APPLICATTO_N: Request by Rick Wilder on behalf of Tri-City Baptist Temple for
approval of a Temporary Use Permit to allow operation of to stand to sell.
fireworks from June 23 to July 6, 1906 at Tigard Plaza. The property is zoned
C-G (General Commercial) (WCTM 151 35DD Lot 3301) .
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above application subject to certain conditions . The
findings and conclusions on which the Director based his decision are as noted
below,
A. FINDING OF FACT
1 , Background
No temporary use permits have been sought for this site
previously. Similar temporary uses have been granted at other
sites throughout the city ,
2. Vicinity Information
Properties to the east, south, and southwest are all zoned and
developed C- G (General Commercial) . Properties to the northwest
are zoned C-P (Commercial--Professional) . Properties to the north
are zoned and developed R--12 (Residential, 12 units per, acre) .
3 . Site Information ;and Proposal Description
'The applicant wishes to establish a temporary stand for the sale
of fireworks. The proceeds are to be used to raise funds for th.e
Tri-City Baptist Temple Youth Camp. The stand is proposed to be
open from June 7.3 to July 6, 1906. It will be lactated in the
southeast corner of the parking lot which serves numerous retail.

stand and approximately 10 to 15 for customers .
4. Agency and NPO Comments
The Police Department has reviewed the proposal and has the
following comment:
A setback distance of at least 20 feet is suggested for all sides
of the stand which are adjacent- to telephone and/or utility poles.
The. Washington and 'lualatin rural Fire Districts have reviewed the
p-oposal and have the following comments:
The applicants must abide by the state regulations on fireworks as
per ORS 037-12-110(4) , These include that the State Fire
Marshall ' s retail sales permit be posted visibly; that: the

applicant have available a list of what. they are selling for
inspection purposes; that the seller sell only "exempted"
fireworks; and that fireworks not be set off within 100 feet of
the stand.
Furthermore, the stand must. e situated at least 15 feet from all
public right--of-ways, and at least 20 feed from combustible
materials, equipment, or designated exitways. It is finally
suggested that the stand also be set up 20 feet or more from all
buildings .
B. ANALYSIS AND CONCLUSION
The proposed activity is consistent with the approval criteria set forth
in Section 18 . 140.050(c) of the Code. The use will be temporary; safe
access and adequate parking is available; no hazards to pedestrians are
apparent; and r.o adverse off--site impacts are anticipated .
C. DECISION
Temporary Use Permit 5-86 is approved subject to the following
conditions:
1 . The sale of fireworks shall not comt,ence until June 24, 1986 and
no appeals.
2. The fireworks stand shall be removed by midnight July 6, 1986.
3 . The applicant is responsible for compliance with all requirements
of ORS 837-12-110(4), including setback distances for the stand
from public right--o�--waya . '.,uil�ings, combustible materials, etc .
4 . The applicant must maintain a setback distance of at least 20 fret
between the stand and all telephone and utility poles .
5. This approval i? valid if exercised within one year of the final.
decision date noted below.

Re: Remodel of Tigard Plaza Basement
Dear Ed:
This is a follow-up letter as per our conversation this
morning with regards to the review of the plans of this
remodel .
1 . All doors leading into the exit corridor that are required
to sw4ng in the direction of egress must be so placed as
not to restrict corridor width by 50% when the doors are
open in any position. Those doors being the ones from
the Health Habit, the two exit doors from the Dance Studio.
All other doors may swing in to the rooms that they serve.
All doors in corridor wall must be not less than 20-minute
labeled with self-closure panic hardware as provided in ,your
drawing.
2. At the entry of the School of Dance , there is a change in
elevation. According to the plans , there are two risers,
however, on visual inspection, there proved to be only one
riser which by the code requires any change in elevation
of less than 12" must be via ramp.
3. 3312(c) of the Oregon State Structural Specialty Code
requires illuminated exit lighting with two separate circuits.
Exit lighting shall he from the School of Dance and throughout
the exit corridor system, and shall clearly indicate the path
of egress.
4. The three doors in the exit corridor that are directly beside
the stairwell -- they may swing into the corridor, however,
they must be supplied with automatic closures.
5. Corridor walls must terminate at the underside of the floor
above with not less than 1 hour construction. (Ed -- this item
we did not talk about in our meeting. This is an afterthought) _
A walk-through indicated that the walls did not extend completely
to the floor above. There was an area of a foot gap between the
top of the wall and the concrete floor above.

6. The plans indicate that Scott Mountain front entrance door opens in.
Because of the er.cupant load, this door must open outward.

leave the automatic sprinkler equipment ineffective in providing adeOuate
protection. If any of the above should occur, this department may write
orde'rs to cease and desist operations , orders to vacate. or orders to
upgrade fire protection.

from other areas by at least one-hour fire resistive construction. Furnace And boiler rooms

28. A.S.M.F.. approved pressure relief valves are re,uired for all water heaters, installed
either in separate water tank port or in port for hot water line. Shutoff valves may not
be located between a water tank and relief valve.
29. A firefighting water supply is required within 500 feet of building that is capable of
producing 500 gpm (rdnimum) for 10 minutes for each 5,000 square feet of floor area within
building up to a maximum of 500 qpm for 30 minutes, or provide a 5,000 to 15,000 gallon
reserve water supply as required,
30. Interior wet standpipe, at least 2 inches in diameter located and equipped as per fec. 3804
