . 1 and 8. 1 .3 of the Comprehensive Plan call or
the provision a safe street- system and sidpwalks . The
deletion of this sidewalk would cause pedestrians to walk in
the street or to cut through pri-jate property . There do not
appear to be any peculiar circumstances which would make the
installation of a sidewalk impractical or unfeasible.
Based upon the above findings, the proposed variance i5 not

The landscaping plan that was approved as part of SDR 17-85
did not include the sidewalk which is the subject of this
rec•aest. However, this plan was approved with the
understanding that the proposed landscaping area3 on the
southern Walnut Place frontaqe would need to by shifted five
foot to the north if the Variance was not. approved. The
Code requires that parking and loading areas be buffered by
landscaped areas that are a minimum of thrpo feet: in width.

No previous land use applications have been revieweJ by the City
on the subject property.
2. Vicinity Information
The properties to thc, northeast and southwest along Pacific are
also zoned C-G and are devoted tv commercial uses. Parcels to the
south are zoned R-12 (Residential, 12 units/acre) and are
delieloped with apartments and a church. The property is located
to the east At the and of Walnut Place is developed with

street opening permit or construction compliance agreement shall
occur prior to, or concurrently with the issuance or approved
